ORDER

(Date of Hearing 03.05.2017)

1.  The petitioner, UPPCL , has filed the petition to seek approval of SPPA with M/s Usher Eco Power Ltd. dated 26.12.2016 for procuring 12 MW biomass (rice husk) based power from 18 MW plant situated at vill: Dautana, Distt. Mathura expected to be commissioned by May 2017.

2.  Earlier, the petitioner also has PPA with M/s Usher Eco Power Ltd. dated 08.08.2012 for 12 MW (rice husk) based power from 16 MW plant situated at same afore-mentioned site.

3.  It is agreed between the parties that discount of 80 paise per unit over applicable UPERC tariff (as amended from time to time) for respective year shall continue for subsequent years during the term of PPA i.e. 20 years. Further, in case of delay in commissioning of the project, tariff corresponding to FY 2017-18 shall be admissible.

4.  The Commission vide its order dated 14.12.2016 in petition no. 1137 of 2016 have permitted UPPCL to enter into instant PPA with discount of Rs. 0.80 per unit on the applicable tariff under UPERC CRE Regulations, 2014 and amended Regulation in future. Further, the Commission also directed that additional Rs. 0.18 per unit shall be deducted from the allowed tariff as per this order, for using the existing transmission infrastructure.

5.  Subsequently, on 26.12.2016 the PPA has been executed on the line of model PPA with deviations as given below and submitted for the approval of the Commission:

i. discount of Rs. 0.80 per unit on the applicable tariff determined by UPERC (as amended from time to time) for respective year shall continue for subsequent years during the term of PPA.

ii. in case of delay in commissioning, tariff applicable corresponding to scheduled commissioning year only shall be applicable.

iii. modification of existing evacuation system, if any, shall be responsibility of the generator. The work for construction/ maintenance of transmission system/ bay shall be entrusted to DISCOM/ UPPTCL on paid basis by the generator.

6.  The Commission approves the SPPA with deviations as above and with the directions as contained in its order dated 14.12.2016 in petition no. 1137 of 2016.

7.  The petition is disposed of.
