Special Use Permit to become code compliant for a current Kennel and Animal Sanctuary. (The keeping of more than 4 dogs or cats in any combination shall be considered a kennel).

Justification

Applicants are licensed with the CO. Dept of Agriculture (PACFA) as well as insured by Scottsdale Insurance for Animal Sanctuary and Rescue, dog boarding and breeding. We have been a nonprofit animal rescue since 1999 and are well known in the Black Forest community.

Existing Facilities

The main Dog kennel is 12’wx30’lx8h’ and located between to our hay barn/Ag building and horse barn/Ag building. The kennel has 9 indoor/outdoor runs. Inside area is 12’x30’ divided into 4x6 indoor kennels with dog doors to the outside 10x10 runs. The attached outside runsarea is 10’x30’ on the North and 10’x30’ on the South sides of the kennel. The runs are six feet tall with welded escape proof steel tops. There is a small training area attached to the West dog kennel run 30x30.

Potential future Dog Kennel or Ag building approximately 36x48. No new roads.

Tracy Hudock Berry and Judith Hudock are seeking a Special Use Permit to legalize an existing kennel and Animal Refuge (Black Forest Animal Sanctuary-BFAS) and which would allow for more than 4 personally owned dogs/cats and continued animal rescue and service dogs. We are licensed with the Colorado Dept. of Agriculture (PACFA) as an Animal Shelter. We own the Water Rights to our 35 acres and have a ‘land classification’ of Agricultural with the El Paso County Assessor’s office.

We have lived at this property for approximately 20 years and have been volunteers with local animal rescue and since Black Forest Animal Sanctuary became a 501c3 nonprofit in 1999. BFAS received accommodation from the El Paso County Commissioners in 2014 for outstanding service to our community. Tracy is a certified dog trainer thru the American Kennel Club (AKC) and is also a Canine Good Citizen (CGC) evaluator and service dog trainer. BFAS is a network of foster homes and the largest foster home is our property kennel.

We take in unwanted animals/dogs and retrain them to be family and service dogs for our community children, veterans, and special need individuals. We do NOT take in any stray dogs or any dogs that are not suitable as family pets or service animals. All visits to our property are by appointment only. We also occasionally have a litter of puppies that are adopted or sold for service dog purposes. At times, we may have these puppies in training past the 8-weekweening period and just past 4 months of age so we can work on puppy and initial obedience/service dog training. Our dogs live in the house with us, plus we have our kennel facility. Our entire 35-acre property is fenced and all dog areas have 6 foot fencing.We would like to offer short term dog boarding for dogs purchased or adopted from us as well as friendly dogs from our local community that are or will train as working dogs.

Our current main kennel has 10 indoor/9 outdoor runs which are all 6’ steel welded Priefert panels. The walls & ceiling have insulated waterproof and easy to sanitize panels with operational windows on the South and West. The kennel is temperature controlled, and is complete with doggy doors, and food and storage area. The outside runsare 10x10x6’ with pea gravel over hardware cloth. Feces is picked up daily and we follow all state regulations.

We also have a small quarantine kennel next to our home that is used for a mother and puppies. It is 8x8x8 with heat and an attached 10 x 30 dog run with top.

We are asking permission to have up 30 dogs on the premises at one time so that we can train the service dog puppies and continue to help our community in disasters with temporary housing. We plan on an average number of 12 dogs. Thank you for your consideration.
