Minutes for the meeting held on Saturday 29th September 2012 at 63 Oldfield Lane South

Subject :- Parking rights and access to rear of dwellings.

The chair opened and explained that the meeting was called to resolve a parking dispute.

Sarah sent her apologies, explaining in a letter that it was regrettable that as parking had occurred in harmony for many years, that this conflict had occurred now.

There had been insufficient information relating to the property ownership in the company files, so documentation relating to the title plans for each flat, acquired from Land Registry were distributed along with a copy of the lease document.

The Land Registry documents (copy attached) show that

  • the land is owned by the occupants of the ground floor flats
  • the upstairs flats having no ground ownership other than where their stairs meet the ground.

The title plans show that whereas it had been assumed that the driveway was a communal area the drive is in fact owned by individual ground floor occupants.

The lease states however that access must be permitted to all occupants across this land to gain access to their garage.

While the land owners may park vehicles upon their own property, this must not impede access for other residents to their garages.

It was agreed by all present that this was fair.

Both flats 5 and 7 expressed that they did not wish other residents to use their land for parking.

Brendan of flat 2 requested that access be made available to allow use of his garage for the parking of a vehicle.

It was agreed by all present that this would be possible and Sarah had indicated by a letter that the red van would be removed from the site shortly.

The issue was raised again about parking on the communal footpaths. Although this now mostly affects flat 1 and 2 due to the bollards, everyone was reminded that this is a footpath that should be kept clear for access at all times, that path is also not reinforced and covers the main sewerage drain. Damage to the pathway could lead to damage to the drain.

Fiona stated that the lease documents show that flat 8 entitled only to store a dustbin under the stairway leading to their flat, and requested that all other items be removed.

Those present were asked if they had any other issues relating to parking or land ownership. There were no further issues.

Any Other Business

Rani complained that flat 7’s motorhomes skylights allowed a view into flat 8’s bedrooms making her feel uncomfortable.

The chair explained that this was not a company issue and was a problem that was experienced by all the occupants of the ground floor flats.

Danny stated that he would like to see improved security on the site. He suggested that an entrance gate and security cameras could be installed.

The chair explained that the issue of the gate had already been investigated and would require planning permission from Ealing council to construct a suitable structure.

The chair explained that he did not have sufficient time to pursue this matter, and asked if any of the other company members would be willing to take it on. Danny said that he would be happy to investigate this further.

The chair explained that the installation of security cameras was a matter for individual occupants, as a communal system would be difficult to implement

Brendan raised a problem with foxes and rats being attracted to household waste. All residents were reminded to please ensure that all food waste was placed inside their bin with the lid secured, and not left in black sacks on the ground.

The issue of Flat 3’s bin, which has not been emptied now for some time, was raised again as the council will not take waste that is not in black sacks.

The current owners explained that the flat had been put on the market for sale and was now ‘under offer’ and any further matters should be taken up with the new owners.

The meeting was closed with no further questions.
