According to the Law on Waste of the Republic of Belarus, wastes are specified as substances or goods produced in the process of economic activities and human vital functions, but not having any certain application at site of their generation or that have lost totally or partially their consumer properties due to physical or moral obsolescence.

According to the Law on Waste of the Republic of Belarus, hazardous wastes are wastes that contain as their compounds substances possessing any hazardous property or set of properties (toxicity, infectious, explosive risk, high reactivity and/or other similar properties) and existing in such amounts and in such form that these wastes independently or in contact with other substances can pose immediate or potential threat to environment, human health and/or to the persons’ property, including that caused by their adverse impact on environment.

Appendix 1 to the Order of State Customs Committee of the Republic of Belarus "On Improvement of Customs Control over Industrial/Consumption Waste Movement through Customs Border" (No. 134-OD of 12.03.1999) provides a "List of Industrial and Consumption Waste, Which Cannot be Processed or Used in the Republic of Belarus”; Appendix 2 to the Order of State Customs Committee "On Improvement of Customs Control over Industrial/Consumption Waste Movement through Customs Border of the Republic of Belarus" (No. 134-OD of 12.04.1999) provides a "List of Industrial and Consumption Waste Which Can be Processed or Used in the Republic of Belarus”, permits for their import (transit) are issued by the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus".

The Law On Waste of the Republic of Belarus of 25 November 1993 № 338-3 in edition of the Law from 18.11.2004 regulates that "Transboundary movement of waste from the Republic of Belarus is carried out on the basis of the written permit issued by the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus, provided that the competent authority of the state to which such waste is exported with the purpose of further use or neutralization in its territory submits a written permit and confirms the availability of the contract specifying ecologically safe use or neutralization of this waste”.

The Law On Waste of the Republic of Belarus of 25 November 1993 No. 338-3 in the wording of the Law of 18.11.2004 regulates that "Transboundary movement of waste to the Republic of Belarus is allowed only with the purpose of its use as raw materials or secondary materials in the Republic of Belarus and is effected only on the basis of a preliminary obtained permit for transboundary movement of waste to the Republic of Belarus issued by the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus, provided that the waste to be imported to the Republic of Belarus may be used by ecologically substantiated method confirmed by the legislation of the Republic of Belarus and the competent authority of the state from which such waste is imported to the Republic of Belarus provides a written permit for return of such waste in case of cancellation of the permit for its transboundary movement in the Republic of Belarus”.

The Law On Waste of the Republic of Belarus of 25 November 1993 No. 338-3 in the wording of the Law of 18.11.2004 regulates that "Transboundary movement of waste through the Republic of Belarus is effected on the basis of a preliminary obtained permit for transboundary movement of waste through the Republic of Belarus issued by the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus provided that the interested state submits a written permit for import and/or transit of this waste and the competent authority of the state from which such waste is moved through the Republic of Belarus submits a written permit for return of this waste in case of cancellation of permits of the Republic of Belarus and other interested states for import and/or transit of this waste”.

Notification is used while controlling the transboundary movements of hazardous wastes in the Republic of Belarus. At present the procedure and the format of this notification are brought into accord with requirements of the Basel Convention.

The National Action Plan on Rational Use of Natural Resources and Environmental Protection in the Republic of Belarus for 2006-2010 years adopted 05.05.2006 by the Decree of the President of Republic of Belarus No. 302 which provides, as one of priorities: collection, use and neutralization of waste; improvement of the economic mechanism of nature management.
Principal activities in waste management for 2006-2010 are as follows:
improvement of the legislation on ecologically safe waste management;
ecologically safe management of waste generated in production of potash fertilizers;
development and implementation of waste use technologies;
construction of the main facilities providing safe burial and processing of waste;
ecologically safe storage and neutralization of hazardous waste;
ecologically safe storage of waste and used equipment containing polychlorinated biphenyls.
(ii) / Legislation, regulations and guidelines:
The Law On Tax for Using Natural Resources (the Ecological Tax) of the Republic of Belarus of 23 December 1991 in the wording of the Law of Republic of Belarus No. 80-3 of 31.12.2005, No. 190-3 of 29.12.2006;
The Law On Waste of 25 November 1993 in the wording of the Law No. 338-3 of the Republic of Belarus of 18.11.2004 is the main act of legislation in the sphere of hazardous wastes management.
The purpose of this Law is to prevent harmful waste effect on the environment and human health, and also to maximize involvement of waste into turnover as secondary raw materials. The Law establishes requirements which are to be observed in managing hazardous waste and other waste. Requirements cover generation, collection, transportation, storage, use and neutralization of waste.
In elaboration of the Law a number of regulations have been adopted:
- Decree No. 275 of the President of Belarus of 15.06.2005 On Tax Rates for Use of Natural Resources (the Ecological Tax) and Some Issues of its Collection.
- Decree No. 437 of the President of Belarus of 10.07.2006 On Specific Measures for Improving Collection (Stocking up) and Use of Waste as a Secondary Raw Material;
- Decision No. 4 of the Ministry of Natural Resources and Environmental Protection of 28.03.2002 On State Register of Technologies for Waste Recycling and On State Register of Facilities for Waste Neutralization and Disposal;
- Decision No. 27 of the Ministry of Natural Resources and Environmental Protection of 26.11.2001 On Approval of Rules of Waste Accounting;
- Decision No. 21 of the Ministry of Natural Resources and Environmental Protection of 23.10.2001 (in the wording No. 1of 11.02.2004) On Approval of the Rules of Issuance, Suspension and Cancellation of Licenses for Industrial Waste Disposal;
