License Agreement

Before we can send you your CD-ROM, we will need this form completed and returned to SMPTE (info in box below). Access to and use of VC-1 Test Materials (reference decoder, sample encoder and bitstreams) are subject to the following license agreement:

VC-1 TEST MATERIALS LICENSE

The test materials consist of the set of binary files listed in SMTPE RP228, Annex A (Bitstreams) and Source Code (Software) for the related Reference

Decoder and Sample Encoder.

The test materials were authorized and developed by members of the SMPTE, and are Copyright 2004 by the Society of Motion Picture and Television Engineers (SMPTE) and the authors. Use rights are subject to this agreement.

The test materials are provided on a one-time fee basis. Upon agreement to this license and payment of the prevailing fee a nonexclusive, royalty fee, fully paid up copyright and trade secret license is granted to:

1.  use and copy internally the test materials:

2.  modify and create derivative works from the software: and

3.  distribute and sub-license copies of the software (including derivative works of the Software) in binary form

Distribution of the Test Materials other than as provided here is expressly forbidden. You also must not grant rights to the Software or derivative works that are broader than those provided by the license.

The Test Materials are provided on an “as is” basis. The SMPTE disclaims any and all warranties whether express, implied or statutory, including any implied warranties of merchantability or fitness for a particular purpose. In no event shall the authors of the SMPTE be liable for any incidental, punitive, or consequential damages of any kind whatsoever arising from the use of the Test Materials. This disclaimer of warranty and limitation of liability extends to the user of these Test Materials. This disclaimer of warranty and limitation of liability extends to the users of these Test Materials and user’s customers, employees, agents, transferees, successors, and assigns.

THIS IS NOT A GRANT OF PATENT RIGHTS- SEE THE SMPTE PATENT POLICY. The SMPTE does not represent or warrant that the Test Materials are free of infringement of any third-party patents. Commercial implementations of SMPTE Standards, including shareware, may be subject to royalty fees to patent holders. Information regarding the SMPTE patent policy is available from the SMPTE Website at http://www.smpte.org.
