All prospective bidders are required to submit their acceptance to the following Terms & Conditions on their Company’s letterhead duly signed and stamped by respective authorized personnel (Refer Annexure A). Also clarify if there is any deviation to the same.
TERMS & CONDITIONS
THE OFFERS ARE INVITED FROM MANUFACTURERS/ OEM OF THEBaggage Gauge with Weighing Scale.AIR INDIA EXPRESS PREFERS TO DEAL DIRECTLY WITH MANUFACTURERS. However, if a manufacturer prefersauthorized dealer-distributors to bid on their behalf, then only on specific authorization of manufacturer, the proposal will be accepted only from such authorised dealers - distributors.
1. The Authorized dealer/distributor should have dedicated business line in such equipment.
2. The authorized dealer/distributor should have their own facility / capabilities for repair, maintenance, warranty and post warranty services support. Such a facility should be independently owned and operated by the dealer/distributor with the manufacturer certification or should be in technical collaboration /joint venture with the said manufacturer.
- Principal/OEM itself or authorized agent/dealer of the Principal/OEM can submit the bid but both cannot bid simultaneously for the same item/product in the same tender.
- Bidder must provide acceptance to Air India EXPRESS Ltd.'s Terms and Conditions of the tender on their letterhead in the format attached with stamp and signature of the authorized signatory. Any deviations from the specifications or terms and conditions must be clearly spelt out.
- Bidder should submit technical literature / specifications with corresponding company Part numbers along with their technical bid.
- Bidder must quote well in time, before the scheduled close date and time. A request for extension on the last day or last few hours will not be binding and will be considered at the sole discretion of Air India EXPRESS. The final decision will rest solely with Air India EXPRESS
1 Commercial Terms
IPayment within 60 days
Payment terms -within 60 days of submission of Invoice or receipt of goods whichever is later.
II Mode of Payment
Payment will be made through the Mumbai office of Air India EXPRESSpreferably by ECS. Kindly provide the following information:

III Penalty Clause
For delayed deliveries a penalty of 0.5% per week or part thereof of the value of the undelivered portion of the baggage gauges (excluding taxes and delivery charges) subject to a maximum of 10% of the value of the undelivered part will be recovered from the amount due to vendor after due notification to vendor.

Delivery schedule should be within ten days OR earlier.

