STEEL TRASH AND RECYCLING

RECEPTACLES

REPLACEMENT FOR EXISTING STOCK

SECTION I: SCOPE

The purpose of this request for quotation is to establish an annual vendor contract(s) for STEEL TRASH AND STEEL RECYCLING RECEPTACLES, to be used in outdoor public areas citywide for incidental use by pedestrian traffic. Although it is the City of Seattle’s intent to award to a single vendor, the City realizes that the need may arise to create a pool of suppliers.

Any questions regarding this solicitation should be directed to the Buyer listed on the cover page of this solicitation, per CLARIFICATIONS, Page 5, of this Request for Quotation.

SECTION II: GENERAL INSTRUCTIONS

Any quantities set forth in this Request for Quotation are estimated annual usage amounts. Quantities are listed only for the purposes of evaluating bids and will not constitute a purchasing obligation by the City.

Taxes shall not be included in the bid price. The City is exempt from Federal Excise Tax. WashingtonState and Local Sales Tax will be an added item on invoice only.

Any contract resulting from this bid may be expanded to cover any similar product normally stocked by the supplier, provided that the supplier agrees to provide the material using the same pricing structure as the items specifically listed.

It is anticipated that most orders placed under any resultant contract shall be placed by telephone. The successful bidder shall be required to maintain adequate local stock to ensure timely delivery upon request.

Award may be made to one contractor only for the entire amount, or contract may be awarded to two or more bidders. Award will be based on availability of products, proximity of bidder’s facility, frequency of deliveries, or any other factor, which may affect cost to the City.

Bid prices are to remain firm through the term of the contract. If firm prices cannot be bid, state escalation terms in the space provided.

Any contract resulting from this Request for Quotation shall be assigned a vendor contract number. Orders shall be placed directly by using City department. Invoices shall be mailed in duplicate directly to the ordering department.

INSURANCE. Prior to the execution of a vendor contract, the successful vendor shall provide evidence of insurance as indicated, and in accordance with “Requirements for Insurance” attached.

Bidders are not to make any contact with the City about this Request for Quotation except through the office of Purchasing Services Section. Any bidder who submits a bid, which is at variance with this Request for Quotation, on the basis of information received from any agency other than the Purchasing Section, may be considered nonresponsive and that bid rejected.

The Director of Executive Services reserves the right to reject any and all bids, to waive formalities in bids, to accept any item in a bid and to cancel any contract upon thirty (30 days written notice).

NON-DISCRIMINATION IN BENEFITS (SMC CH. 20.45). Prior to, and as a condition of, the execution of a purchase contract, the successful bidder/proposer shall provide a completed "Equal Benefits Compliance Declaration," Attached. The apparent successful Bidder/Proposer will be sent an "Intent to Accept Quotation/Proposal & Award Contract" letter requesting the Declaration be returned to the Buyer within 5 days from date of notification.

SUBMISSION OF QUOTE

ALTERNATE QUOTE: If the vendor elects to submit more than one quote, then the quotes should be submitted in separate envelopes and marked as indicated above. The second, or alternate, quote should be marked as “Alternate.”

QUOTES RECEIVED LATE: It is the quoter’s responsibility to ensure that their quote is received by Purchasing Services prior to the opening date and time specified. Any quote received after the opening date and time will be promptly returned to the quoter unopened. The City of Seattle will not be responsible for quotes received late because of delays by a third party delivery service; i.e., US Mail, UPS, Federal Express, etc.

QUOTE CALCULATION ERRORS: In the event there is a discrepancy between the total quoted amount or the extended amounts and the unit prices quote, the unit prices will prevail and the corrected sum will be considered the quoted price.

PAST PERFORMANCE: All vendors will be evaluated on past performance and prior dealings with the City of Seattle (i.e., failure to meet specifications, poor workmanship, late delivery, etc).

WITHDRAWAL OF QUOTE: No quote may be withdrawn for a period of 90 days after the scheduled time for receiving quotes. A quote may be withdrawn prior to the quote opening date and time. Such a request to withdraw should be made in writing to the Purchasing Manager, who will approve or disapprove of the request.

CITY RESERVES THE RIGHT: The City reserves the right to waive minor

informalities in any quote; to reject any or all quotes with or without cause; and/or to accept the quote that in its judgment will be in the best interest of the City of Seattle.

EXECUTION OF QUOTE: All quotes shall contain the signature of an authorized representative of the quoter in the space provided on the quote proposal form. All quotes shall be typed or printed in ink. The bidder may not use erasable ink. All corrections made to the quote shall be initiated.

