CONTROL OF PESTICIDES REGULATIONS 1986 (S.I. 1986 NO. 1510):
APPROVAL FOR OFF-LABEL USE OF AN APPROVED PESTICIDE PRODUCT
This approval provides for the use of the product named below in respect of crops and situations, other than those included on the product label. Such "off-label use", as it is known, is at all times done at the user’s choosing, and the commercial risk is entirely his or hers.
The conditions below are statutory. They must be complied with when the off-label use occurs. Failure to abide by the conditions of approval may constitute a breach of that approval, and a contravention of the Control of Pesticides Regulations 1986 (as amended). The conditions shown below supersede any on the label which would otherwise apply.
Notice is hereby given that in exercise of the powers conferred by Regulation 5 of the Control of Pesticides Regulations 1986 (SI 1986/1510) (as amended) and of all other powers enabling them in that behalf, the Secretary of State and the Scottish Ministers (as regards Scotland) and the Welsh Ministers and the Secretary of State (acting jointly as regards Wales) have given

Operator Protection:
(1)Engineering control of operator exposure must be used where reasonably practicable in addition to the following personal protective equipment:
(a)Operators must wear suitable protective gloves when handling the concentrate.
(b)Operators must wear suitable protective clothing (coveralls, hood) and suitable protective gloves when applying via air-assisted spraying equipment.
(2)However, engineering controls may replace personal protective equipment if a COSHH assessment shows that they provide an equal or higher standard of protection.
Environmental protection:
(1)Since there is a risk to aquatic life from use, users not applying the statutory buffer zone must either themselves carry out, or ensure that someone else has carried out a Local Environment Risk Assessment for Pesticides (LERAP) on their behalf before each spraying operation from a broadcast air-assisted sprayer. Users must not allow direct spray from such sprayers to fall within 35m of the top of the bank of any static or flowing waterbody or within 5m of a ditch which is dry at the time of application (these distances to be measured as set out in PSD’s booklet ‘Local Environment Risk Assessment for Pesticides - Broadcast Air-assisted Sprayers’ - and any amendments that are made to it) unless:
(a)The LERAP indicates that a narrower buffer zone will be sufficient; and
(b)Any measures indicated by the LERAP as justifying the narrower buffer zone are complied with in full and in accordance with any conditions applicable to them.
Spray must be aimed away from water.
(2)The results of the LERAP must be recorded in written form and must be available for a period of three years for inspection to any person entitled to exercise enforcement powers under or in connection with the Food and Environment Protection Act 1985 (as amended). (An electronic record will satisfy the requirement for a written record, providing it is similarly available for inspection and can be copied).
(3)Detailed guidance on LERAPs and how to conduct a LERAP are contained in the PSD booklet ‘Local Environment Risk Assessment for Pesticides - Broadcast Air-assisted Sprayers’ (Ref: PB6533), available from Defra Publications, Admail 6000, London. SW1A 2XX: Tel. 08459 556000. All LERAPs must be carried out in accordance with this Guidance and any amendments that are made to it.
Other specific restrictions:
(1)This product must only be applied in accordance with the terms of this approval, the product label and/or leaflet and any additional guidance on off-label approvals.
(2)A minimum interval of 7 days must be observed between applications.
(3)The maximum concentration must not exceed 30 ml product/100 litres water.
(4)This product qualifies for inclusion within the Local Environment Risk Assessment for Pesticides (LERAP) scheme for broadcast air-assisted sprayers. Before each spraying operation from a broadcast air-assisted sprayer, either a LERAP must be carried out in accordance with PSD’s published guidance or the statutory buffer zone must be maintained. The results of the LERAP must be recorded and kept available for three years.

ADVISORY INFORMATION
This approval relates to the use of ‘Systhane 20 EW’ (M09396) to control hop powdery mildew, particularly during the flowering and cone development stages of the crop.
The product should be applied as a medium spray via broadcast air-assisted sprayer using a maximum spray concentration of 30 ml product per 100 litres water. The spray volume should not exceed 3000 litres water per hectare thus equating to a maximum individual dose of 900 mls product per hectare.
A maximum of 3.6 litres per hectare of ‘Systhane 20 EW’ may be applied per year up until 14 days before harvest. A minimum interval of 7 days must be observed between applications.
This approval has been re-issued to amend the expiry date in line with the parent product.
