Release, Waiver of Liability and Covenant Not to Sue

I certify that I am the parent or legal guardian of ______(the “Participant”). I hereby give permission for the Participant to participate in the Teen Fashion and Fun Tour offered by CityShop Tours, Inc. to be held on ______.

I hereby acknowledge my awareness that participation in the Teen Fashion and Fun Tour may expose the Participant to risk of property damage and bodily or personal injury. I understand that the risks the Participant may be exposed to include the following: motor vehicle accidents, exposure to inclement weather, standard and general risks arising out of the traveling through New York City and all other risks that may not be foreseeable.

To induce CityShop Tours, Inc. to permit the Participant to participate in the Teen Fashion and Fun Tour, I hereby release and forever discharge CityShop Tours, Inc., its officers, agents, independent contractors, and employees from any and all claims, demands, rights and causes of action of whatever kind that I may have, either in my own behalf or in my capacity as parent or legal guardian of the Participant, arising from or in any way connected with the Participant’s involvement in the Teen Fashion and Fun Tour.

I agree that I will discuss with the Participant the importance of following all directions of the tour leader(s). The Participant must stay with the tour at all times. At no time shall the Participant wander off on his/her own. I agree that the tour leader(s) are not chaperones and are in no way responsible for making sure that the Participant remains with the tour at all times.

I acknowledge that Participants ages 11 through 17 are permitted on the Teen Fashion and Fun Tour only if accompanied by a parent/legal guardian or provided that this Release, Waiver of Liability and Covenant Not to Sue is signed by the Participant’s parent or legal guardian and provided to CityShop Tours, Inc. on or before the scheduled tour date. I acknowledge that Participants under the age of 11 MUST be accompanied by an adult at least 21 years or older. The Participant is accompanied by (insert name of adult).

I hereby irrevocably grant CityShop Tours, Inc. the right to photograph and/or record on film, video and/or audio of the Participant’s likeness, biographical information, visual representation and/or voice, and further grant CityShop Tours, Inc. a perpetual, royalty-free license to use the likeness (and any simulation, alteration or reproduction thereof) in connection with advertising, marketing, products, packaging or other uses without compensation and without restriction as to duration, geography, media or frequency.