ACCEPTANCE

The materials and/or services delivered under this quote shall remain the property of the seller until a physical inspection and actual usage of these materials and/or services is accepted by the City and is found to be in compliance with the terms herein, fully in accord with the specifications and of the highest quality. In the event the materials and/or services supplied to the City are found to be defective or do not conform to specifications, the City reserves the right to cancel the order upon written notice to the seller and return such product to the seller at the seller’s expense.

SUBSTITUTIONS

Whenever in these specifications a brand name or make is mentioned, it is the intention of the City only to establish a grade or quality of material and not to rule out other brands or makes of quality. However, if a product other than that specified is quoted, it is the vendor’s responsibility to name such product with his quote and to provide to the City that said product is equal to the product specified. The City of Seattleshall be the sole judge as to whether a product being offered by the quoter is actually equivalent to the one being specified by the detailed specifications. (Note: This paragraph does not apply when it is determined that the technical requirements of this solicitation require only a specific product as stated in the detailed specifications.)

RULES, REGULATIONS, LAWS, ORDINANCES & LICENSES

The awarded vendor shall observe and obey all laws, ordinances, rules and regulations, of the federal, state, and local government, which may be applicable to the supply of this product or service. Also, the vendor shall possess at the time of opening of the quote all necessary permits or licenses required for the sale of this product and/or service.

RECYCLED PRODUCTS

It is the City of Seattle’s stated policy objective to ensure all departments are aware of the availability of recycled products. The bidder shall specify the amount of recycled content material for containers and liners identified in this quotation.

WARRANTY/GUARANTY (Unless otherwise specified)

All materials and/or services furnished under this quote shall be warranted by the vendor to be free from defects and fit for the intended use. The extent and duration of the warranty shall be specified in writing.

ANTI-LOBBYING CLAUSE

All firms are hereby placed on formal notice that no employees from the City of Seattle are to be lobbied, either individually or collectively, concerning this project. Firms and their agents who intend to submit qualifications, or have submitted qualifications, for this project are hereby placed on formal notice that they are not to contact City personnel for such purposes as holding meetings of introduction, meals, or meetings relating to the selection process outside of those specifically scheduled by the City for negotiations. Any such lobbying activities may cause immediate disqualification for this project.

INSURANCE (AS APPLICABLE)

Insurance shall be provided, per the attached insurance guide. Upon request, an insurance certificate complying with the attached guide, may be required prior to award.

ANTI-COLLUSION STATEMENT

NO BIDDER WILL DIVULGE, DISCUSS OR COMPARE THEIR QUOTE WITH OTHER BIDDERS AND WILL NOT COLLUDE WITH ANY OTHER BIDDER OR PARTY TO A QUOTE WHATSOEVER. NOTE: NO PREMIUMS, REBATES OR GRATUITIES TO ANY EMPLOYEE OR AGENT ARE PERMITTED EITHER WITH, PRIOR TO, OR AFTER ANY DELIVERY OF MATERIALS. ANY SUCH VIOLATION WILL RESULT IN THE CANCELLATION AND/OR RETURN OF MATERIAL (AS APPLICABLE) AND THE REMOVAL FROM THE BIDDERS LIST.

Requests from bidders for clarifications, interpretations, exceptions and/or changes to the Specification must be specifically identified and addressed in writing prior to September 10, 2004 at 4:30 PM. The City will not review or accept Bidder’s preprinted terms and conditions.

SECTION III - TECHNICAL SPECIFICATIONS

1.GENERAL

The specifications detail a 36-gallon capacity steel trash receptacle that is durable for the collection of on-street litter or recyclable materials. The City will consider only those bidders who can demonstrate they meet the MINIMUM SPECIFICATION standards for quality, quantity, service and delivery in the manufacturing of STEEL TRASH OR RECYCLING RECEPTACLES. All bids shall be sealed and mailed or hand delivered not later than the time and date set for closing to:

2.STEEL TRASH RECEPTACLES

MINIMUM SPECIFICATIONS: All prospective bidders must meet or exceed the following minimum specifications for the manufacture. Failure on the part of any bidder to meet these minimum specifications will result in rejection of the bid.

The following are minimum specifications required for STEEL TRASH RECEPTACLES to be delivered to the City of Seattle.

A.All trash receptacles shall be made of steel and should have a durable under coat and baked enamel finish. Receptacles must have a rust inhibitor primer coat and the final finish must be of exterior industrial enamel.

B.Trash receptacles must be heavy enough to withstand 25 mph winds when empty.

C.Surface for receptacle and lid must allow for easy removal of graffiti, dirt, grime and similar materials.

D.Litter receptacle must have a separate removable inner liner made of rigid plastic or metal capable of handling loads of at least 60 pounds and be leak resistant. Liner must provide handholds to allow for lifting easy removal from litter receptacle.

