SpecificAssurances

As aconditionofthereceiptoffundsunder thissub-grantprogram,theapplicantagreestocomplywiththe following Sub-grantConditionsand Assurances.Thesignatureofthe authorizedagentsonthe frontofthe applicationindicatesacknowledgementandagreementtoallassurances.The applicantisrequiredto print, sign,andretain acopyofthese specificassurances atthe charter schoolsite.

1.This grantshallbeadministeredin accordancewiththe provisionsofCalifornialawregarding charter schools;Title X,Part CoftheImproving America’sSchoolsAct of1994;andtheCode ofFederalRegulations(CFR) parts75,76.785through76.799,77,81, 86,and99.Expendituresshallcomplywithallapplicableprovisionsoffederalandstateregulationsandpoliciesrelating to theadministration,useandaccountingfor public schoolfunds.Anyinterpretationsoflaw,regulations,andproceduresshallbethe soleresponsibilityof theCaliforniaDepartmentofEducation(CDE).

2.TheCDEreservesthe authoritytorequirethe repaymentofreceived funds,thereturnofallunused funds,and/or the terminationofthegrantif the grantrecipientfails to meetthetermsofthisagreement,failsto meetestablished deadlines, orfails toact ingood faith tocarryout the activitiesdescribedin thegrantproposal.

3.Thecharter school or charter developer agrees tousethe funding in amannerconsistentwiththeir applicationsas submitted, oras revised and approvedbytheCDE.

4.Thegrantrecipientagreesto fulfillthe performance measuresspecifictoitsgranttypeand submittimelyfinancialreports,statusreports,andallotherrequiredreports.Failure todosocouldresultinthe forfeiture ofthegrantand repaymentof funds.

5.ThegrantrecipientagreestocooperatewiththeFederalDepartmentofEducation,theCDE,theState Board ofEducation,andtheir independentcontractors,ifany,intheadministration ofthisgrant,andtoconductanyexternalevaluation ofthe effectivenessofthegrantprocess.

6.Auditablerecordswillbe maintainedon file forfiveyearsfollowing thegrantclosing date.

7.Thegrantrecipient’sname will beusedin allcommunications.

8.ReporttotheCDEthe school-leveldataasdescribedinthisRequestforApplications(RFA).

9.Respondtoanyadditionalsurveys orothermethodsofdatacollectionthatmayberequired for the fullsub-grantperiod.

10.Includeinthe applicationallrequired formssignedbythe primaryapplicantordesignee.

11.Allauditsoffinancialstatementswill beconductedin accordancewithGovernmentAuditingStandardsand withpolicies,procedures,and guidelinesestablished bytheEducationDepartmentGeneralAdministrativeRegulations(EDGAR),SingleAuditAct Amendments,and OMBCircular A-133.

12.Applicanthasprovided timelynotice ofitsintent to applyforPCSGPsub-grantandacopyofthesub-grantapplication tothe authorizer.

13.Maintain fiscalprocedures to minimizethetimeelapsing between thetransfer ofthe fundsfromtheCDEanddisbursement.

14.Federalregulationsrequiregrantrecipientstoestablishwrittenstandardspursuanttoemployee conflictsofinterestin awarding contracts,and writtenstandardsfor resolutionof anyprotests ordisputesthatarise from procurements.Regulationsalsoprovidenumerousrequirementsin theprocurementprocess,specificallydesignedtoensureproperuse ofpublicfundsinanopenand freelycompetitiveenvironment.InformationontheseregulationscanbefoundinAppendixD.Procurementsthatare notnegotiated inaccordancewith federalregulationswill bedisallowed.

15.For allgrantrecipients,the following documentsmustbeon fileat their businessoffices:

  • Organizationalcharts,signedarticlesofincorporation,and anyotherorganizationalandgovernancedocumentsofthe agency.
  • AcopyofthisRFAand thegeneralassurances and certifications,aswell asother relevantmaterials thatarereferred to, butnotincluded, withintheRFA.

