Minutes

The Minutes of the meeting of 15th February, 2001 were presented for adoption. Deputy Power asked that an amendment be made to Item No. NS2/0201 Planing File 99/763. The amendment should indicate that the planning application on appeal to An Bord Pleanala does not relate to a bungalow being built beside a septic tank but rather to three bungalows which had been taken out of the original application for planning permission on this site and are now the subject of a separate planning application. Following this amendment the minutes were adopted on the proposal of Councillor T. Conway seconded by Councillor B. Hillis and agreed by the members.

Planning Files

00/1927 – Dermot Fallon

Annette Aspell, S.S.O. confirmed that planning permission had been granted by Kildare County Council on 21st December 2000, a third party appeal was lodged with an Bord Pleanala and a decision is due on 16th May 2001.

00/2197 – Stephen White

It was confirmed that planning permission had been granted on 6th April 2001. A copy of the permission was circulated to the members.

00/2089 – Swanward Enterprises

Further information was requested on 22nd February 2001. A copy of this was circulated to the members. No reply has been received to date.

00/2092 – Readymix Dublin Ltd.

Further information was requested on 26th January 2001. A copy was circulated to the members. No reply has been received to date.

01/37 – Stephen Tuohy

A decision is due on this application on 22nd May 2001.

00/2203 – Jimmy, George and Ray Stanley

It was confirmed that further information was requested on 20th February and a copy of this was circulated to the members. No reply has been received to date.

00/1087 – Pipers Hill

Planning permission was granted by Kildare County Council on 6th February 2001. Four third party appeals have been lodged with an Bord Pleanala. A decision is due on these on 14th June 2001.

01/597 – Donal and Marie Mc Allister

This application was received on 10th April 2001. A decision is due on 9th June. Councillor Conway referred to this application and confirmed that Kildare County Council had previously granted planning permission for a house on this site. The original application was appealed to An Bord Pleanala and refused by them. Mc Allister’s have revised their plans and made a new application. They need a site with a secure garden away from other houses as their circumstances are exceptional. The area committee unanimously recommended a grant of permission in this case and that all documentation in relation to the exceptional circumstances would be available on the file in the event of another appeal to an Bord Pleanala.

00/1209 – F. Flannelly, Kill Equestrian Centre

Planning permission was granted on 2nd March 2001 and a copy was circulated. A first party appeal was lodged with an Bord Pleanala in relation to condition No. 28 and a decision is due on 1st August. A discussion took place in relation to condition 28 of the planning application. Kevin Kelly, A.O., advised that the applicants should make a submission in writing outlining their difficulties with the condition and that the matter would then be dealt with.

99/763 – Housing Development at Caragh – Kevin Cooke.

A discussion took place in relation to this application and Deputy Power asked if the Planning Section would clarify in writing what the position is in relation to compliance with conditions on all parts of the site. Kevin Kelly, A.O., undertook to refer the enforcement notice which had been issued in relation to this application to the Council’s solicitors tomorrow.

PUBLIC LIGHTING 2001

Liam Dunne, S.S.O., confirmed that lights to the value of £7,000 had already been ordered, the balance available for use by the area committee is £13,000. It was agreed to provide lights at the following locations:

(1)additional lighting at Punchestown Upper (Brendan Boylan) (white lights)

(2)continuation of lights to the end of the houses on the Brannockstown to Ballymore Road at the Brannockstown end.

(3)Continuation of lights at Liffey Heights, Ballymore Eustace to Smoothing Iron Crossroads at the junction of Hollywood and Broadleas Road.

(4)Two additional lights at the laneway between house no 16 and 17 in Glen Dara Estate, Kill and also at house no. 49.

NOMINATIONS TO THE FINANCE COMMITTEE

Councillor Lawlor was nominated to the Finance Committee on the proposal of Councillor Glennon seconded by Councillor Hillis and agreed unanimously by the committee.

