4. Purchase orders or contracts resulting from this quotation may not be assigned without written prior approval from the Director of Purchasing.

5. The seller agrees to protect the purchaser from all damage arising out of alleged infringements of patents.

6. Unless otherwise specified, the Director of Purchasing reserves the right to accept or reject all or any part of this quotation.

7. All offered discounts will be considered in determining the low bid, and taken when payment is made.

8. Bids and performance guarantee, when required, will be outlined in the specifications below.

9. All prices quoted are to be less federal excise and state sales taxes.

10. E-mail bids are not acceptable in lieu of original response unless prior approval has been granted or outlined in the specifications below.

GENERAL TERMS AND CONDITIONS

1.  It is the intent of KUMC to permit competitive bidding. It is the bidder’s responsibility to advise KUMC Purchasing, in writing no later than seven (7) days prior to the closing date, if any specification or requirement limits bidding to a single source.

2.  Unless otherwise specified, KUMC reserves the right to accept or reject all or any part of a quotation, and to waive technicalities.

3.  Except as otherwise indicated, the merchandise quoted shall be in new condition.

4.  KUMC reserves the right to award purchases by item, by group, or by lot, whichever is deemed to be in its best interest.

5.  In the event of a tie, the award shall be made to a Kansas bidder.

6.  Unit price shall prevail in the event of extension errors.

7.  When brand names or trade names and model numbers are used in the bid request, it is for quality, style and features. Bids on equivalent items of substantially the same quality, style and features are invited, unless otherwise indicated. However, to receive consideration, such equivalent bids must be accompanied by sufficient literature and/or specifications to clearly identify the items and allow for functional evaluation. If a bid indicates that an item quoted is functionally equivalent and is purchased and found to not be comparable, KUMC reserves the right to return the item at the bidder’s expense, and the bidder will be charged back for any difference in cost for the specified item.

8.  If any portion of this bid is provided by a vendor other than the bidder, the bidder remains the prime contractor responsible for fulfilling all requirements of this bid.

9.  Samples of items, when required, shall be furnished at no expense to KUMC, and, if not destroyed in the evaluation process, will be returned at the bidder’s expense if requested.

10.  Partial payments can only be made with the prior approval of the Project Coordinator.

11.  Any conviction for a criminal or civil offense that indicates a lack of business integrity or honesty must be disclosed. This includes 1) conviction of a criminal offense incidental to obtaining or trying to obtain a public or private contract or subcontract or in the performance of such contract or subcontract; 2) conviction under state or federal statutes of embezzlement, theft, forgery, bribery, falsification or destruction of documents, receiving stolen property; 3) conviction under state or federal antitrust statutes; and 4) any other offense to be serious and compelling as to affect responsibility as a state contractor. Failure to disclose an offense may result in disqualification of the bid or termination of the contract.

1.1  Specifications

1.2  Request for Proposal:

The University of Kansas Medical Center (KUMC) seeks to retain the services of a qualified
Concrete Restoration Contractor knowledgeable in the restoration of parking garages. The Company will serve as the Prime General Contractor for the renovation of one of the five parking garages on the KUMC Campus. The Prime Concrete Restoration Contractor shall be licensed to practice in the state of Kansas. Please include in your proposal, a breakdown of your RFQ submittal information.

1.4  Project Description/Basic Services:

Cambridge Garage is located on the University of Kansas Medical Center (KUMC) Campus at 4008 Stateline Rd. /Kansas City, KS 66160. The five-level, field-topped precast concrete structure was built in 1979. Over the years, the topping has gone through extensive scaling and spalling at several areas of the garage leading to chloride ion content contamination, corrosion of topping and double-tee flange reinforcement, flange spalling, and other distress conditions.

The bidder shall be the Prime General Contractor and their Contract shall be with the University of Kansas Medical Center (KUMC). The Prime General Contractor shall be a Concrete Restoration Contractor and shall meet the qualifications as outlined in Specification Section 001153 Contract Qualifications. If the Prime General Contractor subcontracts scopes of work outlined in the Contract Documents the subcontracts shall be under their contract umbrella, unless noted otherwise. The Construction Team shall assess and document all existing conditions and protect and maintain all components slated to remain. The Prime Contractor shall coordinate all required inspection visits with the authority having jurisdiction (State of Kansas) and with the Special Inspector (who will be contracted directly with KUMC).

The project consists of the removal and replacement of the concrete topping at all levels (except at stair towers where patching of only some portions will be required). The new topping slabs shall meet industry standards for slabs exposed to weather and deicer chemicals. Upon topping removal, structural repairs to the exposed precast concrete double-tee and inverted-tee girders shall be performed as noted in the Contract Documents. It is expected that the contractor shall maintain the integrity of the double tees and inverted-tee girders and other existing conditions to remain throughout the entire construction period.

Replacement of electrical lighting and associated components in the parking areas, in stairways, on the building exterior, and door/frame/hardware replacement is included in the scope. Removal of the existing blue phones and security cameras will be by the Owner, but it will be the Prime construction team’s responsibility to remove associated electrical components and provide new electrical connecting components when the Blue Phones and security cameras are to be reinstalled by the Owner. Installation of new sealant joints at the new topping is also included, as is the application of a traffic membrane at the top levels of the garage and in some other minor locations. Replacement of four vertical concrete panels is required at the top deck. It is expected that the contractor shall maintain the integrity of the remaining double tees and inverted tee girders and other existing conditions to remain throughout the entire construction period.

The proposed topping replacement program would be phased over a multiple year period. This Project is intended to be a multi- phased replacement construction project to keep portions of the garage open and functional while only taking portions (+/-120 spaces) out of operation during the planned restoration work. Phase I shall be the replacement of the top deck areas as noted in the Construction Documents. However, we are open to other available scheduling options. Please provide pricing/scheduling for all options recommended, specifically we are looking to see what the alternative price/schedule would be for shutting the garage down completely for these repairs. KUMC and the Engineer will work with the Contractor to achieve the desired phasing plan to be outlined the Contract Documents. Once the desired Phasing Plan has been approved by KUMC and the Engineer, the Prime General Contractor will need to provide an Emergency Egress Plan for submission to the Authority having Jurisdiction (Topeka) for approval. The proposed budget for the repair program is approximately $7.47 million.
