. Sub: Confirmation Letter of Training

DearKushalVasunath,

On behalf of Shrem Resorts Private Limited., (the Owning Company of Novotel Goa Shrem Resortand hereinafter referred to as the Company), we have pleasure in making you an offer of Training as Industrial Exposure Training (IET) for Novotel Goa Shrem Resort in the F & B Production Department..

Further to the interview you had with us, we are pleased to select and confirm you as anIndustrial Exposure Training (IET) for the period one month, with effect from 1stDecember 2014 to 31st December 2014, on the following terms and conditions.

TRAINING
The training will be for a period of one month from the date of your joining. On completion of your training period, subject to your performance and availability of a suitable vacancy, the Company May offer you permanent training.

STIPEND
You will be paid a stipend of Rs. 1500/- (One Thousand Five Hundred Rupees Only) per month during the period of your training. However you will not be eligible any statutory benefit.

MEALS

You will be provided Duty meals by the company.

UNIFORM & LAUNDRY

You will have to carry your own uniform during the training period. The following is to be carried by the student (2 pair white full sleeve shirt,2 pair of black trouser,2 pair of black socks, black belt, chef coat, apron and a pair of black shoes).Laundry facility will be provided to the students by the company

ACCOMODATION

The company will not be responsible for providing accommodation during the training period.

GROOMING

You will have to abide by the company grooming guidelines at all times during your training period.

NON-DISCLOSURE OF CONFIDENTIALITY

All proprietary business data, business plans, financial projections and results, customer information, computer programs and similar materials, and information made available to you during your training are the sole property of the Hotel.

All such materials and information shall be held by you in the strictest confidence, and shall not be shared or disclosed to any third parties or otherwise utilized except in the routine course of performing your duties. This restriction shall continue to apply even after cessation of your training with the Hotel. All documents, data or other requisites therefore shall be returned to the Hotel upon cessation of your training with the Hotel.

CONFLICT OF INTEREST

Without prior written consent of the Management, you shall not indulge, engage or interest yourself either directly or indirectly, whether for reward or gratuity in any work, investment or business other than in the course of the performance of your duties in the Hotel.

RULES AND REGULATIONS

The law of the Country of India and the State of Goa shall govern the provisions in this offer of training.

During your training, you will be bound by the service rules and policies of the Hotel which may be framed and enforced from time to time. You will also carry out and abide by any instructions, house rules and office orders issued by the management from time to time. The Hotel reserves the right to amend or alter these at its discretion without any notice thereof, and these will be deemed to be the terms and conditions governing the terms of your training.

It is understood that this training is being offered to you on the basis of the particulars submitted by you in your application for training. However, if at any time it should emerge that the particulars furnished by you as a part of the joining formalities, are false, incorrect or inaccurate, if any material or relevant information has been suppressed or concealed, if you are engaged in any fraudulent activity, misconduct, or if your performance is not up to the expected standard this appointment will be considered ineffective and irregular and would be liable to be terminated by the Hotel forthwith without notice. This will be without prejudice to the right of the Hotel to take disciplinary action against you for the same.

You shall not at any time during the term of your training with the Hotel or thereafter, under any circumstances, directly or indirectly solicit the Hotel’s and/ or any of its affiliates’ personnel to leave the training of the Hotel and/ or any of its affiliates or apply for training with any third party or encourage such personnel of the Hotel to take any action or inaction that may adversely impact the performance by the Hotel of its obligations under this Letter and / or any other contract or adversely impact the ability of the Hotel to carry out its normal business activities. You further agree that you shall not engage in soliciting business or allied business that is in any way similar, identical or competitive with the business, activities, services of the Hotel, or with those customers of the Hotel with whom you had any contact, during your training with the Hotel and for a period of one year after your training ceases with the Hotel.

You shall keep the Hotel informed of your latest postal address and other contact details at all times and intimate in writing in case of change of such address or contact details. Any communication sent to you by the Hotel on your last known address shall be deemed to have been duly served notwithstanding the fact that you have changed your address.

During the course of your training with the Hotel you may be required to undergo specialized training(s) / skill and / or knowledge enhancement / developmental program to enable you to effectively discharge your current or new responsibility assigned to you.

In such cases the Hotel may propose that an agreement, in the form and manner acceptable to the Hotel be entered into between the Hotel and you.

Such agreement shall primarily intend to offset the expenses incurred by the Hotel towards your specialized training / skill and / or knowledge enhancement. In the event that such an agreement is executed between you and the Hotel, you shall be governed by the terms and conditions of such agreement as well, which shall be considered as an integral parcel of this Appointment Letter. In the event of any conflict in respect of any provisions between the contents of this Appointment Letter and such agreement, the provisions of such agreement shall take precedence.
