National Biodiversity Authority (NBA), a statutory and regulatory body of the Ministry of Environment and Forests, Government of India, established as per Section 8 of the Biological Diversity Act, 2002 having its Head Office at Chennai. The Authority performs regulatory, enabling and advisory functions on issues related to biodiversity, sustainable use and access and benefit sharing by delivering its mandate along with the State Biodiversity Boards (SBBs) and Biodiversity Management Committees (BMCs).

In order to assist NBA, applications are invited from the individuals in India for the following positions purely on temporary basis.

I.  Senior Consultant - Legal

A.  The Terms of Reference are as follows:

1.  Follow up of issues related to review and monitoring of completed ABS applications

2.  Preparation of a review on IPR related issues within the context of the Biological Diversity Act and Rules suggesting linkages with the Controller General of Patents, Designs and Trade Marks (CGPTM);

3.  Preparation of IPR related issues within the WIPO context given the discussions under the WIPO-IGC

4.  Preparation of periodical notes and orientation material for SBBs and BMCs on BD Act from a legal perspective.

5.  Assist counsels engaged by NBA in Court / Tribunal matters.

6.  Any other work assigned by Advisor(Law) / Secretary, NBA / Chairman, NBA in relation to ABS agreements and IPR related issues

The positions are full time based at Chennai; May involve travel liabilities throughout India for orientation of SBBs and BMCs, if required by the competent authority.

B.  Qualification and Experience

(i)  Essential Qualification

1.  A full time Master of Law from a recognized university or institution with specialization in environment and/or biodiversity law / IPR issues.

2.  Experience of 10 years and above in techno-legal teams with a relevant focus on trade related/biodiversity issues and IPR.

3.  A proven ability to understand and comprehend issues of IPR, patent law and Biological Diversity Act, through publications, reviews, papers etc.,

4.  Ability to work as a member of legal team.

(ii) Desirable Qualifications

1.  One year Post graduate degree/diploma in IPR / Environmental Law or Policy / Sustainability Science.

2.  At least 2 years of working experience in providing legal guidance, analyses and support on environmental law and/or biodiversity law;

3.  A proven skills in writing reports and briefs on Biodiversity / IPR related issues

C.  Age Limit

The maximum age limit for applying is 50 years as on the last date prescribed for the receipt of the applications.

D.  Remuneration, Leave etc.

1.  A consolidated pay of Rs. 70,000/- will be fixed per month. In addition to pay, a local conveyance of Rs.8,000/- p.m. will be paid excluding for the period of leave. The pay and local conveyance are subject to TDS at the rates applicable.

2.  Remuneration being consolidated amount is payable at the end of the month irrespective of the fact whether the month consists of 28/29/30/31 days and TDS at the rates applicable will be deducted from the payment. The amount will be paid upon the Consultant submitting a “Report of work done during the month” to the Chairman, NBA through the Secretary, NBA / Advisor (Law) and upon due approval of the same.

3.  The Consultant shall be eligible for one day leave in a calendar month irrespective of the number of days in a month. Un-availed leave in a calendar month can be carried forward to the next month if he / she is engaged continuously. However, the unavailed leave in a calendar year cannot be carried forward to next calendar year and no encashment of accumulated leave is admissible. NBA would be free to terminate the service in case of a consultant remains absent for more than 15 days beyond the entitled leave in a calendar year.

II. Consultant - Legal

3.  A proven skills in writing reports and briefs on Biodiversity / IPR related issues

The maximum age limit for applying is 45 years as on the last date prescribed for the receipt of the applications.

D.  Remuneration, Leave etc.

1.  A consolidated pay of Rs. 50,000/- will be fixed per month. In addition to pay, a local conveyance of Rs.4,500/- p.m. will be paid excluding for the period of leave. The pay and local conveyance are subject to TDS at the rates applicable.

2.  Remuneration being consolidated amount is payable at the end of the month irrespective of the fact whether the month consists of 28/29/30/31 days and TDS at the rates applicable will be deducted from the payment. GENERAL INSTRUCTIONS:

APPLICABLE TO ABOVE MENTIONED TWO CATEGORIES OF POSTS.

I.  Terms & Conditions

a.  The position shall be full time and place of work shall be office of the NBA, Chennai.

b.  The NBA may hold an interview and the candidates will have to attend the interview at their own expenses.

c.  The offer will be purely temporary and initially for a period of one year. However, depending upon the work schedule, the period of engagement may be extended / curtailed with the approval of the Chairman, NBA - the Competent Authority. The selected candidate cannot claim any permanent postings in NBA. NBA reserves the right to terminate the services of him/her at any time, if required, without assigning any reason.

d.  In each of the offer of work order issued, specific conditions may be laid down for compliance by the selected candidate. NBA will not provide any typing / computer operator assistance for carrying out assignment and the work has to be carried out on his/her own.

e.  NBA reserves the right to engage more than one person for the above job profile. In case of multiple engagements, separate work orders indicating specific work to be carried out by each person will be issued.

f.  The final outcome of any paper / guidelines / report / notes / briefs etc. prepared by the candidate will become the property of NBA. No authorship / copy right can be claimed on any written report / material prepared by him/her.

g.  The selected candidate should not take up any other assignment during the period of his / her engagement in NBA. She/he may be required to work on Saturdays / holidays also, if need be, for which no additional remuneration will be paid.

h.  She / He may have to undertake tours as and when directed by the Chairman / Secretary, NBA and travel entitlements shall be specified in the offer letter. However, no allowance shall be admissible for joining the assignment or on its completion.

i.  For all other terms and conditions not mentioned in the advertisement, the provisions in the “Procedures and Guidelines for engagement of Consultants in the National Biodiversity Authority” as approved by the Authority will apply.

j.  NBA reserves the right to reject all or any application received for the position without assigning any reason.

k.  The NBA reserves the right to select more than one candidate against each position if they are found suitable.

l.  In case of any dispute about the interpretation of any point / clause / condition / rule, etc. the decision of the Chairman, NBA shall be final
