[1]Page numbers should not appear on the draft index that is filed for settling or on the clean copies that are filed following settling of the index. They are inserted only when the appeal books are prepared.

[2]If any document has been amended, include only the final version of the document and the date it was filed.

[3]If the chronology has been agreed by the parties, include only the agreed chronology described as “chronology” – rule 38(2)(i).

[4]The certificate of correctness should be signed by the person who prepared the appeal booksand the respondent – rule 41(c).

[5]Separate blue and green appeal books are not required. The relevant documents should be included in a combined blue and green appeal book.

[6]Where it is intended to include the entire transcript, the Court prefers that the transcript be electronic. When there is electronic transcript, there is no need to separately identify the witnesses or parts of the transcript.

[7]Include only those exhibits or parts of exhibits that are needed to consider and decide the issues in the appeal as referenced in the parties’ submissions – rule 37(2).

[8]When describing an exhibit, the description should not be taken from the record kept by the Associate but from the document itself.

[9]It is not necessary to reproduce all documents in the bundle – include only those that are needed to consider and decide the issues in the appeal. If the bundle of documents contains a numbered index, include the exhibit number as shown in item 4. If the documents in the bundle have not been separately indexed, list the documents as shown in item 5.

[10]Exhibits which are to be used at the hearing of the appeal but which, for whatever reason, cannot be incorporated in the appeal book.
