These are our standard terms and conditions of acting. By signing them, you agree to be bound by them.
Definitions
The Services
The services referred to in clause 1 hereof.
Finder’s Fee
1.5% of the purchase price (including VAT) subject to a minimum fee of £2,500.
The Term
Six calendar months from the date hereof.
Termination Date
Four weeks from the date a written notice of termination is received by either party.
Terms and Conditions
1.We undertake to use our best endeavours during the Term to:
a.find and submit to you a selection of suitable properties to purchase;
b.assist you to negotiate the terms of any purchase; and
c.enter into direct negotiations on your behalf with sellers and their respective agents.
2.The Client gives the Finder the exclusive right to search for property on the Client’s behalf during the Term.
3.The Finder’s Fee is payable upon completion of the purchase in respect of any property which we introduce you to during the Term.
4.If, within twelve months of the Termination Date, you acquire any property which we introduced you to during the Term, the Finder’s Fee will be payable in full in any event.
5.If the Finder’s Fee remains unpaid for 14 days or more from the date of completion (purchase) interest will be charged at a rate of 4% per annum above the base lending rate of National Westminster Bank until full payment is received.
6.Termination of the Agreement can be made by either party giving four weeks’ notice of termination in writing to the other party. Such notice may only be given after the expiration of four weeks from the date of this Agreement.
7.Any advice which we may offer you during the Term reflects our opinion only, and is not a representation of fact, or a warranty, or any like or similar thing. Before committing yourself to buying any property introduced to you by us, you agree to first satisfy yourself as to the suitability of the property (and whether by obtaining independent professional advice or otherwise) including but not limited to, it’s value, structure, condition, location and title.
