Resolution No. 5, Series 2016
A RESOLUTION AMENDING THE INTRODUCTORY PARAGRAPH OF THE CITY OF IDAHO SPRINGS PARKING PLAN
WHEREAS, pursuant to Article 15, Title 31, C.R.S., the City Council possesses the authority to adopt rules and regulations concerning the parking of vehicles within the City of Idaho Springs; and
WHEREAS, the City Council has exercised that authority by previously adopting the City of Idaho Springs Parking Plan ("Parking Plan") by Ordinance No. 7, Series 2003 and
WHEREAS, said Ordinance authorizes the City Council to amend the Parking Plan by resolution, which the Council has previously done several times; and
WHEREAS, over the years the Parking Plan has been effective, the Idaho Springs Municipal Code (“Code”) has undergone amendments as well, including a comprehensive amendment that changed the many of the Code Chapters in regards to numbering; and
WHEREAS, as a result, the Parking Plan references an out-of-date Code section in its introductory paragraph; and
WHEREAS, the City Council therefore desires to amend the introductory paragraph of the Parking Plan to reference the correct Code section.
NOW THEREFORE be it RESOLVED by the City Council of the City of Idaho Springs, Colorado as follows:
Section 1.The introductory paragraph of the Idaho Springs Parking Plan is hereby amended as follows:
This Parking Plan governs the parking of vehicles within the City of Idaho Springs, Colorado. Parking in violation of this Plan is unlawful as provided by Section 21-415-5of the Idaho Springs Municipal Code.
Section 2.The City Clerk shall amend all copies of the Parking Plan in her custody.
Section 3.Nothing in this Resolution shall be construed to repeal, modify or otherwise affect the validity of any parking regulation provided by the Model Traffic Code as adopted by the City by reference or by any section of the Parking Plan. The sole purpose and intent of this Resolution is to correct an erroneous reference created by the passage of time and Code amendments.
Section 4.Should any one or more sections or provisions of this Resolution be judicially determined invalid or unenforceable, such judgment shall not affect, impair or invalidate the remaining provisions of this Resolution, the intention being that the various sections and provisions are severable.
