WHAT IS MEDIATION?

Although a certain amount of conflict occurs in our lives, very few of us are comfortable with it. We’ve been taught that “conflict is bad” and so our inclination is to avoid it, do nothing, and hope that it goes away. If the conflict intensifies, we pay attorneys and the courts to proclaim us either a “winner or a “loser”.

Just Solutions believes there is another alternative. Mediation. Mediation occurs when a neutral third-party assists two or more people in working through their conflicts. Costs are minimal; risks are low. The goal of mediation is to find solutions, not to place blame.

HOW DOES MEDIATION WORK?

Trained mediators listen carefully to both sides. They:

  • Create a safe environment that permits the participants to interact.
  • Clarify points of agreement and disagreement
  • Help identify new options.
  • Define the facts of the conflict and the emotions associated with those facts.
  • Structure the communications between the parties.
  • Draw up a tentative agreement between the parties.
  • Do not tell the parties what to do.

WHY DOES MEDIATION WORK?

  • Neither party is blamed.
  • Participants create and are responsible for their own agreements.
  • Each party negotiates the changes necessary to resolve the conflicts.
  • Each party decides what to say, what to discuss, and what decisions they want to make.
  • Feelings, facts, and behaviors are considered and communicated with the help of a trained, neutral mediator.
  • All information about the case remains confidential.

FEES:

Each attending party is charged an initial fee of $150. This includes 3 hours of mediation, plus the writing of the agreement. If additional time is needed, both parties are charged $50for each extra hour.

ADVANTAGES OF MEDIATION:

Fair and neutral - Parties have an equal say in the process and decide the settlement terms.

Saves Time and Money-Mediation can be scheduled quickly and most are finished within three hours. Legal representation is optional but not required.

Confidential-All information is confidential and only an agreement, if one is reached, leaves the mediation.

Avoids Litigation-Settlement means no trial. Mediation fosters cooperation between participants.

Improves Communication-A safe, open setting is provided so the participants can discuss their views on the issues underlying the conflicts.

Design Your Own Solutions-A neutral third party assists in reaching a voluntary, mutually beneficial resolution. Mediation can resolve all issues important to the parties, not just the presenting problem.