  1. Liner should have a capacity of at least 35 gallons when empty.
  2. Separate metal lid for receptacle must be affixed to frame of receptable via hinge or steel plastic-coated cable of at least ¼ inch. The opening of the lid must be no more than 8 square inches in circumference and should be designed to reduce chance of litter falling between the inner liner and outer container.

G.Receptacle must have a minimum of four adjustable legs.

H.The steel litter receptacle must be a green color which is close to or a identical match to existing city litter receptacles (current color is Parkforms VS Green).

I.The service height of the receptacle cannot exceed 64" (Service height is the total height of both the interior liner and the exterior receptacle when the liner is being lifted out of the exterior receptacle.)

J.SPU or its designee must be provided at least one (1) receptacle for field testing prior to accepting a full order of receptacles. The field test may last up to 10 days in duration.

  1. Steel containers should be equal to Victor Stanley T-32 series (36 gallon) litter receptacle or better. Equal means that container should have similar weight, rugged construction and have similar rust or damage guarantee.
  2. Containers shall have permanently affixed panel for labeling. This panel shall be welded to one side of the litter receptacle. The panel shall be at least 3” by 9 “ and should be made of steel. This placard may be used by the city to affix a label or other information on the litter receptacle.
  3. Containers shall comply with applicable ADA requirements.

IF YOUR PROPOSAL MEETS ALL THE MINUMUM SPECIFICATIONS OR REQUIREMENTS SHOWN, MARK "YES" OR "Y" IN THE BLANK SPACES PROVIDED. IF YOUR PROPOSAL DOES NOT MEET THE MINIMUM SPECIFICATIONS OR TAKES EXCEPTION TO THE REQUIREMENTS, THEN MARK "NO" OR "N". Optional Features for Steel Litter Cans

  1. Dome style, convex shaped lid that reduces water into the container can or special lid cover.
  2. Lid that can be locked to prevent items larger than the lid opening to be placed in the container.
  3. Liners made from galvanized steel or similar material.
  4. Side load litter cans with a permanently affixed lid.
  5. Cost for replacement liners and lids of the same standards (quality, color etc) as original liners and lids.

Prices to be firm for the initial three-year period. After this time prices may be adjusted based on an agreed upon inflation factor for an additional year.

Bidders shall specify the recycling content of materials used to fabricate litter can and liner.

5. STEEL RECYCLING RECEPTACLES

MINIMUM SPECIFICATIONS: All prospective bidders must meet or exceed the following minimum specifications for the manufacture. Failure on the part of any bidder to meet these minimum specifications will result in rejection of the bid.

The following are minimum specifications required for STEEL RECYCLING RECEPTACLES to be delivered to the City of Seattle.

A.All Recycling receptacles shall be made of steel and should have under coat and baked enamel finish. Receptacles must have a rust inhibitor primer coat and the final finish must be of exterior industrial enamel.

B.Recycling receptacles must be heavy enough to withstand 25 mph winds when empty.

C.Surface for receptacle and lid must allow for easy removal of graffiti, dirt, grime and similar materials. Finish on lids should be durable enough that it can hold up to chemicals that may be used to remove graffiti and dirt.

D.Container must have a separate removable inner liner made of metal liner capable of handling loads of at least 60 pounds and be leak resistant. Liner must provide handholds to allow for easy removal from recycling receptacle.

E.Liner should have a capacity of at least 33 gallons when empty.

F.Lid for receptacle must be made of steel and may be affixed via plastic coated steel cable of at least ¼ inches, or by hinge or other device. Lid should be designed and operate in a manner that reduces chance for items to fall between liner and metal receptacle. The opening of the lid shall be round and no longer than 8 inches and shall be designed to for the deposit of both round (cans and bottles) and square (newspapers) into the litter receptacle.

G.Receptacle must have a minimum of four adjustable legs.

  1. The steel recycling receptacle must be blue (must match color of existing city recycling containers).
  2. The service height of the receptacle cannot exceed 64" (Service height is the total height of both the interior liner and the exterior receptacle when the liner is being lifted out of the exterior receptacle.)

J.SPU or its designee must be provided at least one (1) receptacle for field testing prior to accepting a full order of receptacles. The field test may last up to 10 days in duration and may be the basis for accepting or rejecting the propose receptacle.

  1. Steel containers should be equal to Victor Stanley T-32 series (36 gallon) litter receptacle or better. Equal means that container should have similar weight, rugged construction and have similar rust or damage guarantee.
  2. Containers shall have two (2) permanently affixed panels (12” x 18”) on opposite sides of the container. These shall be welded to opposite sides of the litter receptacle. The placards must be made of a durable metal.
  3. Containers shall comply with applicable ADA requirements.
