44/13 Planning Decisions

The committee was passed details of planning decisions received from Teignbridge District Council for information. Noted.

45/13 Teignbridge District Council – Draft Enforcement Policy for Consultation

This item was referred from the March Works, Services and Planning Committee meeting.

Discussion took place and Cllr Austen said that this Policy had been drawn up as enforcement action had not been carried out quickly enough in the past. She said that following the adoption of this policy, things would be done more vigorously and more efficiently.

The following comments were made to be passed back to TDC:

·  That the number of days for dealing with a complaint was listed for urgent, less urgent etc., items, but no number of days for dealing with priority complaints was given. Councillors would like to see a number of days to be listed for this action.

·  Under item 2.1 of the Consultation TDC say that “The council’s objectives for the planning enforcement policy were to ensure that the policies of the council and the planning system are not undermined”. Town Councillors felt that they were undermined in relation to the Planning Application for 20A Firleigh Road being approved by the District. Also in relation to Haldon Woods where enforcement to remove travellers has meant that by flouting the rules they have obtained what they hoped for by being provided with a permanent site.

46/13 Road Safety, Kingsteignton Retail Park

The committee was passed a copy of a letter received from Mr C Slocombe, together with photos concerning road safety at Kingsteignton Retail Park. Mr Slocombe said that he felt that pedestrian safety could be improved at this site. He said that the entrance to the Retail Park on the Newton Road was very wide to cross with traffic coming from two directions entering the retail park as well as traffic leaving the park. He offered a solution and felt that it would make sense to get rid of the shrubs on the left hand side of the entrance so that the pavement could be extended into the retail park. Mr Slocombe also said it would be sensible to put in a crossing i.e. white lines on the ground to make it clear that this is where pedestrians need to cross to enter the park.

Mr Slocombe had also emailed Cllr Walters concerning this matter. Cllr Walters has responded to Mr Slocombe and said that a request has been put forward for the yellow lines at this junction to be extended, however, the land itself belongs to the Cooperative Society and works on a pavement would probably necessitate a widening of the entrance. Cllr Walters said he would investigate the idea but suggested that Mr Slocombe speak with the manager of the Next Store who has a contact with the Cooperative Society.

Discussion took place and Cllr Howard proposed that the Town Council should write to the Cooperative Society saying what a great success the Kingsteignton Retail Park has been and how busy the site now is and suggest that it may now be necessary to consider some adjustments to the site with regard to a pavement on the left hand side for pedestrians as they enter the Retail Park. Seconded by Cllr Moss and agreed.

47/13 Letter received from Mrs a M Pope, Exeter Road concerning accident at the junction of Exeter Road/Strawberry Terrace/Ley Lane

Mrs Pope has handed a letter into the office, with copies also being sent to TDC and Cllr M Walters, concerning the recent accident at the traffic lights on the junction of Exeter Road/Strawberry Terrace/Ley Lane. She says that that the recent accident on Friday 5 April, 2013 damaged the wall to her property, which saved the van from hitting her window. She says that she has lost count of the numerous times she has seen accidents with drivers exchanging details.

Discussion took place and the committee asked that the Clerk acknowledge receipt of the letter to Mrs Pope and inform her that the council have written to DCC Highways supporting her concern at the number of accidents at this junction.

36/13 Correspondence

·  TDC Monthly – February up-date for information

o  Dealt with 547 incidents

o  Dealt with 142 incidents involving dogs and dog fouling

o  Issued one £300 fixed penalty for No Waste Carriers Licence

o  Carried out extensive daily patrols around Teignbridge

o  Assisted the police on 2 occasions

o  8 abandoned vehicles were reported with 2 removed to storage and 1 was scrapped from storage

·  A letter has been received from Teignbridge District Council informing the Town Council that they have resolved that the Community Resource Centre, Greenhill Road and the area of green space at the corner of Hackney Lane and Greenhill Way should be listed as assets of community value under the Community Right to Bid process. The asset owners have the right to request that the District Council review its decision, which must be made within 8 weeks of notification of listing. The properties will remain listed as assets of community value during this period. TDC will contact the Town Council if an appeal is received or in 8 weeks time from the date of their letter (23 April, 2013)
