DOCUMENTS THAT PROVE ELIGIBILITY

TO WORK IN THE UK

LIST A – Documents that provide the defence if produced alone

1. A passport showing that the holder, or a person named in the passport as the child of theholder, is a British citizen or a citizen of the United Kingdom and Colonies having the right ofabode in the United Kingdom.

2. A passport or national identitycard showing that the holder, ora person named in the passportas the child of the holder, isa national of the EuropeanEconomic Area or Switzerland.

3. A residence permit, registrationcertificate or document certifyingor indicating permanent residenceissued by the Home Office, theBorder and ImmigrationAgencyor the UK Border Agency to anational of a European EconomicArea country or Switzerland.

4. A permanent residence cardissued by the Home Office, theBorder and Immigration Agencyor the UK Border Agency tothe family member of a national

of a European Economic Areacountry or Switzerland.

5. A passport or other traveldocument endorsed to showthat the holder is exempt fromimmigration control, is allowedto stay indefinitely in the United

Kingdom, has the right of abodein the United Kingdom, or hasno time limit on their stay in theUnited Kingdom.

6. An Immigration StatusDocument issued by theHome Office, the Border and

Immigration Agency or the UKBorder Agency to the holder withan endorsement indicating thatthe person named in it is allowedto stay indefinitely in the United

Kingdom or has no time limit ontheir stay in the United Kingdom,whenproduced in combinationwith an official document givingthe person’s National Insurance Number and their name issued by a Government agency or a

previous employer.

7. A full birth certificate issued in theUnited Kingdom which includesthe name(s) of at least one of theholder’s parents, when producedin combination with an officialdocument giving the person’sNational Insurance Number andtheir name issued by a Governmentagency or a previous employer.

8. A full adoption certificate issuedin the United Kingdom whichincludes the name(s) of at least oneof the holder’s adoptive parentswhen produced in combinationwith an official document givingthe person’s National Insurance

Number and their name issued bya Government agency or aprevious employer.

9. A birth certificate issued in theChannel Islands, the Isle of Manor Ireland, when produced incombination with an officialdocument giving the person’s

National Insurance Numberand their name issued by aGovernment agency or a

previous employer.

10. An adoption certificate issued inthe Channel Islands, the Isle ofMan or Ireland, when producedin combination with an officialdocument giving the person’sNational Insurance Numberand their name issued by aGovernment agency or aprevious employer.

11. A certificate of registration ornaturalisation as a British citizen,when produced in combinationwith an official document givingthe person’s National InsuranceNumber and their name issuedby a Government agency or aprevious employer.

12. A letter issued by the HomeOffice, the Border andImmigration Agency or theUK Border Agency to theholder which indicates that theperson named in it is allowed tostay indefinitely in the UnitedKingdom when produced incombination with an officialdocument giving the person’sNational Insurance Numberand their name issued by aGovernment agency or aprevious employer.

Notes:

If one of these documents is checked and copied there is no need to ask for any further documents contained in List 2 below.

Defence can also be established by checking and copying a combination of two original documents included in the following list:

LIST B – Documents that provide the defence if produced in combination

1. A passport or travel document endorsed to show that the holder is allowed to stay in the United Kingdom and is allowed to do the type of work in question, provided that it does not require the issue of a work permit.

2. A Biometric ImmigrationDocument issued by the UKBorder Agency to the holderwhich indicates that the personnamed in it can stay in the United

Kingdom and is allowed to do thework in question.

3. A work permit or other approvalto take employment issued bythe Home Office, the Borderand Immigration Agency orthe UK Border Agency when

produced in combination witheither a passport or another traveldocument endorsed to show theholder is allowed to stay in theUnited Kingdom and is allowedto do the work in question, ora letter issued by the HomeOffice, Border and ImmigrationAgency or UK Border Agencyto the holder or the employer orprospective employer confirmingthe same.

4. A certificate of application issuedby the Home Office, the Borderand Immigration Agency or theUK Border Agency to or fora family member of a nationalof a European Economic Areacountry or Switzerland statingthat the holder is permittedto take employment which isless than 6 months old whenproduced in combination withevidence of verification by theUK Border Agency EmployerChecking Service.

5. A residence card or documentissued by the Home Office, theBorder and Immigration Agencyor the UK Border Agency toa family member of a nationalof a European Economic Areacountry or Switzerland.

6. An Application Registration Cardissued by the Home Office, theBorder and Immigration Agencyor the UK Border Agency statingthat the holder is permittedto take employment, whenproduced in combination withevidence of verification by theUK Border Agency EmployerChecking Service.

7. An Immigration Status Documentissued by the Home Office, theBorder and Immigration Agencyor the UK Border Agency tothe holder with an endorsementindicating that the person namedin it can stay in the UnitedKingdom, and is allowed to dothe type of work in question,when produced in combinationwith an official document givingthe person’s National InsuranceNumber and their name issuedby a Government agency or aprevious employer.

8. A letter issued by the HomeOffice, Border and ImmigrationAgency or UK Border Agencyto the holder or the employeror prospective employer, which

indicates that the person namedin it can stay in the UnitedKingdom and is allowed to dothe work in question whenproduced in combinationwith an official document givingthe person’s National InsuranceNumber and their name issued bya Government agency or aprevious employer.

NB Defence will not be gained if one document from the first combination and one from the second combination is checked and copied.

The following documents are not acceptable

1. A Home Office StandardAcknowledgement Letter orImmigration Service Letter(IS96W) which states that anasylum seeker can work in theUK. If you are presented withthese documents then youshould advise the applicant tocall the UK Border Agency on0151 237 6375 for informationabout how they can apply for anApplication Registration Card;

2. A National Insurance numberwhen presented in isolation;

3. A driving licence issued bythe Driver and VehicleLicensing Agency;

4. A bill issued by a financialinstitution or a utility company;

5. A passport describing theholder as a British DependentTerritories Citizen which statesthat the holder has a connectionwith Gibraltar;

6. A short (abbreviated) birthcertificate issued in the UKwhich does not have details of atleast one of the holder’s parents;

7. A licence provided by theSecurity Industry Authority;

8. A document check by theCriminal Records Bureau;

9. A card or certificate issued bythe Inland Revenue under theConstruction Industry Scheme.
