Mayor Wheeler opened the public hearing at 7:00p.m. to consider a local law to amend Chapter 180 of the Code of the Village of Cazenovia (see above). There are four elements. The first would redefine the word “kennel” in the code to allow for dog grooming businesses in the Village. Currently, the village code does not distinguish between dog grooming and day care facilities from overnight kennels. The second edit to the code would clearly allow drive thru windows in Village Edge South in conjunction with drug stores or banks. The third edit would clarify the jurisdiction of the Historic Preservation Committee to be consistent with that required for the Village to earn “Certified Local Government” status. The fourth edit would modify the procedure of placing a sign in the B-1 district. The applicant for a sign would only have to go to either the Planning Board or the Historic Preservation/Architectural Review Committee but not both. There were no comments from the Board or the public.

Motion made by Mayor Kurt Wheeler and seconded by Trustee Fritz Koennecke to close the public hearing at 7:04pm.

Mayor Wheeler opened the public hearing at 7:05p.m. to consider a local law to amend Chapter 174 of the Code of the Village of Cazenovia which would clarify that all water service lateral lines must have both a corporate stop and a curb stop and that service lines for fire suppression systems shall consist of a separate service line tapped directly to the main with its own corporation stop and curb stop. There were no comments from the Board or the public.

MARCH 7, 2016 VILLAGE BOARD MEETING

Meeting called to order by Mayor Wheeler at 7:06 p.m.

Upon a motion by Mayor Wheeler, seconded by Trustee Koennecke, the Board approved the minutes from the February 1, 2016 Village Board meeting with one minor clarification brought up by Trustee Mann by a vote of 4-0.

Upon a motion by Mayor Wheeler and seconded by Trustee Mann, the Board approved the following resolution by a vote of 5-0.

RESOLUTION NO. 45

TO THE BOARD OF TRUSTEES

OF THE VILLAGE OF CAZENOVIA

WHEREAS, the attorney for the Village has prepared and presented aproposed local law entitled, “A local law authorizing a property tax levy in excess of the limit established in General Municipal Law section 3-c for the 2016 -2017 fiscal year”, and

WHEREAS, the proposed local law is intended to authorize the Village of Cazenovia to exceed the tax levy cap otherwise provided under New York State law for the Town’s 2016-2017 budget and fiscal year.

NOW THEREFORE IT IS HEREBY RESOLVED that the Board of Trustees of the Village of Cazenovia will hold a public hearing April 4, 2017 at 7:05 p.m. at the Village Municipal Building, 90 Albany Street, to consider the proposed local law entitled, “A local law authorizing a property tax levy in excess of the limit established in General Municipal Law section 3-c for the 2016-2017 fiscal year.”

The Village Board scheduled a special meeting for March 24, 2016, at 6:05 p.m.,or as soon thereafter as may be heard, at the Municipal Building to discuss the 2016 – 2017 budget.

Upon a motion by Mayor Wheeler and seconded by Trustee Mann, the Board scheduled a Public Hearing for April 4, 2016 at 7:00 p.m. at the Municipal to take and hear comments relating to the tentative budget as proposed by the Board of Trustees for the year 2016-2017 by a vote of 5-0.

The Board approved the request from Mimi Hall of the CazenoviaRotary Club to place three Little Free Libraries

at three different locations within the Village. The locations are Lakeland Park, Lakeside Park and at Burton Street Athletic Fields. The Board asked the Rotary Club to work with the Public Works Administrator when selecting the exact location of each.

Mr. Jim Stokes, Attorney for the Village of Cazenovia reviewedthe Environmental Assessment Form. The Board went through Part 2 of the EAF for the amendments of Chapter 180 of the Village Code.

Attorney Stokes reviewed the proposed resolution. Motion made by Mayor Wheeler and seconded by Trustee Joseph to pass the following resolution:

OF THE BOARD OF TRUSTEES

A RESOLUTION MAKING A DETERMINATION OF

ENVIRONMENTAL NON-SIGNIFICANCE UNDER THE NEW YORK STATE ENVIRONMENTAL QUALITY REVIEW ACT AND ENACTING

LOCAL LAW 2016-1 TO AMEND THE ZONING CODE OF THE VILLAGE OF CAZENOVIA

WHEREAS, this Board of Trustees has been developing and considering a proposed local law to enact revisions to the Village Zoning Code to correct prior omissions and revise administrative procedures to provide greater efficiency in the application process; and

WHEREAS, pursuant to a referral duly made pursuant to the provisions of Section 239-m of the General Municipal Law, the Madison County Planning Agency has reviewed proposed Local Law 2016-1, and has recommended that the question of the adoption of this local law be returned to this Board of Trustees for local determination, and

WHEREAS, upon notice duly published and posted, a public hearing on the adoption of proposed Local Law 2016-1 was duly held by this Village Board; and

WHEREAS, the public hearing has been, or hereby is closed, and

WHEREAS, in response to the comments received from the Madison County Planning Agency, the proposed local law has been slightly revised to clarify ambiguities identified by the Madison County Planning Agency, which revisions this Board hereby finds to be non-substantial changes to the local law; and

WHEREAS, this Board has reviewed the full environmental assessment form and has considered the likelihood of any potential adverse environmental impacts that might result from the adoption of Local Law 2016-1.

