SHORT TERM RENTAL AGREEMENT
THIS SHORT TERM RENTAL AGREEMENT hereinafter referred to as “Lease”, made and entered into this ______day of ______, 2007 by and between Steven and Carol Bowen, hereinafter referred to as "Owner," and ______hereinafter referred to as "Renter," hereby rents from Owner and grants to Renter pursuant to all state laws, the vacation residence described below in its present condition, under the terms herein stated.

1. Renter agrees to pay the following sums of money to Owner in consideration of this lease:

Upon deposit, Owner agrees to ensure that the vacation time is in the name of the Renter and to notify Renter of this. Renter agrees to confirm the reservation with the owner of the property and that it has been made accurately.
2. Security deposit will be returned to renter within two weeks of their departure given that there is no damage to the condo or any furnishings. Any repairs or excessive cleaning required will be paid for out of the security deposit.
3. The deposit, minus any fees or expenses, will be refunded if cancellation is prior to two months before arrival. From 2 months prior to arrival to 1 month prior to arrival, a 50% refund of deposit will be offered. Less than one month prior to arrival, the entire deposit will be forfeited.
4. With rental of the condo, the Renter has the right to use the 4 seat GEM electric cart stored in the garage. The Renter acknowledges that:
- The GEM cart is a street legal vehicle and should only be driven by licensed adults.
- Although street legal, this cart has not been insured or licensed to drive on the public streets and should therefore only be driven on the private drives around the country club.
- The cart should not be driven on the golf course or the cart paths around the golf course.
- Any damage done by the GEM cart or to the GEM cart will be the responsibility of the Renter to correct.
5. The Renter will also have the right to use the Owners Charlevoix Country Club Social Membership, which includes free unlimited use of the tennis courts, swimming pool, and 24 hour fitness room. While using these country club facilities, the Renters will be expected to act in a responsible manner.
6. The Social Membership does not include golf privileges. The golf course is a private, member’s only course, but does offer opportunities for golf to Social Memberships and visitors (which change from time to time). It is the Renter’s responsibility to check with the country club directly and tell them you will be staying in a Social Members condo to find out what golfing opportunities and prices might be available.
7. Renter shall not sublet this lease without Owner’s express written consent.
8. Occupancy shall be no more than 6 persons. Renter agrees to abide by policies set by the management, refrain from loud noise and to return unit in clean sanitary rentable condition or pay costs of same. Renter is responsible for any damages.
9. Renter agrees that no pets shall be allowed in vacation property without permission of Owner. If a pet is allowed, Renter shall take special care to ensure that no sign of the pet (smells, stains, hairs, etc) remain at their departure.
10. Personal Property and Liability: All personal property kept by Renter in said premises shall be and remain at his/her sole risk and Owner shall not be liable for any damages to, or loss of such personal property ensuing from any acts of negligence of any other persons, nor from any problems with the rental unit from any other cause whatsoever, nor shall Owner be liable for any injury to the Renter or guests of the Tenant in or about the premises. The Renter expressly agrees to save Owner harmless in all such cases.
11. This Lease shall be governed pursuant to the laws of the state of the property; and invalidation of any portion of this Lease shall not invalidate the remainder.
This document contains the entire agreement between the parties, and any changes, amendments, or modifications hereof shall be void unless the same are in writing and signed by the parties hereto. Renter and Owner acknowledge receipt of a true copy of this Short Term Rental Agreement.
