Description / Bequests:
- to testator’s friend Nicholas Crews of Hembal, St Mewan, gentleman, and testator’s son-in-law Samuel Trethewy of St Stephen in Brannel, yeoman, messuage, tenement and appurtenances in Enniscavin [Enniscaven] in St Dennis ‘now in the Tenure and Possession’ of William Robins, to hold for the remainder of the term of years ‘which I shall be possessed of therein at the time of my death’ to hold in trust, to allow testator’s daughter Mary Trethewy to have for her own use at ‘Rent Issues and Profit therof’ for ‘such time of the said Term as shall run out and expire in her life time’; after her death testator’s granddaughter Mary Hawke and great-granddaughter Ann Martin to receive the rent etc for their joint lives ‘share and share alike’; after the death of one of them the survivor shall receive the rents, issues and profits.
In case Mary Hawke and Ann Martin both die before Mary Trethewy, testator’s grandson William Phillips and his heirs is to ‘hold and injoy’ the property for the remainder of the lease and term after Mary Trethewy’s death.
- To daughter Mary Trethewy, one guinea
- To Nicholas Crews and Samuel Trethewy an annuity of £6 for life of testator’s granddaughter Mary Hawke payable out of the testator’s tenement ‘commonly called Penventen Vale’ in Roche payable half-yearly from the time of testator’s death ‘or levied by Distress and Sale of Goods’ in trust to be paid to Mary Hawke for her sole use; the annuity is not to be sold or mortgaged, and not subject to ‘the Control Debt or Engagement’ of Mary’s husband George Hawke ‘or any after taken Husbands of hers’. Also to trustees, annuity of five guineas until testator’s great-granddaughter Ann Martin is 21, payable out of his tenement in Treranke in Roche payable half-yearly from the time of testator’s death or to be levied by distraint in trust to pay the annuity to Ann Martin
- to Ann Martin, 5 guineas ‘at her day of Marriage’
- to son-in-law, Samuel Trethewy 5 guineas
- to testator’s sister, Elizabeth Kelly, brother George Carhart, nephew George Carhart, his son Robert Carhart, and John, son of John Robins of Roche, victualler, one guinea each
- to Nicholas Crews and Samuel Trethewy all testator’s lands and tenements in Penventen Vale, Treranke [both in Roche] and in Trethergy in St Austell ‘and all my other Lands and Tenements’ for ever, in trust, for the ‘Use and Behoof’ of testator’s grandson William Phillips and his lawful heirs; in default of issue, to nephew George Carhart and his lawful heirs; in default of issue, ‘for my right heirs’, subject to annuities.
- All the testator’s ‘Personal Estate, ready Money, Securities for Money, Tin Work Bounds, Tin Adventures, Goods, Chattles and Effects whatsoever not before disposed I hereby Give & Bequeath’ to the trustees in trust for grandson William Phillips and his heirs for ever. The trustees are to act as guardians of grandson until he is 21.
