Custer County Commissioner Meeting

Date: October 23rd, 2013

Chairman Bies called the meeting to order at 8:00 a.m. with the Pledge of Allegiance. David Hazeltine, Jim Lintz, Phil Lampert, Mark Hartman, Tracy Kelley, State’s Attorney and the Auditor were present.

The Board moved to approve the agenda as presented. Motion carried. In the following proceedings, all action taken was first duly moved and seconded, received a unanimous vote of the Commissioners without dissenting vote or abstention, unless otherwise stated.

Minutes

The Board moved to approve the minutes of the October 9th, 2013 commission meeting as presented. Motion carried.

Declaration of Conflict of Interest-None declared

Mike Carter, Director of Emergency Management

-By consensus, the commissioners decided that the county should provide a burial pit for the disposal of animal carcasses in the eastern part of the county. Mike said all permitting procedures were completed. School and Public Lands gave permission for use of leased land located in Section 36, Twp. 2 South, Range 10 East. The Board moved to leave it up to the Custer County Highway Department and Emergency Management to continue operation of the pit at their discretion. Motion carried.

Custer County Planning

Final Plat- 2013-9 Haywood Estates Subdivision- Legal Description: Parcel 3834 & 3835. Plat of Tract Willow Run of Haywood Estates, (Formerly Tracts 3 and 4 of Haywood Estates), located in SE1/4SW1/4 Section 21, T2S, R7E, BHM, Custer County, South Dakota. Applicant is Mathew and Jamie Roder. The Board moved to approve the final plat of the residential subdivision as recommended by the Planning Commission, provided that all conditions have been met. Motion carried.

Final Plat-2013-10 Plat of Tract C, D and E of JK Ranch Subdivision –Legal Description: Parcel 1924; A Plat of Tract C, D and E of JK Ranch Subdivision containing a part of Lot AB-2 of HES 59, and a part of HES 59 located in the SE4 of Section 2 and the NE4 of Section 2, T5S, R4E, BHM, Custer County, South Dakota. Applicant is Isa and Jack Kirk. The Board moved to approve the final plat of the mixed use subdivision as recommended by the Planning Commission, provided that all conditions have been met. Motion carried.

Wireless Telecommunication Facility Modification

Herman Rausch Subdivision –Legal description: Parcel ID: 5512. Lot 1 Revised of SE4NE4 & NE4SE4 Sec 2 T-3S R-7E, BHM, Custer County, South Dakota. Applicant is SMJ (Agent for AT&T Mobility).The Board moved to approve the application conditioned upon receipt of the Performance Security bond in the amount of $25,000.00 as required by Ordinance 15. Motion carried.

Tim Holland, Custer County Housing Update

-Tim updated the Board on the progress being made with Custer County Housing. Tim introduced Tammy Burtness with MetroPlains Management, LLC, who is with the company managing some of Custer County Housing’s properties. Custer County Housing may be losing board members in the future. In the event that happens, Custer County will publish a request for letters of interest in the paper.

Mike Mooney, Assessor Access to Locked Property

Mr. Mooney wanted to make the county commission aware that assessors from the equalization office had entered through a locked gate on his property in the course of performing their duties. The concerns over his liability and the safety of the assessors were discussed. Allison Jensen, Director of Equalization, confirmed that Mr. Mooney would be notified of such assessments in the future.

Betty Dikoff, Ag Status Letter

-Betty, along with several other taxpayers from the eastern part of the county, had questions about the letter and form regarding the application for ag status for 2014 assessment year received from the director of equalization. The cover letter asks for receipts for proof of productivity, copy of lease for leased property and federal tax returns. Many were concerned about public access to the personal information that they provided. Allison assured them that this information was kept in a separate file and not open to the public. Federal tax returns are returned to the customer or shredded and only used in the calculation to determine gross income. Many taxpayers have verbal leases and asked how they could meet the criteria of providing a written lease. The Board agreed that an affidavit could be signed by the lessee/lessor swearing under oath that a lease exists.

Mail Call

-The Board acknowledged a thank you letter from the Storehouse for 3rd quarter budget of $875.00.

Travel Requests

The Board moved to approve the following travel requests. Motion carried.

-Ken Irwin made a travel request to attend the Veteran’s Mini Conference in Sturgis on October 22nd at a cost to the county of mileage.

-Joel Behlings made a travel request to attend the 2013 Annual Safety & Loss Control Training Conference in Mitchell on November 20-21 at a cost to the county of $172.00

Meeting Schedule

-Lintz Bros. Pizza in Hermosa at 11:30 on October 23rd to hear John Thune speak.

Indigent (Executive Session)

-Action was taken to go in and out of executive session to consider indigent claims. The session began at 8:23 a.m. and adjourned at 8:27 a.m. The Board reviewed an indigent request for rent and medication in the amount of $2,000.00. The Board moved to deny the request due the fact that all avenues of assistance have not been exhausted. Motion carried.

Human Resources/Personnel

-The Board acknowledged a letter of resignation from Teri Morgan from Director of Equalization office effective 10/25/13 and a letter of resignation from Pat Winter from Treasurers effective 10/21/13. Teri has transferred to the Register of Deeds office and Pat has transferred to the Auditor’s office.

-The Board moved to approve the hire of Roberta Upton as a part time janitor for the county part of the Hermosa city hall. Motion carried. She now works at that location and will do the county janitor work along with her librarian duties. Her start date with the county was 3/19/07 and she will stay at her current wage of $12.75 per hour. She will only work 20 hours a month as a janitor.

Surplus

-The Library made a request to surplus a Dell monitor CN-0G422H-72872 to landfill. The Board moved to approve the request. Motion carried.

General Fund Surplus

-The General Fund Surplus analysis completed as of September 30th, 2013 shows the unassigned balance to be $1,205,951.12 resulting in a fund balance percentage of 27.87%.

Department Update-Library

Doris Ann Mertz gave the Board an update on activities in her department.