EXTINGUISHMENT OF RIGHT OF WAY AT BLUEBELL NAAS

Liam Dunne, S.S.O., confirmed that the proposed extinguishment of right of way at Bluebell Naas had been advertised and four objections to the closure were received. There was no request for an oral hearing. Following discussions in relation to the situation the committee unanimously agreed on the proposal of Councillor Conway seconded by Councillor Glennon that the council should not proceed with the extinguishment of the right of way at this location. This is to be recommended to the full Council for it’s monthly meeting.

PROPOSED TELECOMMUNICATIONS

INSTALLATION AT CARAGH – WATER METEOR MOBILE COMMUNICATIONS LTD.

Liam Dunne, S.S.O., confirmed that Meteor Mobile Communications Ltd. wished to put a telecommunications installation on the Water Tower at Caragh in Naas. A planning application needs to be made for the proposed installation on the property. The company need the consent of Kildare County Council to the making of an application and request that the Council would consider leasing the Tower to them for an initial five year period at an annual licence fee of £5,000. Following discussions in relation to this proposal the members recommended that the agreement be entered into and that the £5,000 annual licence be allocated within the Caragh area at the discretion of the Naas Area Committee.

DEPUTATION ARCHITECTURAL PLANNING AND DESIGN

SERVICES RE CAVAN DEVELOPMENTS LTD. SUBMISSION ON THE KILL DEVELOPMENT PLAN.

Mr. Frank Benson on behalf of Cavan Developments made a presentation to the members in relation to this land which Cavan Developments have owned for ten years. There is seventeen acres on which they have been trying to get planning permission for houses. The land is situated in the Kill area. They circulated a copy of their proposal in relation to the development of the area and confirmed that they were seeking re-instatement of the zoned status previously enjoyed on this portion of land. In relation to the issue of community gain they confirmed that they would be prepared to make a contribution of £10,000 to the community and that there would be an allocation of 5% of the development for affordable housing. There would be three acres given to the community for open space and they would hope that this three acres would be taken into account as part of the gross area of the site. They are also looking for higher densities in relation to their proposal.

ROAD IMPROVEMENT GRANTS 2002 – 2005

Des O’Connor confirmed that the 2000 – 2004 plan went to the Department of the Environment and Local Government in 1999 and is being worked to at present. The Department have sought an updated programme for 2002 – 2005. He advised the members that submissions should be sent in as soon as possible for areas to be considered under the scheme and that the members proposals would be given consideration.

COUNCILLORS DISCRETIONARY GRANTS

Des O’Connor, S.E.E. confirmed that the discretionary grants for this year were £14,400 per Councillor. It was agreed that the members would submit projects directly to the area engineer.

COUNCILLOR’S QUESTIONS

Councillor Lawlor

(a)Sallins – School Barrier and Traffic lights.

It was confirmed that the traffic lights have been erected but have yet to be commissioned by the contractor. The barrier is being erected at present.

(b)Traffic lights at Kill.

It was confirmed that the contractor is proceeding with work on the controller with a view to separating Straffan and Kill traffic movements.

(c)What the Department of Environment and Local Government grant for the Naas ring road link between Kilcullen Road and Newbridge Road is for?

John Mc Gowan, S.E.E., confirmed that £2.1m has been allocated from the Department of the Environment and Local Government for this ring road. This represents 75% funding of the project. The members asked how the contribution from the industrial development at Killashee would fit into this project and it was agreed to ask the County Engineer for a report on this matter.

(d)When will the Development levies for the towns in the Naas area be provided?

This was dealt with under the item on development levies.

(e) Of the levies collected from Mc Court Developments in Kill and college Creast Developments in Kill, can the Council identify where they have been spent?

Des O’Connor, S.E.E. confirmed that he would follow up this matter.
(f)Will the sanitary department clean the sewerage spill onto the land of Mr. Treacy between Halverstown Cross and Newhall Cross?

