TERMS & CONDITIONS

1. INTRODUCTION:

2. SCOPE OF WORK:

Providing Conference hall Table with chairs, 34 Person with Revolving Chair, 02 Executive Chair,(Company perrence Gooderj.) sound system attach (Ahuja) projector with screen (motorized)OFFICE OF UOCB LOCATED AT 2nd FLOOR, KISAN BHAWAN, MUSSOORIE BY PASS, RING ROAD,NEHRUGRAM, DEHRADUN, Uttarakhand (India) Tel: 0135-2662770, Fax: 0135-2662771, Web: E-mail: th fitting and all included work as per work order issued by the office. All work to be complete as perdrawing provided.

3. PRE-QUALIFICATION CRITERIA :

3.1. Pre-qualification will be based on meeting the following minimum criteria regarding the firm’swork experience and financial position, as provided by the firm's in the tender. (Technical Bid).

3.2. The firm to meet the following minimum criteria for Pre-qualification:

(a) Average Annual financial turnover for similar works during the last three years, ending 31stMarch, 2015, should be at least Rs. 20.00 lakh.

(b)The firm should be registered with the commercial tax department and income taxdepartment with valid TIN No. and PAN.

3.3. Definition of “Similar Work”: Experience in carrying out works consisting glass partitions and

related work etc. in Government Organizations /Semi Government Organizations / Large PrivateSectors.

4. EARNEST MONEY DEPOSIT (EMD):

The Bidder shall furnish EMD of Rs.15000/- (Fifteen thousand only) along with the tender in theshape of demand draft in favour of “Secretary, UOCB ” payable at Dehradun. EMD shall bereturned to the unsuccessful bidders after award of work. EMD of successful bidder shall beadjusted in the security deposit. The tender not accompanied with requisite amount of EMD shallbe rejected.

5. SITE VISIT:

The bidder is advised to acquaint himself with the job work, visit the Site & examine site conditions,climatic conditions, labour, power, material availability, transport and communication facilities etc.in order to collect information that will be helpful for preparing the bid and entering into a contract. The cost of visiting the Site and collecting information for the purpose of submission of the bid shallbe borne by the bidder himself.

6. SUBMISSION OF TENDER:

The bidder shall submit the tender in the sealed envelope in the following way.

Envelope No. 1 – This envelope will contain Technical Bid, EMD in the form of demand draft for

Rs. .15000/- (Fifteen thousand only) in favour of “Secretary, UOCB” payable at Dehradun.duly signed and stamped by the bidder along withdocuments in support of fulfilling the pre-qualification criteria (copy of experience certificates, balance sheets, registration certificates of firm etc.) and marked on top of envelop “Technical Bid”.

Envelope No. 2 – This envelope will contain Financial-Bid only and marked on top “Financial Bid.Price shall be quoted by the bidder on the Financial-Bid format enclosed with thetender by UOCB. Both the sealed envelopes No. 1 & 2 shall be then put in a bigger envelope duly addressed to“Managing Director, uttarakhand Organic Commodity Board (UOCB), 2nd FLOOR, KISAN BHAWAN, MUSSOORIE BY PASS,RING ROAD,NEHRUGRAM, DEHRADUN” and marked on top Tender for “Providing Conference hall, furniture.

7. EVALUATION & AWARD OF WORK:

The bids will be evaluated as per the Pre-Qualification (PQ) criteria given at point no. 3 above. Thebids which are found to be fulfilling the PQ criteria shall only be considered for opening ofFinancial-Bids. The work will be awarded to lowest responsive (L-1) evaluated bidder. Thecompleted works of the bidder may be visited by UOCB team before award of the work.

8. PERFORMANCE SECURITY:

8.1 Within 7 days of receipt of work order from UOCB, the successful firm shall furnish thePerformance Security equivalent to 10 % of the contact value in the form of Bank Guarantee (fromany Nationalized /Scheduled Bank) valid for 60 days beyond expiry of the Defect Liability Period inthe form of Demand Draft/ Pay Order in favour of “Secretary, UOCB” payable at Dehradun.

8.2 Failure of the contractor to comply with the requirement of contract shall constitute sufficientgrounds for the annulment of the award and forfeiture of the performance security / Demand Draft/Pay Order , in which event UOCB may get the work done at the risk & cost of the firm.

9. CONTRACT AGREEMENT:

UOCB will notify the successful bidder that his tender has been accepted and it will send a workorder to the bidder describing the works to be carried out and the same shall be returned dulyacknowledged affirmatively by the bidder as a token of acceptance. Contract agreement will besigned between both the parties on the agreement form. The firm shall present the agreement on appropriate value of stamp paper for signature of UOCB.

10. TIME OF COMPLETION:

The work shall be completed within 1 (One) month from the date of issue / receipt of work order.

11. LIQUIDATED DAMAGES/PENALTY FOR DELAY:

If the firm fails to complete the work within the stipulated time or time extended by the UOCB (ifany), liquidated damages at the rate of 1% per week of delay subject to maximum 10% of the totalcontract value shall be deducted/ recovered from the firm.

12. SPECIFICATIONS:

The materials supplied and proposed to be used in the work shall be of requisite specifications,

manufactured by reputed companies in the industry. The make (brand name) of materials to be

used shall be as specified in the original tender paper submitted by the agency. The materials

brought to site would be got checked before installation & utilization.

13. DEFECT LIABILITY PERIOD::

The work/ materials of the firm shall be under one year’s Defect Liability Period (DLP). Defect/snoticed during the defect liability period shall be rectified by the firmr without any cost to UOCB,failing which the Security Deposit of the Contractor shall be forfeited. The contractor may also bedebarred from any future tendering in the UOCB.

14. PAYMENT:

Payment will be made after completion of work & handing over of the work and production of bill bythe firm. The payment shall be released within 30 (Thirty days from the date of receipt of the bill. Applicable taxes and TDS etc. will be deducted from the amount payable to the firm. The paymentwill be made as per the measurement and verification of the work by the UOCB officials. Noadvance payment shall be made to the firm.

15. TOOLS & TACKLES, WATER & ELECTRICITY:

All tools, tackles such as glass cutters, drill machine set, ropes, working plate forms etc. will bearranged by the firm and their charges will be deemed to be included in the quoted rates, no extrapayment shall be made for the same.Water & Electricity for carrying out the said work will be provided free of cost by UOCB, at one

point from where contractor will make arrangement of pipes, cables, power plugs, sockets etc. toextend the same to work site.

17. RISKS:

Contractor shall be solely responsible for safety of his workers, working at site by taking insurance

cover and by following all safety norms in the trade.All risks of loss or damage to physical property and of personal injury and death which may ariseduring and in consequence of the performance of the Contract are the responsibility of the firm.

18. DISPUTES:

All the legal disputes shall be to jurisdiction of Dehradun Court only.

19. RIGHT TO ACCEPT OR REJECT THE TENDER:

Managing Director, UOCB, reserves the right to accept or reject any or all the tenders without Assigning any reason thereof.
