RE: Individual Landscaping and Deck/Patio Modifications

Dear Unit Owner:

During the last year or so we have had a number of residents who have expressed a desire to upgrade or modify the exterior of their units, primarily by way of adding to existing decks patios, front porches and/or landscaping the areas near their unit. This letter is to remind unit owners of Sparrow Pond’s policies and procedures regarding any changes to the exterior of individual units and the necessity of obtaining Board approval before initiating any project that affects the “Common Elements” or “Limited Common Elements” of Sparrow Pond.

As a starting point, please remember that your actual ownership of your unit is limited to the interior of your unit. The exterior of your unit, including patios, decks, front porches, etc. are designated as “Limited Common Elements” and are owned by the Association as a whole. Even though “Limited Common Elements” are for the exclusive use of the owners and occupants, and the owners are responsible for maintaining the “Limited Common Elements”, our governing documents require that any alterations or modifications to either the “Limited Common Elements” or the general “Common Elements” require prior Board approval. This means that a comprehensive written plan of any proposed project must be presented to the Board and Board approval be obtained before any project begins. A copy of the form used to present any proposed modifications is attached and these are also available from GL Management. The Board meets once a month and is required to act on a modification request within 60 days of receiving a properly submitted request. If a project is commenced before the Board acts on a request for approval the Unit Owner may be subject to paying for the cost to return the area to its previous condition.
