The following agreement represents the full and complete understanding between the parties, and both parties agree to the following terms.

Condition of Sale: The puppy referenced in this contract has been born under the care of 6R Upland Kennels. Many of the puppies from 6R Upland Kennels will develop into dogs that are suitable for one or more of the following purposes: showing, hunting, or breeding. It should be understood, however, that there is no guarantee at the time of sale regarding the future showing, hunting, or breeding prospects of the animal. We do guarantee a good companion animal and pet.

Registration:All puppies from 6R Upland Kennels are sold on limited registration unless otherwise arranged prior to completion of sale and noted on this contract.

Transfer:This contract and any warranties of health are non-transferable upon later sale or gift of dog.
Return:6R Upland Kennels guarantees that at the time the puppy leaves the kennel, that he/she is in good health to the best of our knowledge. The Buyer has 1 month from the time of receipt of dog to have dog examined by a veterinarian. It is strongly urged by us that all purchasers do so in order to avoid nullification of this agreement. If at the time of the initial vet check, the puppy is determined to be seriously ill from symptoms that are undoubtedly the result of a hereditary condition (this does not include the presence of parasites), the Buyer is to return the puppy along with any other accompanying information within two days at Buyer’s expense, if a replacement is desired. At this point 6R Upland Kennels will replace the puppy in question with another puppy of similar bloodlines and/or the same color and gender should the Buyer so desire, upon availability. This guarantee will be terminated immediately if the dog is not examined within the allotted time.

Health Warranties: A warranty against all life altering genetic disease is provided for two years after the date of birth. Should a genetic disease be discovered during this time that will greatly shorten the life of, or greatly alter the quality of life of the dog, 6R Upland Kennels will provide the Buyer with a puppy of same value, chosen by the breeder, upon availability. All of what has been said above is contingent upon the new owner(s) providing a letter of verification from the examining veterinarian.
The new puppy is also guaranteed until it reaches two years of age against any severe and/or life threatening heart, liver, kidney or thyroid defects. Additionally this guarantee covers any severe and/or life threatening seizure disorders or ocular defects resulting in blindness for two years. Should any problem such as those mentioned above arise, that are clearly hereditary in nature, the owner is to contact 6R Upland Kennels immediately. In addition to their written statement of intent to invoke the terms of the guarantee, the owner should provide documentation and any or all x-rays or other material from their veterinarian to 6R Upland Kennels, who will upon receiving them seek a confirming diagnosis from a veterinarian of their choice. Should the condition prove to be hereditary in nature and have a serious adverse effect on the dog’s quality of life, an exchange will be made for a puppy of equal value to the dog in question, chosen by the breeder, upon availability. This exchange is contingent on either veterinary verification of the dog’s euthanasia (for purposes of minimization of pain and suffering) or in non-life threatening cases, a spay/neuter verification from a veterinarian.
Additionally, the puppy is guaranteed until it reaches two years of age against severe crippling hip and elbow dysplasia. In an instance where severe crippling hip or elbow dysplasia is diagnosed a replacement puppy will be provided so long as the owner takes the following steps. First,the owner must immediately notify 6R Upland Kennels of the diagnosis. Second, the owner must then provide X-Rays for submission to OFA (the Orthopedic Foundation for Animals) and/or a veterinarian of the breeder’s choosing. If the diagnosis of severe crippling hip or elbow dysplasia (dysplasia so extreme that it prevents the dog from being a functional family companion and that surgery or euthanasia is required) is confirmed, a replacement puppy of equal value, of the breeder’s choosing, will be provided. This replacement is contingent on the owners providing a written statement from their veterinarian that the dog is not and has never been overweight for its bone structure and that no evidence exists that the puppy was overstressed or over exercised during this important developmental period of its life. Furthermore, the veterinarian must indicate there have been no signs of abuse, neglect or past injuries that could be the cause of such dysplasia. In cases where the exchange is to take place and the owners of the dog to be replaced have chosen surgery rather than euthanasia, they must also provide written documentation that the dog in question has been spayed or neutered and has never sired or whelped a litter. It is agreed and understood that in all instances outlined above the only applicable refund is a replacement puppy. In no case will there be a money refund. If the breeder feels the puppy has been the victim of an accident, abuse or neglect, the health warranty will be void.
Buyer Guarantee: The Buyer agrees to maintain this dog in good health, provide routine preventative health care including, but not limited to, inoculation, internal and external parasites, and preventative medication. Veterinary records must be provided to breeder if requesting a replacement under the circumstances stated in the “Return” provision stated above. The puppy is to be fed a high quality dog food, and have fresh water available and adequate shelter. If any of the above preventative care has not been provided, or if the breeder feels the puppy has been the victim of abuse or neglect, the health warranty will be void.

6R Upland Kennels have taken steps to ensure that the puppy is healthy. This puppy has been selectively bred for excellent quality, health, soundness, intelligence and good temperament. The puppy has been on a vaccination and deworming schedule. It is very important to continue vaccinations and a worming schedule and to not forget annual boosters. The Buyer agrees that the puppy will need follow-up vaccinations, worming, flea control, rabies vaccination, and heart worm prevention as recommended by a veterinarian.

Deposit and Payment: Deposits are non-refundable. The puppy must be paidfor in full at time of pick up or shipping.

Order of Choice: 6R Upland Kennels reserves the right of first choice of any puppy out of any litter for our breeding program. For purchasing parties: the first party to place a deposit on a puppy will have the next choice of puppy, with the second party to place a deposit getting the next opportunity to choose their puppy, and so on for the remaining puppies of the litter. Final picks of puppy must be chosen by or before the week the puppies turn 7 weeks old.
Shipping: When shipping is required, it is at the Buyer’s expense. All puppies will have a first set of vaccinations, be de-wormed, and will be accompanied by a veterinary health certificate if being shipped by air. Shipping fees include: air fare, shipping crate, health certificate, and travel to the Airport. If a puppy must be returned, all shipping and transportation costs are at the expense of the Buyer.

Damages: The Buyer agrees to maintain the dog in a humane environment and to properly train and care for the dog. Under no circumstances shall 6R Upland Kennels be liable to the Buyer or any third party for any consequential, incidental, or special damages resulting from, or in any manner related to the dog.

Costs:Upon receipt of puppy all veterinary care and associated costs are the sole and exclusive responsibility of Buyer.
Waiver of Liability:6R Upland Kennels expressly assumes no responsibility for this dog once it leaves the premises. This includes veterinary medical expense, mortality, landlord’s disapproval, allergic reaction to puppy, family disagreement, behavioral/training difficulties, mistreatment of dog, accidental poisoning or trauma or any other reason not specifically stated above.

Seller’s Request: If for some reason one of the above problems should arise and you find yourself wanting to place the dog in a new home, we ask that you first contact 6R Upland Kennels. Our primary concern is that none of our dogs, under any circumstances, end up in a dog pound or other type of animal shelter. There may be other options and we would be happy to help.

As the Breeder/Seller I certify that the dog/puppy is free from illness and defects to the best of my knowledge. This agreement is valid only for the original owner and is non-transferable.
As the Buyer I have read and understand the stated guarantees and information regarding 6R Upland Kennels and this puppy/dog and agree to this document in full.
