THE UNDERSIGNED HEREBY CERTIFIES THAT WHEN THIS ADVANCE IS MADE:
OPTION 1 (Non Title Insured Hypothecs)
1. The Borrower will have executed a Hypothec in favour of CIBC MORTGAGES INC. subject to the terms contained in the Deed of Loan in accordance with your Instructions to Notary, Loan Commitment Letter and any subsequent Amendments, if applicable.
2. All tax bills issued up to the Loan Advance will have been paid in full.
3. The funds representing the capital secured by the Hypothec are to be disbursed within three business days of my receipt of the funds.
4. When the funds are disbursed, the Borrower will have a good and marketable title, free and clear of all judgments, executions, charges and other liens except for the above Loan and you will have a valid first rank charge against the property.
5. Details of fire, hazard and other insurance as specified in your Instructions to Notary will have been verified.
6. Your requirements with respect to Co-borrower non-owner and the taking of collateral security as defined in your Loan Commitment Letter and your Instructions to Notary will have been met.
7. Unless otherwise recorded below, all registered restrictions or building/zoning by-laws and regulations and provincial statutes will have been complied with and there are no easements, encroachments, encumbrances or other qualifications (including taxes) EXCEPT as noted below. You were informed of these matters prior to this report and these were accepted by you. They are neither detrimental to your security nor to the marketability of title.
8. All requirements in the Instructions to Solicitor relating to ascertaining the identity of all mortgagors and guarantors will have been met. If required by the Mortgage Approval or Mortgage Commitment, the fully completed IVF will be faxed to you before funds are advanced.
