Re: Government-imposed Fraud Prevention and Detection Fee

The “Consolidated Appropriations Act, 2005 (H.R. 4818) requires a fee for H-1B immigration status applicants beginning on March 8, 2005. Section 26 of the Act reads:

“Adds to INA Section 214© a new $500.00 fraud fee. Such fee will be in

addition to other fees and will apply to employers filing either an initial

petition for an H-lB or for a change of status petition.”

The employing department at the university is required to pay the $500.00 fee for this applicant.

(The department making the hiring decision will be responsible to fund payment of the $500. The only restrictions on types of funds to be used would be related to contract/grant funds. The fee could only be paid if the contract/grant allowed such expenditure and the individual is physically expending effort on and benefiting the project. Any fee to be paid from a grant/contract account is to be paid in proportion to the level of effort proposed and supported by the grant/contract for that specific individual (i.e. if personnel are paid 50% time from the grant/contract, then only 50% of the fee may be charged to the account).

·  This anti-fraud fee is in addition to the application fee of $325.00

*Check must be received in OIE before the H-1B application can be sent to Homeland Security. Any checks sent directly to Homeland Security will be considered lost and will have to be re-issued.
