Dear Sirs,

We acknowledge that the sensitivity and reaction of this kind of cargo (……) is very unforeseeable. The risk of lost or damaged on plant could be independent of the temperature accurate. As well the non-possibility to manage properly and fully regular the humidity control could create some damage on cargo. We certify that all the necessary care and preparation have been achieved to guarantee our cargo to arrive in sound condition at destination. But Due to the sensitiveness of the cargo, we hereby undertake to hold CMA CGM, its underwriters, subsidiaries, agencies, sub-agencies, all their representative directors and employees harmless in respect of any liability, loss or damage of whatsoever nature which you may sustain in respect with your complying with our instruction and that we shall not make any claim, nor issue any proceedings, for damage or loss regarding the quality of the cargo.

CMA-CGM will be responsible in case of breakdown of the unit on reefer, the regulation and temperature will be submitted to the shipping condition.

We also acknowledge that the estimated time arrival provided by CMA CGM is given as estimation only and that CMA CGM shall not be held liable for any damage or loss to the cargo due to any delays.

Moreover, in the event that the cargo is refused at destination by Sanitary Authority any other Authority, we agree to bear the full fees and costs which should be engaged for the re-sending the unit to port of loading and / or cargo destruction and we agree to reimburse CMA CGM for any Customs fine / penalty which should be levied against them.

This letter of indemnity will cover up each shipment carried out by CMA CGM on our account.