NOW, THEREFORE, BE IT HEREBY RESOLVED AS FOLLOWS:

  1. That the enactment of Local Law 2016-1 is a Type 1 action for purposes of the New York State Environmental Quality Review Act. There are no involved federal agencies, and there are no other involved agencies. The enactment of Local Law 2016-1 does not affect any lands located within New York State agricultural districts and does not involve the exercise of eminent domain or other public acquisition of land or the advance of public funds for any construction.
  1. That the enactment of Local Law 2016-1 will not have any significant adverse effects upon the environment. This resolution shall constitute a negative declaration pursuant to the New York State Environmental Quality Review Act in accordance with SEQRA’S implementing regulations. The reasons supporting this determination are as follows:

the action consists solely of a legislative enactment designed and intended to make technical changes to the language of certain sections of the zoning code so as to better achieve goals and recommendations of the Village’s Comprehensive Plan. The Board finds that the modifications of permitted uses in certain zoning districts that will result from the enactment of this local law are in accordance with the meaning and intent of the Comprehensive Plan. There will be no physical changes to the land or environment as a result of this action.

  1. This Board, after due deliberation, finds the amendments to the Village Zoning Code contemplated by Local Law 2016-1 to be in accordance with the Comprehensive Plan for the Village of Cazenovia, as amended.
  1. The adoption of Local Law 2016-1 will promote and protect the health, safety and general welfare of the Village of Cazenovia and its residents.
  1. That Local Law 2016-1 entitled “A Local law to amend Chapter 180 of the Code of the Village of Cazenovia”, is hereby adopted, to be effective immediately upon its filing with the Secretary of State, and that the Village Clerk be and hereby is directed to enter said Local Law in the minutes of this meeting and in the Local Law Book of the Village of Cazenovia, and to give due notice of the adoption of said Local Law to the public and to the Secretary of State.

WHEREAS, proposed local law 2016-2 of the Village of Cazenovia, entitled “A Local law to revise the water service regulations of Chapter 174 of the Code of the Village of Cazenovia”, has been introduced before this Board, and

WHEREAS, upon notice duly published and posted as required, a public hearing on the adoption of this proposed Local Law of the Village of Cazenovia was held by this Village Board of Trustees on March 7, 2016, and

WHEREAS, the adoption of this local law is not an action subject to the provisions of the New York State Environmental Quality Review Act in that it will not have any physical impact upon the environment, nor does it constitute an agency decision that will commit the Village of Cazenovia or any of its boards, agencies or officials to any future course of action that may affect the environment, and

WHEREAS, this Board, after due deliberation, finds it in the best interest of the Village of Cazenovia to adopt this local law.

NOW, THEREFORE, BE IT HEREBY RESOLVED that local law 2016-2 entitled “A Local law to revise the water service regulations of Chapter 174 of the Code of the Village of Cazenovia”, is hereby adopted, and that the Village Clerk be and hereby is directed to enter said Local Law in the minutes of this meeting and in the Local Law Book of the Village of Cazenovia, and to give due notice of the adoption of said Local Law to the public and to the Secretary of State.

The Board approved a sign request from CACDA for a sign on Lakeland Park fence to advertise Friday night movies at the Catherine Cummings Theater. The sign will go up during the week before each movie. The movies are scheduled for March 18, April 22, May 20, June 17 and July 15.

CACDA Initiatives

Mayor Wheeler stated the Creekside Park Planning Committee will be meeting on Tuesday, March 29th at 6:30 at the Cazenovia Public Library Community Room.

Trustee Fritz Koennecke gave his monthly report:

Parks:

  • Boat Launch Season will run from April 30 to Columbus Day October 10.
  • Last year we kept a steward on duty after 8 pm if there was still a trailer in the park. This ensured we got the outbound inspection. As a result, we may exceed the personnel budget by a few hundred dollars. Not planning to do this again for the coming year.

Lake Association and Lake Watershed Council

  • Next Lake Watershed Council meeting 7:00, March 15th at the village hall
  • February Lake Association
  • Tim Hunt briefed about the new harvester. It is twice as big as the old one and should produce much better results. CLA members provided him with feedback on how the harvester might be best employed.

Village Court:

  • Monthly totals: Judge Moore $9112, Judge Fisher $0.
  • Judge Fischer’s accounts are all set up and he is able to hear cases. He is planning to attend training soon.

Police Chief Mike Hayes gave updates on some of the ongoing investigations.

TREES

Tree Commission met February 20 to put the finishing touches on our upcoming educational seminar. The seminar will be held on Saturday, March 19 in the Library Community Room from 10 am - noon and is entitled Foundations for Successful Landscape Planting: Techniques for Planting and Pruning. Next month we will have more details about our Arbor Day observance on April 23.

I am also pleased to announce that the village has been named a Tree City USA for the fifth consecutive year. This comes as a result of coordinated effort between the volunteer Tree Commission, the DPW, local utilities, and of course the village board, and I am very grateful for everyone’s support.

LAKELAND PARK MASTER PLAN/HAND LAUNCH PROJECT

Lauren Lines, Ted Bartlett, Kurt and I met with Brit Basinger of Saratoga and Associates on February 23 to discuss the kayak launch project in Lakeland Park. Per our conversation here last month, Saratoga will be updating the concept drawings they did for us for the grant applications into construction documents that we will use to go to bid later this spring. We updated Brit on the budget for the project and directed him on what we would like to include in the new scope. Brit gave us some preliminary guidance on seeking agency approvals, which he feels will be our biggest hurdle. We expect to receive a tentative contract from Saratoga on March 15 for our review. Long story short, between the need for agency approvals and the fact that we are not yet under contract with NYS, it is difficult to set a timeframe for the project but it is unlikely that it will be complete this summer. I will know more when these contracts fall into place.
