ORDINANCE NO. 1- 2010

AN ORDINANCE AMENDING MUNICIPAL CODE SECTION 11-1-8, OF THE CODE OF THE TOWN OF GRANDLAKE, BY REDUCING THE BOARDWALK CLEARANCE WIDTH FOR A COVERED BOARDWALK ON AN 80’ RIGHT OF WAY

WHEREAS, amendments to the Boardwalks, Sidewalks and Community Greenway Regulations of the Town of Grand Lake Code are permitted; and,

WHEREAS, the Town of Grand Lake Board of Trustees discussed proposed changes on December 14, 2009, and January 11, 2010; and

NOW THEREFORE BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF GRANDLAKE THAT:

PART 1. Section 11-1-8,Obstruction of Sidewalks and Boardwalks Prohibited, of the code of the Town of Grand Lake, Colorado, is hereby amended to read as follows:

  1. Except as provided in this Articleno person shall obstruct or cause to be obstructed any sidewalk or boardwalk within the Town in any manner whatsoever, but shall at all times, keep such sidewalks and boardwalks free of obstructions to the passage of foot travel.
  1. Nothing in this Articleshall prohibit duly authorized personnel from placing items on sidewalks and boardwalks for public safety.
  2. For a typical one-hundred foot (100’) Right of Way, items Items that shall not be deemed to be obstructions so long as the continuous walking area is not reduced to less than five feet (5’), and the owner of said item has received prior written approval from the Town Manager or his designee for the placement of the item shall include:
  3. Public telephones
  4. Unattended drop boxes (parcel post, etc.)
  5. Covered cigarette butt disposal devices
  6. Posts
  7. Rails
  8. Decorative or flower boxes, excluding hanging flowers
  9. News racks that comply with this Article.

3.For a typical eighty foot (80’) Right of Way, the post(s) for the roof covering on a covered boardwalk shall not be deemed to be obstructions so long as the continuous walking area is not reduced to less than four feet, four inches (4’-4”), and the owner of said item has received prior approval from the Town Manager or his designee for the placement of the post/roof covering.

a. In all areas where a roof covering post is not located, a five-foot (5’) clearance must be maintained.

b.The decreased continuous walking area shall not be permitted in locations where there is access into or from the structure. In these locations, a five-foot (5’) clearance must be maintained.

  1. Any items that are located in entirety on the private property portion of the boardwalk or sidewalk shall not be deemed to be obstructions so long as the continuous walking area of the boardwalk or sidewalk is not reduced to less than five feet (5’).

PART 2. Except as specifically amended herein, the other provisions of Chapter 11 of the Grand Lake Town Code shall remain in full force and effect.

PART 3. If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or unconstitutionally of the remaining portions of this ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, and phrases be declared invalid or unconstitutional.
