(c)ArbitratorQualificationsandAppointment.InadditiontofulfillingthequalificationsofamediatorfoundinLocalRule9019-2(b),apersonqualifyingasanarbitratorhereundermustbecertifiedasanarbitratorthroughaqualifyingprogramthatincludesabankruptcycomponent.Anarbitratorshallbeappointed(andmaybedisqualified)inthesamemannerasinLocalRule9019-2(e). ThearbitratorshallbeliableonlytotheextentprovidedinLocalRule9019-2(e)(iv).

(d)PowersofArbitrator.

(i)Anarbitratortowhomanactionisreferredshallhavethepower,uponconsentoftheparties,to

(A)Conductarbitrationhearings;

(B)Administeroathsandaffirmations;and

(C)Makeawards.

(ii)TheFed.R.Civ.P.andtheFed.R.Bankr.P.applytosubpoenasfortheattendanceofwitnessesandtheproductionofdocumentsatavoluntaryarbitrationhearing.

(e)ArbitrationAwardandJudgment.

(i)FilingandEffectofArbitrationAward.Anarbitrationawardmadebyanarbitrator,alongwithproofofserviceofsuchawardontheotherpartybytheprevailingparty,shallbefiledwiththeClerkpromptlyafterthearbitrationhearingisconcluded.TheClerkshallplaceundersealthecontentsofanyarbitrationawardmadehereunderandthecontentsshallnotbeknowntoanyJudgewhomightbeassignedtothematteruntiltheCourthasentereda

finaljudgmentintheactionortheactionhasotherwiseterminated.

(ii)EnteringJudgmentofArbitrationAward.ArbitrationawardsshallbeenteredasthejudgmentoftheCourtafterthetimehasexpiredforrequestingadeterminationdenovo,withnosuchrequesthavingbeenfiled. Thejudgmentsoenteredshallbesubjecttothesameprovisionsoflawandshallhave

thesameforceandeffectasajudgmentoftheCourt,exceptthatthejudgmentshallnotbesubjecttoreviewinanyothercourtbyappealorotherwise.

(f)DeterminationDeNovoofArbitrationAwards.

(i)TimeforFilingDemand.Withinthirty(30)daysafterthefilingofanarbitrationawardunderLocalRule9019-4(e)withtheClerk,anypartymayfileawrittendemandforadeterminationdenovowiththeCourt.

(ii)ActionRestoredtoCourtDocket.Uponademandfordeterminationdenovo,theactionshallberestoredtothedocketoftheCourtandtreatedforallpurposesasifithadnotbeenreferredtoarbitration.

(iii)ExclusionofEvidenceofArbitration.TheCourtshallnotadmitatthedeterminationdenovoanyevidencethattherehasbeenanarbitrationproceeding,thenatureoramountofanyawardoranyothermatterconcerningtheconductofthearbitrationproceeding,unless

(A)TheevidencewouldotherwisebeadmissibleintheCourtundertheFederalRulesofEvidence;or

(B)Thepartieshaveotherwisestipulated.

(g)ThisLocalRuleshallnotapplytoarbitrationunder

9U.S.C.§3,ifapplicable.