P. Hickey, A.O., read a report to the meeting in relation to this matter. The sewerage spill between Halverstown and Newhall Crossroads occurred on January 22nd while a contracting company were laying a new gas pipe line for an Bord Gais. They burst the foul rising main coming from Newhall Pumphouse to Osberstown Waste Water Treatment Plant causing a sewage spillage. While Kildare County Council officials were being contacted and before they had an opportunity to turn off the pumps C.L.G. Ltd., the company concerned had pumped the spill onto Mr. Treacy’s land. They carried out this pumping operation of their own judgement and without consultation with Kildare County Council officials. When Mr. Treacy appeared on the scene of the spill later that afternoon it was explained to him what happened. He was introduced to the C.L.G. personnel and was told that they would be responsible for all damages caused by them. As C.L.G. has been in the area for a considerable time afterwards and Mr. Treacy had not contacted Kildare County Council in relation to this matter it was assumed that any problems had been sorted out between the two parties. With the passage of time any evidence of the spill had since dissipated.

When will the rear entrance to St. Bridget’s Terrace, Kilcullen be fixed?
It was confirmed that repairs would be carried out within the coming weeks.

Deputy Power
(a) Would the County Council outline what action has been taken in relation to an unauthorised development in Caragh as discussed at our last meeting of 15th February.

This matter has already been covered under the planning files.

(b) If development levies could be used to
(i) widen the entrance to Kilcullen Community Centre
(ii)provide a stone mesh for the side of the river in order to prevent the riverbank from collapsing
(iii) repair the walkway around the pitches, which were built in 1988.

A report was read to the members indicating that this letter would be considered in the context of the ongoing review of development contributions. As development contributions would not have been collected for the specific works listed it will be necessary to determine whether any monies remain available when all works have been completed for which contributions would have been specifically levied/collected. Deputy Power requested that a stone mesh would be provided for the side of the river in order to prevent the river bank from collapsing. The area engineer confirmed that development is ongoing beside this area and it was suggested that the developer would be approached to carry out some work on the river bank area. The area engineer is to follow this matter up.

Deputy Power outlined the current situation and asked for an immediate report on the matter.

“That this Council liase with the Gardai to sort out the acute danger associated with the traffic using the “Flying Saucer” filling station on the Dublin/Naas dual-carriageway.”
It was confirmed that vehicles are parking on the hard shoulder and causing a danger to traffic on the main road. This would be followed up with the National Road Design Office

“That this Council approve the installation of traffic measures on Loughlin Lane which has become a rat run.”
It was confirmed that traffic calming may not be required when work on the traffic lights is complete.

It was agreed that Councillor Conway would use part of his discretionary grant allocation to fund this work.

P. Hickey, A.O., read a report from L. Dunne indicating that Capital Works Section are currently building houses at the rear of the estate and it is planned to re-surface the road and provide drainage when works are completed.

“That the Naas Area Committee call on the N.R.A. to construct an underpass instead of an overpass for pedestrians.”
It was confirmed that a report is awaited from the National Roads Authority in relation to this matter.

“That Yellow Boxes be painted on the road at the traffic lights in Sallins to allow cars into and out of existing housing estates at these traffic lights.”
It was confirmed that this would be considered when the lights are operative. The Area Engineer indicated that it would probably not be necessary to install yellow boxes on the road at this location, however, the matter can be reviewed.

Notice of Motion – Deputy Power
“To outline the current situation in relation to the proposed Industrial Estate in Kilcullen and if a route for the sewerage system has been agreed.”
P. Hickey, A.O., read a report confirming that forty one applications had been received and examined. Thirteen applicants have been prioritised for individual sites. A number of companies have listed their requirements for building units from 2,500 to 5,000 sq.ft. It would not make economic use of the industrial land that is available to provide individual sites to companies who are seeking to construct buildings of 2,500 sq.ft. to 5,000 sq.ft. and the development of a business park area for small sized enterprises is being considered. Consideration is also been given to the appointment of a management company to oversee the actual development of sites, boundary treatments and security ongoing site management etc. In relation to the route for the sewerage system Michael O’Leary, S.E.E. undertook to follow up this matter and respond directly to the members.
