6209.13 / Adds Forests direction for handling FOIA requests.

12 - REQUESTS. A copy of all Freedom of Information Act (FOIA) requests shall be forwarded to the Forest FOIA Coordinator. Processing may be done at District level or SO depending on the volume and nature of request. The District SSS will act as the District FOIA Coordinator. All log numbers will be issued from the SO -- call Headquarters mailroom to request log number. If more than one District receives the same FOIA request, the SO will respond with the Districts supplying the documentation, if needed.

1. MINOR REQUESTS (Walk-in's, telephone requests). All minimal requests can be tallied on the FOIA cost record form for one month and sent to the Forest FOIA Coordinator. See Exhibit A

2. MAJOR REQUESTS (More than one District or Forest receives a request from the same person or group).

The Forest policy is to respond only once to a requestor encompassing every item in the request. Consistency in what documents are being supplied by each District must be maintained to avoid any legal consequences.

Copies of all FOIA requests and responses under this designation will be forwarded to the Forest FOIA Coordinator. If one District does not have information to supply, they need to inform the Forest FOIA Coordinator.

Case files need to be prepared for each FOIA request and labeled as shown in Exhibit B. Each file needs an identifying number such as 001-94 as shown in Exhibit B. Files are not to be labeled with the requestors name.

An annual FOIA Report is due in the RO by January 15 of each year, covering the previous calendar year. Therefore each District will maintain a log sheet on all written and verbal FOIA requests. The District FOIA log sheet will be sent to the Forest FOIA Coordinator monthly.

SEARCH VERSUS REVIEW. "Search" time is the time spent looking for documents/information responsive to a request (not just going to a file cabinet and pulling the files). If documents must be read to determine whether they contain information requested, this can be considered "search" time.

"Review" time is the time spent reading the "responsive" documents to determine whether the information is releasable.

BILLS FOR COLLECTION. Reference FSH 6209.13, page 14 through 14.1--6, Exhibits 1 through 3 for fee schedule and charges. Ensure checks are made payable to: "TREASURY OF THE UNITED STATES."
