General Summary

Question 1. - Do you have a management system, QA/QC, or continual improvement process for erosion control and maintenance? (Describe, provide forms)

Of the states that responded, 13 states (37%) answered yes that some type of management system, QA/QC or a continual improvement process related to erosion control and maintenance.

Question 2. - Are there any other construction areas where your organization uses or has considered using an environmental management system?

Of the states that responded, 10 states (29%) answered yes that they use or has considered using an environmental management system other construction areas.

Question 3. - Please describe incentives that DOT employees have for environmental stewardship/performance (e.g. factors in performance evaluation), in the face of other competing priorities.

Of the states that responded, 7 states (20%) answered yes that they have incentives for DOT employees have for environmental stewardship/performance. 6 out of the 7 states incorporate environmental stewardship into staff performance plans. Only 1 state (Vermont) provided a monetary merit awards for employees.

Question 4. - How do you pay for erosion control and maintenance for erosion control?

Of the states that responded, 29 states (83%) pay for erosion control and maintenance by Unit Bid. 3 states pay for temporary erosion control items on a Lump Sum basis. 2 states pay for temporary erosion control by either Unit Bid or Lump Sum depending on the size and complexity of the project.

Question 5. - Do you use incentives/disincentives to promote compliance?

Of the states that responded, 11 states (31%) use incentives/disincentives to promote environmental compliance.

Question 5b. - Do you withhold payment for erosion control items or withhold entire estimates for noncompliance ? (Send specification with applicable language.) Please discuss.

Of the states that responded, 26 states (74%) can withhold payments for erosion control items or withhold entire estimates for noncompliance.

Question 6. - Do you have issues with contractor unbalanced bids for such work? Please discuss.

Of the states that responded, 10 states (29%) have issues with contractor submitting unbalanced bids for environmental work items.

General Summary

Question 7. - Do you have problems with enforcement related to payment? (For example, does the payment method create noncompliance choices by the contractor because the cost of the compliance exceeds the penalty for noncompliance?)

Of the states that responded, only 4 states (11%) responded that they have problems with enforcement related to payment.

Question 9. - Provide a short discussion of responsibilities for environmental compliance with NPDES/SWPPP. (e.g. The state DOT designs and directs contractor installation and maintenance of the BMPs. The department submits NOIs and NOTs and performs all inspection.)

Of the states that responded, 20 states (57%) submit the NOI and NOT related to NPDES/SWPPP. The majority of the states that do not submit these documents require the contractor to submit them to the regulatory agency.
