ORDINANCE NO. 26.1

PUBLIC PROPERTY ORDINANCE

AN ORDINANCE regulating the use of public parks, property and buildings within the Village of North Branch, imposing regulations on the use of those properties and facilities, and repealing any and all ordinances and/or resolutions in conflict therewith.

THE VILLAGE OF NORTH BRANCH ORDAINS:

SECTION 1.ENABLING AUTHORITY.

This Ordinance is adopted pursuant to and in accordance with the General Law Village Act, being Act 3 of 1895, as amended.

SECTION 2. SHORT TITLE.

This Ordinance shall be known and cited as the “Village of North Branch Public Property Ordinance.”

SECTION 3.COMPLIANCE WITH RULES AND REGULATIONS.

All persons in, on, or about any public land or building within the Village of North Branch must complywith all posted regulations, signs, and park rules. Any person who fails to comply with such regulations, signs or rules may be refused admittance to the property or facility.

SECTION 4.PROHIBITED CONDUCT.

4.1The following conduct shall be prohibited on all public property and within public buildings:

  1. No person shall injure, deface, disturb or in any manner destroy or cause to be destroyed any part of any school, public building, park or any facility building, sign, structure, equipment, utility or other property found therein.
  1. No person shall mark with any substance, or in any other manner deface or do damage to any fence, tree, lawn, motor vehicle, sign, fixture, or other items situated on lands owned, occupied, or otherwise used by any school or any governmental agency.
  1. No personshall, while on public or private grounds near any building in which a school or any class thereof is in session, or in which a meeting of any governmental body is in session, willfully make or assist in making any noise or diversion which disturbs or tends to disturb the peace, quiet, or good order of such school, class, or governmental meeting.
  1. No person, whether in the day or nighttime, shall willfully make or assist in the making of any noise or diversion which disturbs or tends to disturb the peace, quiet or good order of any school gathering or function.

4.2The following regulations shall apply to individuals utilizing the North Branch Memorial Park:

  1. It shall be unlawful for any person to consume, possess and/or transport into or within, or have under his or her control within the boundaries of North Branch Memorial Park, any beer, wine or other alcoholic beverage.
  1. No personal shall start or maintain a fire except in approved grills located throughout the Park.
  1. No person shall enter or remain within the Park between the hours of dusk and dawn.
  1. No person shall dump, deposit, throw, leave, or abandon any litter at, or on any property located within the Park. All litter shall be placed in receptacles or containers designated for the temporary collection or storage of litter.
  1. No person shall use bicycles within the Park except in the area designated as a skate park.
  1. No person shall have in his/her possession or control any fireworks within the Park.

SECTION 5.PENALTIES

Any person or persons violating any of the provisions of this Ordinance, upon conviction thereof, shall be guilty of a misdemeanor punishable by imprisonment in the county jail for a term not to exceed 90 days or a fine not to exceed $500.00 or both, such fine and imprisonment.

SECTION 6.REPEAL OF CONFLICTING PROVISIONS

All resolutions, ordinances or parts thereof in conflict with the provisions of this Ordinance are to the extent of such conflict hereby repealed.

SECTION 7. SEVERABILITY

If any section, paragraph, clause or provision of this Ordinance is for any reason held to be invalid or unconstitutional, the invalidity or unconstitutionality of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this Ordinance.

SECTION 8.PUBLICATION

A true copy of this Ordinance or a synopsis of the Ordinance shall be published in a newspaper circulated in the Village within fifteen (15) days after the date of adoption.

SECTION 9.EFFECTIVE DATE.

This Ordinance Amendment shall take effect twenty (20) days after adoption.
