AN ACT TO ADD A NEW §67103.2 TO CHAPTER 67 OF DIVISION 3, TITLE 10, GUAM CODE ANNOTATED,RELATIVE TO AUTHORIZING THE GUAM VETERANSAFFAIRS OFFICE TO OUTSOURCE THE MAINTENANCE AND UPKEEP OF THE GUAM VETERANS CEMETARY.

BE IT ENACTED BY THE PEOPLE OF GUAM:

Section 1. Legislative Intent. I Liheslaturan Guåhanfinds that the Guam Veterans Affairs Office struggles to consistently maintain the upkeep and maintenance of the Veterans Cemetery. I Liheslaturan Guåhanfurther finds that the Guam Veteran Cemetery is a Veteran Administration recognized state veteran cemetery and as such should strive to achieve the standards set forth in Veteran Administration, National Cemetery Administration (NCA) guidelines for the operation and maintenance of cemeteries. I Liheslaturan Guåhanfinds that the appearance of the cemetery is a high priority to our Veterans and general community and rightly so as we value andrespect our service members.

Section 2. A new § 67103.2 is added to Chapter 67 of Division 3, Title 10, Guam Code Annotated, to read:

§ 67103.2. Outsource maintenance and upkeep of Guam Veterans Cemetery.

(a) The Guam Veterans Affairs Office working with the Veterans Commission pursuant to this Chapter, shall, within sixty (60) days from the effective date of this Act, develop and transmit toI Liheslaturan Guåhan, the standard operating procedures (SOP)to be followed for the upkeep and maintenance of the Guam Veterans Cemetery. This SOP is subject to the approval of the Guam Veteran Commission. This SOPshall be used to develop the desired contractualscope of work to be published in the Request for Proposals issued pursuant to Title 5, Guam Code Annotated.

(b) In developing the standard operating procedures, the Guam Veterans Affairs Office shall use applicable Veteran Administration references and guidelines to include the Mill Spring National Cemetery solicitation number VA786-13-R-0054 dated 12-27-2012, National Cemetery Administration National Shrine Operational Standards and Measures and 36 CFR Part 12 (National Cemetery Regulations).

(c) The Guam Veterans Affairs Officemay contract the maintenance and upkeep of the Veteran Cemetery with the concurrence of the Veterans Commission.

(d) The contract shall be written for a preferenceset-aside to a Service Disabled Veteran Owned Small Business.

(e) Funding for the contractual outsourcing for maintenance and upkeep of the Guam Veterans Cemetery shall annually be allocated from the fiscal year budget for the Guam Veterans Cemetery of the Guam Veterans Affairs Office.”

Section 3. Effective Date. This Act shall become effective upon enactment.

Section 4. Severability. If any of the provisions of this law or its application to any person or circumstance is found to be invalid or contrary to law, such invalidity shall not affect other provisions or application, and to this end the provisions of this law are severable.