16.Teachershired bygrant recipientsmustadhereto Elementaryand SecondaryEducation Act (ESEA)“highly-qualifiedteacher” standardsfor core academics.Moreinformationaboutthesestandardsmaybe foundontheCDEImprovingTeacherand PrincipalQualityWeb page at Inaddition,allstaffmusthavecleared health(e.g.,tuberculosis) and criminalbackground (e.g.,fingerprinting) checks.Thisinformationissubjecttoreviewandverification byCDEstaff.

17.Grantrecipientsmustparticipateannuallyinalltesting programsrequiredbystatelaw.

18.Allnon-federalentitiesexpending $500,000ormore incombinedfederalfunds(e.g.,PCSGPand TitleIfunds,or American RecoveryandReinvestment Act[ARRA]funds) in asingleyear arerequiredbyfederallawtoobtain andsubmit aSingleAudittotheFederal AuditClearinghouse.Further information maybefoundin OMBCircular A-133,whichmaybe accessed at the following link:

19.Grantrecipientswill access theFederalAuditClearinghouseWebpagetosubmittheir SingleAudit.The Web pageaddressis

20.TheCDEwillverifythat the grantrecipient’sschool(1)has anenrollmentof atleast50studentsatonepointin time withinthe first calendar year ofoperationbasedon theeffective date thecharter schoolisopenand availabletoservestudentsAND(2)hasat least100studentsatonepointin timewithintwocalendar yearsofoperation basedonthe effectivedatethecharter schoolisopenandavailable to servestudents.

Depending onthe date thecharter schoolopened toservestudents,grantrecipientsmayprovidetheCDEwitheither acopyofanonlineCDEDataQuestcertifiedenrollmentreport, acopyofanaggregateschool-levelCaliforniaLongitudinalPupilAchievementData System (CALPADS) OperationalDataStore(ODS) enrollmentreport,orasignedletterfrom thecharter authorizer thatconfirmsenrollment.

If theschooldoesnotreach the minimum enrollmentrequiredduring thegrantprojectperiod,grantdisbursementsmaybe withhelduntilthe enrollmentrequirementhasbeen met.Ifthe schooldoesnot reach the minimumenrollment

requirementbythe endof the grantprojectperiod,theCDEmayinvoicetheschoolfor grantpaymentsissuedtodate.Ifthegrantrecipientisconcerned thattheschoolwill notmeet the enrollmentrequirements,inlieu ofmeeting thisrequirementtheCDEwillconsider a budgetreportsubmittedbythegranteethatatteststothe sustainabilityoftheschoolbeyond the duration ofthe grant.

Theadmissionpolicyofthe charter schooliscompliantwithallapplicablelaws.

CaliforniaEducationCode Section47605(d)states

(d)(1) Inaddition to anyother requirementimposedunderthispart,acharter school shall be nonsectarianinitsprograms,admissionpolicies,employmentpractices,and allotheroperations,shallnot chargetuition,andshallnotdiscriminate againstanypupil onthe basisofthecharacteristicslistedin Section220.Exceptasprovidedinparagraph(2),admissiontoacharter schoolshallnot bedeterminedaccording totheplaceofresidenceof the pupil,or ofhisor her parentor legalguardian,withinthisstate,exceptthatanexisting publicschoolconverting partiallyorentirelytoacharter schoolunder thispartshalladoptandmaintain apolicygiving admission preferenceto pupilswhoresidewithintheformer attendance area ofthatpublicschool.

(2)(A) Acharter school shalladmitallpupilswhowishtoattendtheschool.

(B)Ifthe numberofpupilswhowishto attend thecharter schoolexceeds theschool'scapacity,attendance,exceptfor existing pupilsofthecharter school,shallbedeterminedbyapublicrandom drawing.Preferenceshallbeextended to pupilscurrentlyattending thecharter schoolandpupilswhoresideinthedistrictexceptas providedfor inSection 47614.5.Other preferencesmaybe permitted bythechartering authorityonanindividual schoolbasis and onlyifconsistentwiththelaw.

(C)Inthe eventof a drawing, thechartering authorityshallmake reasonableefforts toaccommodatethe growthofthecharter schoolandinnoeventshalltakeanyaction toimpedethecharter schoolfromexpanding enrollment tomeetpupildemand.
