We will arrive approximately 1 hour before your “Dipping Start Time” to set up the fountain and will begin to take down after 3 hours dipping time (or earlier if requested).

Terms and Conditions
1. Each fountain when fully loaded with chocolate can weigh over 120 lbs. The Hirer will be required to provide a suitable sturdy and level table on which to locate the fountain.
2. A white table cloth will be provided to place under you illuminated display.
3. A 240V electrical socket will be required within 5 feet of the fountain. If the fountain is to be located in the middle of an open area, be aware that trailing leads may be necessary. Any such leads will be taped to the floor wherever possible, however although all care is taken, no responsibility for accidents can be accepted. Our recommendation is to have access from one side of the fountain only.
4. The quantities of dipping items provided by the Company is dependent on accurate guest numbers
being advised by the Hirer. If these numbers are incorrect, no liability will be accepted for any decision
to shorten the dipping time due to non availability of dipping items or to simply not set up at all.
5 *. Deposits paid for booking of Chocolate Fountain equipment are not refundable in the event of cancellation of booking unless the same piece of equipment can be re-hired to another hirer for the same date. In cases where a refund is approved by the company, 25% of the monies paid will be retained by the Company to cover costs associated with the cancelled hire. In exceptional circumstances, a full refund may be offered at the discretion of the Company.
6. Booking dates are provisional only until confirmed by Ice Fantastic/Fantastic Chocolate Fountains and the booking deposit is received. If a booking request cannot be honoured by the Company, the Hirer is due a complete refund of all monies paid and subsequent claims for incidental damages from the Hirer due to the cancellation of the booking by the Company will not be accepted.
7. Final payment of outstanding monies due for the hire shall be paid by the date due, or in any case, no later than 7 days prior to the event if paying by cheque or credit/debit card/Paypal. Payment in cash can be made to the fountain Operator on the day of the event, before setting up the fountain. If the authorized cash payment is not made at that time, no responsibility will be accepted if the fountain is not set up when the event begins. The fountain operator is not authorized to begin the fountain setup until all outstanding hire charges have been paid.
8. Force Majeure. The due performance of this contract is subject to alteration or cancellation by the Company owing to any cause beyond their control. Liability shall be limited to a full and complete refund of all monies paid. The Company cannot be held responsible for any equipment failure, nor circumstances beyond its control, which may result in the inability to fulfil its contractual obligations.
9. The Company cannot be held responsible for any loss caused by changes of venues, times or dates made by the Hirer unless written notification is given to the Company. This advice must be at least 48 hours before the event.
10. Any out of pocket expenses incurred by the fountain operator on the day of the event (ie Car Parking Fees or any other expenses that were not expected, or we were not previously made aware of) will be charged to the Hirer.
11. The Company reserves the right to vary the personnel, numbers of personnel or the equipment specified, especially when changes are notified by the Hirer at very short notice. The decision of the Company concerning these matters will be final.
12. This is not a hire purchase agreement.
13. During the continuance of the Agreement, the fountain and accessories remain the property of the Company at all times and the Hirer shall not sell or offer for sale, assign, mortgage, pledge, lend or otherwise deal with the equipment and shall take all reasonable precautions to safeguard the equipment.
14. The Hirer's statutory rights as a consumer are not affected.
15. The Hirer agrees to these Terms and Conditions.
