This AGREEMENT is hereby made by and between Patty and/or Ray Norwood, Jr., doing business as PattyRay Paints, hereinafter referred to as "Stallion Owner" and ______, hereinafter referred to as "Mare Owner."
WITNESSETH THAT:
WHEREAS, the Stallion Owner wishes to stand the Stallion: PR Kids Pure Class AQHA #4562817,
and WHEREAS, the Mare Owner wishes to breed the mare Breed and Registration Number: ______, here after referred to as Mare, " to the StallionPR Kids Pure Class and NOW THEREFORE, it is mutually understood and agreed by the Stallion Owner and Mare Owner as follows:
1.Stallion Owner does hereby reserve for Mare Owner a season's booking in2009 to Stallion for
Service to Mare. In consideration of the reservation by Stallion Owner, a booking fee in the amount of $250.00, shall accompany this Agreement with a copy of the mare's registration papers. The booking fee is non-refundable. The amount of the Stallion fee of $1000.00, which includes the booking fee and the first collection for Stallion, PR Kids Pure Class, the Mare Owner agrees to pay in full before the time the first shipment of semen is sent from farm or picked up from the farm. (Subject to discounts available at bottom of contract)
2.Breeding season will begin February 1st and close no earlier than June 13th.
3.Cooled Shipped Semen Only. Approximate first shipping date or farm pick up______Mare Owner is required to give Stallion Owner 24 hours notice before semen will be shipped. Mare Owner is also responsible for all shipping and collection fees for their mare(s). Stallion Collection, semen preparation and shipping will be at PattyRay Paints. First collection and shipping fee is free, each there after will be $200.00 for shipped semen and $75.00 for on the farm pick up. Days for collection are Monday, Wednesday & Friday. Counter to counter/same day shipping when possible will be available with extra cost. Cost for pick up from PattyRay Paints to another location is responsibility of Mare Owner.
4.A Breeders Certificate will be furnished by the Stallion Owner upon birth of a live foal conceived by this service, if and only if all charges incurred on behalf of the Mare Owner in the Agreement have been paid in full. No certificate will be issued until any unpaid charges are paid infull which include but are not limited to charges from Stallion Owner and veterinarian or other.
5.Mares should be cultured before requesting semen, even maiden mares, to avoid breeding mare with an infection.
6.Stallion Owner may at their sole discretion, show and promote Stallion during breeding season.
7.Stallion Owner guarantees a Live Foal with a return breeding the following season, either for said Mare or an approved substitute by Stallion Owner, shall a "live foal," (defined as one that has stood and nursed from a mare, or fed by hand for a period of twenty-four (24) hours, not result from this Service, provided that within one week of the birth or abortion of such foal, the Stallion Owner is provided with written certification by a licensed veterinarian that:
a.The Mare had been given the Rhinopneumonitis vaccination series at 5, 7, and 9 months of this pregnancy, and
b.The foal was not a "live foal" as defined herein, and that the death of the foal was not due to negligence of the Mare Owner, the Mare Owner's agents or the employees thereof.
c.Mares checked "not in foal" shall be serviced during the same season unless it is agreed in writing by the Stallion Owner to Service the Mare the following season.
d.Mare Owner will still remain responsible for collection, shipping fees and any other related charges.
e.None of the aforementioned is refundable.
f.All guaranteed privileges are automatically lost or forfeited if Mare is taken to any other stallion before coming back to Stallion for return service. Or same is true if mare is no longer owned by the Mare Owner of the contract.
8.Special Provision - Should Stallion become unable to Service Mare due sale of said Stallion, injury, health or should death of the Stallion occur, the stud fee shall be refunded.
9.In the event that it be necessary for Stallion Owner to employ an attorney to enforce the terms and conditions of the Agreement, or as a result of Mare Owner's Breach, Mare Owner agrees to pay all reasonable attorney fees, arbitration and/or court cost expended by Stallion Owner through and including the execution of any judgement.
10. Any legal action regarding this Agreement or the Service of Mare shall be commenced in Darlington County, South Carolina.
11. This Agreement including all attachments, exhibits and documents identified and incorporated herein by reference, constitutes the complete and exclusive statement of the terms and conditions of the Agreement between the Stallion Owner and Mare Owner and it supercedes all prior representations, understandings and communications.
12.Any attempted assignment of the agreement without the express written consent of Stallion Owner and Mare Owner shall be void.
13.In the event any section, paragraph, sentence clause or phrase contained in the Agreement documents shall be determined, declared or adjudged invalid, illegal, unconstitutional or otherwise unenforceable, such determination, declaration or adjudication in no manner affects the other sections and paragraphs.
