C I R C U L A R

It has been noticed that there has been undue delay in finalizing disciplinary proceedings by Cadre Authorities. In some cases, disciplinary proceedings have been initiated against officials when they were at the verge of superannuation.

Natural justice demands that disciplinary proceedings are finalized in an expeditious manner. The delay in completion of proceedings works against the institutional incentive built to fight corruption. It may either cause undue harassment and demoralization of innocent employees, who at the end of the proceedings are exonerated of the charges framed against them; or it enables the guilty officers to evade punitive action for longer periods of time. In the former, it is not fair to the official concerned. In the latter, it provides perverse incentive for the corrupt. The delay in handling disciplinary cases has, on several occasions, been viewed adversely by the Courts also. There have in fact been instances where the proceedings initiated against the delinquent employees were quashed solely on the ground that there were inordinate delays in handling the disciplinary cases. It is important that the formal proceedings, once instituted, are completed within the time frame laid down by the Government so that timely action can be taken against the delinquent employees.

Delays in disposal of disciplinary cases are a matter of serious concern to the Central Vigilance Commission also. The Commission has issued instructions that departmental inquiries should be completed within a period of six months from the date of appointment of Inquiry Officers. A copy of instructions dtd. 23rd May, 2000 issued by the Central Vigilance Commission, New Delhi is enclosed herewith. It is desired that the time limits specified should be strictly adhered to by the Cadre Authorities in dealing with disciplinary cases, so as to ensure that the disciplinary cases are disposed off expeditiously.

CIRCULAR

Sub: Submission of annual immovable property returns by employees of KVIC.

According to Regulation-23(ii) KVIC Employees Conduct Regulation-2003, every employee is required to submit an annual return in the prescribed format giving full particulars regarding the immovable property inherited by him or owned or acquired by him or held by him on lease or mortgage either in his own name or in the name of any member of his family or in the name of any other person. This return is to be filed by 31st January for the previous calendar year.

Further, Regulation- 2 (f) KVIC Employees Conduct Regulation -2003 defines member of the family as :

(i)the wife or husband, as the case may be, of the employee, whether residing with the employee or not but does not include a wife or husband, as the case may be, separated from the employee by a decree or order of a competent court;

(ii)son or daughter or step/son or step-daughter of the employee and wholly dependent on him, but does not include a child or step-child who is no longer in any way dependent on the employee or of whose custody the employee has been deprived by or under any law;

(iii)Any other person related, whether by blood or marriage, to the employee or to the employee's wife or husband and wholly dependent on the employee.

All Cadre Controlling/Administrative Authorities are informed to obtain IPR (Form enclosed) from the Employees working under their administrative as well as cadre jurisdiction and proper records may be maintained for the same.

Compliance of the specific provisions of Regulations may be adhered scrupulously and action taken report may be sent on the above.

Sub: Complaint Handling Policy –reg.

It is observed that complaints/grievances containing the elements of vigilance angle which are received by State/Divisional Directors and Zonal Dy.C.E.O.s are taken up by them for confirmation as well as scrutiny.

2.The Central Vigilance Commission has issued guidelines in this regard vide Circular dtd.01.07.2009.

3.As per the guidelines issued by the CVC,any complaint/grievance received by any functionary containing any element of alleged corruption, malpractice and misconduct etc., should necessarily be sent to the Chief Vigilance Officer for scrutiny and action. Any further action on such complaints shall be taken by the Vigilance.

4.It is desired that all concerned may ensure compliance of the same.

Sub: Observance of Vigilance Awareness Period - 2010

The Central Vigilance Commission (CVC) has decided that this year (2010), Vigilance Awareness Period will be observed from 25th October to 1st November 2010. The observance of Vigilance Awareness Period should commence with the pledge (copy enclosed) on 25th October, 2010 at 11.00 A.M. This year the main focus of observing Vigilance Awareness Period is on "Generation of Awareness and Publicity against Corruption". The CVC has emphasized on spreading awareness against the harmful effect of corruption and has suggested organizations to have an effective anti-corruption campaign this year.

2.In this connection, it has been decided to observe Vigilance Awareness Period as detailed below :

i)All Field Offices (State/Divisional/Sub/Zonal Offices and Departmental Training/Trading Units) should conduct Vigilance oath ceremony on 25 October 2010 at 11.00 A.M.

ii)Posters/Banners on Vigilance Awareness Period should be displayed predominantly in the office premises.

iii)With a view to involve maximum number of officials in Vigilance Awareness programmes, all officials of KVIC are informed to send their views (not exceeding 200 words) suggesting ways to eliminate misconduct and corruption in the organization and how to promote a culture of honesty and efficiency. Best three views from the employees/officers will be selected by a Committee and certificate will be issued. The views may be sent directly to Chief Vigilance Officer, KVIC on or before 1st November 2010.

It has been noticed that records containing sanction of funds as well as other records are not properly maintained in various Directorates/offices. At times, when Directorate of Vigilance makes requisition of certain records, those records/files are reported untraceable and at times certain relevant documents are missing from the files.

It is also seen that the concerned Director/Incharge is not able to fix anyone’s accountability/responsibility for such missing records. Such mismanagement of records leads to undue delay in finalization of investigation undertaken by Vigilance. It is the responsibility of the concerned Directors/Incharges to ensure that a proper record keeping system is in place and also to ensure that office records are maintained and kept systematically and properly.

All Directors/Incharges should pay attention to proper maintenance of records and they should make the supervisory/ministerial staff dealing with the records responsible for proper filing and upkeep of records. If any record is found untraceable/missing when required for any verification, concerned official will be held responsible and action, as deemed fit, will be taken against him.

All concerned should ensure that necessary steps for proper maintenance of records are taken immediately and Compliance Report may be sent.

Sub: Acceptance of Gift by Govt. Servants

Central Vigilance Commission (CVC) has considered the matter of gifts presented during festive occasions to Govt. Servants and is of the view that this practice, at least, so far as Government servants are concerned, needs to be discouraged. The CCS (Conduct) Rules provide that no Government servantshall accept or permit any member of the family or any other person acting on his behalf to accept any gift except on occasions like weddings, anniversaries or religious functions.

CVC further clarified that the gifts are to be provided only to promote commercial/business interest and need not therefore be sent to government officials etc. who are only doing their duty. The public sector undertakings, banks etc. are therefore advised that they may follow this advice with immediate effect.

All officials of KVIC may ensure adherence of guidelines specified by the CVC.
