Welcome and Introduction of Members – President - Chuck Rivette

President Rivette welcomed everyone in attendance. He went on to say that there were not enough members present to form a quorum; therefore, the highlights from the last meeting could not be approved. He asked Steve Hutchinson to send them out via email as final and ask for approval from members. President Rivette announced that the agenda was shortened for today and the meeting should adjourn around the lunch hour.

Advisory Council Update – Steve Hutchinson – Waste Permits Division

Steve reminded members that the Trade Fair will be May 3 & 4 at the Austin Convention Center. MSW topics are listed on the brochure and available for review on the website. Steve went on to announce that six positions on the Council are expiring at the end of August and the outreach for the Notice for Applications would be published in the very near future. He encouraged those members whose terms are expiring to please reapply. All expiring terms are listed on the website.

Ken May from TCEQ presented the legislative report to the 82nd Legislative Session from the Regional Solid Waste Grant Program. The numbers included are from 2008-2009 and provided to legislators from each of the twenty-four Councils of Government. The report is also available for review on the website.

Waste Permits Division Update – Earl Lott – Division Director

Ms. Kari Bourland was present to report for Earl Lott. Kari presented a summary of the list of bills filed at the 2011 legislative session that related to solid waste. Discussion ensued regarding several of the bills.

MSW Section Update – Dr. Richard Carmichael – Section Manager

Dr. Carmichael reported that there are currently seven vacancies in the section that will not be filled. He also reported that he knows of two engineers that will be leaving by the end of June. These positions also will not be refilled. He stated that Work Group Leaders have been appointed and this new program has been very successful. The leaders supervise functions of the sections but do not complete personnel actions.

Dr. Carmichael related interesting facts regarding presentations at the upcoming Trade Fair. Discussion followed relating to what courses at the Trade Fair would qualify for continuing education for license renewals. To view this interesting discussion, go to the website:

Shingle Recycling and Discussion – Wayne Harry – MSW Division

Mr. Harry related a success story that started in 2009 when TXDOT rewrote their asphalt mix specifications and allowed for the addition of a 5% amount of recycled, single tab residential shingles could be added to their asphalt mix. The Air Program ‘s decision to allow a standard air permit for post consumer and manufactured scrap shingles helped lead to the TXDOT decision. The change brought about a successful program and created a need for the scrap shingles that are otherwise useless in recycling. Much discussion followed.

Recycling Rate Discussion – MSW Advisory Council

President Rivette introduced the subject by reminding members of discussions and presentations held at earlier meetings and then announced that Dr. Clark had drafted a resolution to the Commissioners. Dr. Clark read the resolution to members. The resolution suggests that a stakeholder group be established to define what data can be obtained and the best method to collect the data. Dr. Clark made a motion that the resolution be forwarded as written and sent on to the Commissioners. David Yanke seconded the motion. After interesting discussions, it was decided that the recommendation be sent to members electronically and discussed more completely at the next meeting of the Council. Issues regarding funding were also discussed.

President Rivette adjourned the meeting.