VI Warranty
Minimum one year warranty on weighing scale is required. Please mention your best warranty periodfor the subject item.
VII Price Negotiation
As our company policy does not permit post-tender negotiations, you are requested to submit your best quote at this stage itself. Post-tender negotiations will be in exceptional cases with the L1 bidder only.
VIIIFall in Price
Price should remain firm till the date of release of Purchase order. If for any reason there is a downward revision in prices, the successful bidder will be responsible for passing on the benefits to Air India Ltd.
IX Exit/Cancellation
The PO may be terminated under the following circumstances :
· In the event of unsatisfactory performance during the PO period, PO shall be cancelledwith advance notice.
· If there is change in Air IndiaEXPRESS Ltd. requirement, PO shall be cancelled with advance notice.
X Exemption / Preference to MSE units
1. As per Public Procurement Policy for Micro and Small Enterprises (MSEs) Order, 2012 issued vide Gazette Notification No. 503 dated 23.03.12 by Ministry of Micro, Small and Medium Enterprise of Govt. of India., MSEs must be registered with any of the following in order to avail the benefits / preference available vide Public procurement Policy MSEs Order, 2012
(1) District Industries Centres (DIC)
(2) National Small Industries Corporation (NSIC)
(3) Any other body specified by Ministry of MSME.
2. MSEs participating in the tender must submit the certificate of registration with any one of the above agencies indicating the details of the particular tendered item along with their bid.
3. The MSEs registered with District Industries Centres must submit the Acknowledgement of Entrepreneur Memorandum (EM) Part-II along with their bid. The MSEs registered with National Small Industries Corporation (NSIC) must submit the valid NSIC registration certificate along with their bid.
4. The Micro and Small Enterprises not registered for the particular trade/item for which this tender is relevant, would not be eligible for exemption / preference.
5. The registration certificate issued from any one of the above agencies must be valid as on close date of the tender.The successful bidder should ensure that the same is valid till the end of the contract period.
6. The MSEs, who have applied for registration or renewal of registration with any of the above agencies/bodies,but have not obtained the valid certificate as on close date of the tender, are not eligible for exemption / preference.
7. Price Preference- The MSEs registered with above mentioned agencies/bodies for the tendered item and quoting price within a price band of L1+15 percent shall be allowed to supply a portion of requirement by bringing down their price to L1 price in a situation where L1 price is from
other than a MSE and such MSE shall be allowed to supply up to 20 per cent of total tendered quantity. In case of more than one such MSEs are in the price band of L1+15 % and matches the L1 price, the supply shall be shared proportionately (to tendered quantity).
8. Preference for MSEs owned by Scheduled Castes or Scheduled Tribes–20% from the 20%quantity (i.e. 4% of the tender quantity) offered to the MSE’s shall be reserved for MSE’sowned bySC/STs. In event of failure of such MSE to participate in tender process or meet tender requirements andL1 price, 4 per cent quantity for MSEs owned by SC/ST entrepreneurs shall be met from other participatingMSEs.
XI Arbitration
Any dispute arising between the parties in respect of the construction, interpretation, application, meaning, scope, operation or effect of this document or the validity or breach thereof, shall first be settled by mutual consultation. if the dispute remains unresolved after a period of 90 days from the date when the mutual consultation has started, the matter shall be referred for settlement to 'SCOPE FORUM OF CONCILIATION AND ARBITRATION', Govt. of India, and the award made in pursuance thereof shall be binding on the parties.
XII Jurisdiction
Any dispute whatsoever shall be subject to the jurisdiction of the courts of Mumbai.
XIII Loading Criteria :
1) In case of deviation from Payment Terms, such as advance payment or payment against delivery, the price of bidder would be loaded @ 18% per annum on the basic price, calculated on pro-rata basis.
2) In case of deviation with regard to warranty period beyond the specified period in the RFx, the price bid of the bidder would be loaded @ 10% per annum on the basic price, calculated on a pro-rata basis.
3) In case of deviation with regard to delivery period beyond the specified schedule in the RFx,the price bid of the bidder would be loaded @ 12% per annum on the basic price, calculated on a pro-rata basis.
XIV Price Bid Criteria
GST should be quoted separately, i.e the quoted price should be Basic + Applicable charges + GST. No request for taxes to be added separately in the quoted price will be accepted later on.
XV Pre Delivery Inspection
Pre- Delivery inspection may be carried out by Air IndiaEXPRESS Representative at vendor’s site free of cost and it will be at sole discretion of the Air India EXPRESS to conduct the same.
2 Technical Terms
I Quality Assurance Certificate
Every supply should be accompanied with a 'Quality Assurance Certificate' (QAC) indicating that the BAGGAGE GAUGESso supplied are in conformity with the specifications given in the purchase order.
II In-house inspection
Air India reserves the right to inspect the BAGGAGE GAUGES at its discretion before accepting the material. In case any deviation in quality is found at the time of supply, then the same will be rejected and should be replaced free of cost.
Non adherence to this clause may lead to cancellation of Purchase Order and Air India EXPRESS reserves the right to with hold the invoice for that shipment.
3 Award Decision
I Award Criteria
The vendor whose net price (on common platform such as landed cost) works out to be the lowest will be determined as L1 bidder.

I Validity of Quote (Two Bid)
The validity of your quote should be for a minimum of 120 days from the opening date of Tender.

IV Submission of Bid : (Two Bid System)
. You are, requested to submit your quotation in two bid system i.e. (Techno-commercial Bid) and (Price Bid as per attached format) in sealed envelopes.
1. Bidder should submit in TWO BID SYSTEM, Commercial Bid (Price Only as per attached format) & Techno Commercial (Technical Information) in two separate sealed envelopes, super scribing Tender No., Due date, along with Contact Person's name, contact number and e-mail ID.Pleasenote that non adherence to this aspect may result in rejection of your bid.
2.Both the RFI and RFQ envelopes can be put in Master envelope. This master envelope should be superscribed with both RFI and RFQ no. and the close date along with Contact Person’s name and e-mail ID. Please note that non adherence to this aspect may result in rejection of your bid. However, if the techno-commercial bid and the price bid are in open condition, when the sealed master envelope was opened, your bid will stand disqualified.
3. Bidder should provide acceptance to AirIndia's Terms and Conditions on company’s letter head as per format given below. Any deviations from the specifications or terms and conditions must be clearly spelt out in the quotation.
4. Your Technical bid should not mention any rates/prices.
5. Any other applicable taxes/levies should be clearly mentioned in your quotation.
