Building Recycling Lease Agreement AddendumUpdated 11/30/2011
This agreement is made between (BUILDING NAME) at (BUILDING ADDRESS) and (TENANTSNAME) on (DATE).
Beginning July, 1, 2012, two pieces of legislation will go into effect that will make recycling mandatory in Apartment Buildings with 5 or more units.AB 818 Renter’s Right to Recycle Law requires all owners of MFU (> 5 units) to provide recycling services for tenants. AB 341 Recycling Law requires all multifamily units to recycle (> 5 units).In addition, Marin County has set a Zero Waste diversion rate goal for 2025 of 94%. This means that 94% of all materials will not be sent to the landfill but will be reused and/or recycled. This addendum serves as your required notification of the recycling program on this property.
======All residents shall separate all plastic beverage and food containers #1-7; glass bottles and jars;metal food cans, aluminum cans and other bimetal food and beverage containers; paper, newspaper, junk mail, paperboard (like cereal and food boxes) and cardboard forrecycling per the attached recycling guidelines. 30% of the garbage going to the landfill is contaminated paper. In order to save this resource, Marin Sanitary Service requires that paper products be separated from glass, plastic, and metal products. None of these materials shall be deposited in the garbage. Food-soiled papers, such as pizza boxes, are not recyclable and must go in the garbage until a commercial composting program is available.
It is the tenants’ responsibility to participate in the recycling program.You are required to source separate your recyclables (paper/cardboard items and glass/plastic/metal items) and place them in the appropriate containers. (See attached recycling guide). Failure to comply will be considered to be a material violation of this rental agreement and local and state law, which could result in termination of your tenancy as permitted by law.
