We have learned from the Company (business name and the address of the Payer in accordance with the Certificate of Incorporation), Company ID No.: ...... that it is participating in the Tender that was announced on the 18th October 2017, the purpose of which is entering into a Contract on band electricity delivery to cover the losses in the transmission system anticipated during the years 2018 and 2019 (hereinafter referred to as the “Contract”), and that it is designated, pursuant to the Terms and Conditions of the Tender, to provide you with a guarantee to ensure its surety.

on the basis of your first written and duly signed request containing your declaration that the Company (thebusiness name and the address of the Payer in accordance with the Certificate of Incorporation)
a)has not duly entered into a Contract in accordance with the Terms of the Tender that were announced on the 18th October 2017, or
b)it made false claims in its Affidavit pursuant to the Terms of the Tender announced on the 18th October 2017 and therefore it does not meet the requisite characteristics of the participant in this Tender, or
c)that it submitted false, incomplete and/or misleading documents for the purpose of its registration for the Tender.
For identification purposes your request must be submitted through the bank, which will then confirm the validity of your signature on this document.
Our guarantee will be valid from ...... till ...... and your request containing your declaration must be delivered to our address: (Name and address of the bank) no later than by the starting date.
We also ask you to return the original of our guarantee immediately after its expiration. Our obligations under this guarantee shall also expire upon its expiration, even if the original is not returned to us.
Should the return of the letter of guarantee take place before the expiration date of this guarantee our guarantee will also expire at the exact timethat the original of our letter of guarantee is delivered (returned) to us.
This guarantee will be both implemented and construed in accordance with Czech law and it will be subject to the jurisdiction of the Czech courts.
The rights based onthis guarantee may not be assigned.
