Terms and conditions

  1. The promoter of this competition is Yooralla (the "promoter") (ABN 14 005 304 432), 244 Flinders Street, Melbourne, Victoria, Australia.
  1. An entrant must be an individual and not a company or organisation. Individual employees of Dangerfield, Father Bob Maguire Foundation and Yooralla are eligible to enter, however these individualswill not be permitted to participate on the judging panel of the entries.
  1. Each entry must be submitted in accordance with these terms and conditions. By entering the competition, each entrant agrees to be bound by these terms and conditions. The promoter may at its discretion refuse to award any prize to any entrant who fails to comply with these terms and conditions.
  1. Entry into the competition is free and is open to residents of Australia and elsewhere, worldwide.
  1. Entrants under the age of 18 must have their designs submitted by a parent or guardian to be eligible to receive their prize if successful in being selected as a finalist.
  1. The competition opens at 9am,Monday 4 May 2015 and closes at 5pm, Friday 29 May 2015 Australian Eastern Standard Time(“the competition period”).Any entry received outside the competition period will be deemed invalid. No responsibility is accepted for late, lost, delayed or incorrectly uploaded entries.
  1. To enter the competition, you mustcorrectlyupload your t-shirt design throughthe YoorallaTEE 99designs competition page which will be made available from the promoter’s website at for the competition period.
  1. By submitting thedesign, you as entrant:
  1. agree to be bound by these terms and conditions
  2. grant the promoter and its licensees and assignees an exclusive licence for the period from the commencement of the competition period up to and including Wednesday 31 December 2014 and thereafter, a non-exclusive, perpetuallicense(in each case including the right to sub-license) to exercise all intellectual property and other rights throughout the world in the t-shirt designyou have submitted and all other material provided by you to the promoter as part of your entry to this competition and specifically, you consent to the promoter doing anything with your t-shirt design which would, but for this consent infringe your moral rights (as defined in the Copyright Act 1968 (Cth)).
  1. There will be five(5) finalists in this competition who will win cash and voucher prizes and have their t-shirt design printed and sold in Dangerfield stores across Australia and internationally online.

The judging process will proceed as follows:

  1. The top 20 designs will be selected from the entries available on the 99designs competition page by the promoter's panel of judges. The top 20 will be determined by which designs best meet the design theme and brief(which will be available on the YoorallaTEE 99designs competition page accessible at yooralla.com.au) and will be selected by 5pm on Tuesday 2 June 2015.
  2. From the top 20, five(5)entrants whosedesignsare judged by the promoter's panel of judges to be the best, most original and creative will be thefinalists of the competition and will be selected and announced by 5pm Friday 5June 2015.
  1. Entries which, in the promoters sole discretion, contain offensive content or language will be disqualified.
  1. This is a game of skill and chance plays no part in determining the prize winners.
  1. The five(5)finalistswill havetheir winning designsprintedon t-shirts which will be sold in Dangerfield storesand onlineby Dangerfield from Wednesday 1July 2015 until the earlier to occur of Wednesday30 September 2015 or the date the t-shirts are all sold out ("sale period").
  1. At the conclusion of the sale period, the winner will be the design that sold the most number of t-shirts through Dangerfield. If two or more designs are sold out by the end of the sale promotion period, the winner will be the entrant with the design that sold out first.
  1. The total prize pool valueiscomprised of cash and prizes which will be distributed to finalists as follows:
  1. The five (5) finalists of the competition will each receive AUD$145(or equivalent in the local currency of the finalist)in cashthroughthe 99designs platform and payment system.
  2. The five (5) finalists will eachreceive a $500 Dangerfield voucher. Note that Dangerfield vouchers are not transferable or redeemable for cash and are subject to their own terms and conditions. Each voucher is valid for redemption for a period of 12 months from the date of purchase.
  3. All finalists will be notified by telephone or email and the fivefinalists' names will be published on the Yooralla website within seven (7) days of winners being determined.
  4. If any prize is not available for any reason, the promoter may substitute prize of equal or greater value, subject to any written directions from the relevant lottery authorities.
  1. Each entrantwarrants that:
  1. all details provided with his or herentry are true and accurate
  2. he or shehas all necessary rights and licenses to grant the rights set out in these terms and conditions
  3. the designsubmitted is an original work and of his or herown creation
  4. he or she is the copyright owner of all copyright works and subject matter comprising the design. Note that any design believed to be in breach of copyright laws or other laws protecting intellectual property will be refused entry or disqualified and the original creator notified. This applies to trace jobs, character theft and photo manipulations;and
  5. the exercise of the rights granted to the promoter in these terms and conditions will not infringe the intellectual property rights or any other rights of any third parties,andhe or she will indemnify the promoter against any loss or damage resulting from any breach of these warranties.
  1. Entrants acknowledge that the promoter is under no obligation to exercise any of the rights granted to it by these terms and conditions.
  1. Entrants agree that,should they win, the promoter may use their entry and any personal details provided to the promoter for any promotional, marketing and publicity purposes of the Promoter, in any media without notice and without any fee. Otherwise, all personal information collected in the course of this competition will be used solely for the purposes of the competition and will otherwise be treated in accordance with Yooralla's privacy policy found at
  1. The finalistsare permitted to display the winning design on their website(s), blogs or other internet sites provided they are labeled as a competition entry and linked back to the Yooralla website at
  1. Decisions of the promoter and its panel of judges are final and will be binding on each entrant and no correspondence will be entered into.
  1. Prizes will be distributed to finalists and the overall winner within 30 days of the conclusion of the sales promotion period on Wednesday 30 September 2015.
  1. In the event that afinalistis unable to be contacted, the promoter will retain the prize for twelve (12) months from the date of the conclusion of the sale promotion period. If the prize is not claimed within twelve (12) months of this date, the judges may determine another finalistfor the unclaimed prize.The finalistreceivingthe unclaimed prize will be the finalist for the purpose of these terms and conditions.
  2. If there are any events that prevent or hinder the promoter's conduct of the competition or the promoter's ability to deliver the prize to the finalists, the promoter may, in its discretion, cancel the competition and recommence it at another time under the same conditions or select another finalist.
  1. The promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this competition, or for any technical error that may occur in the course of the administration of this competition. The promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
  1. To the full extent permitted by the law, the promoter will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or inconsequential) to persons or property as a result of any person entering into the competition or accepting or using any prize, including without limitation non-receipt of any prize or damage to any prize in transit.
  1. The promoter reserves the right to request verification of age, identity, residential address and any other information from entrants relevant to entry into or participation in this competition. Such verification is at the absolute discretion of the promoter, whose decision is final. Any entrant who provides false information or fails to provide information requested by the promoter may be disqualified at the promoter's absolute discretion.
  1. The promoter reserves the right to change these terms and conditions at any time. In the event of such change, notification will be posted on the promoter’s website.
  1. These terms and conditions are to be interpreted, in relation to entrants within Australia, in accordance with the law applicable in the relevant state or territory of Australia in which the Australian Entrant resides and otherwise for all other entrants from outside of Australia, in accordance with the Laws of the State of Victoria, Australia.
