(1)There is no reference in the Code to any form of Operator Protective Structures such as ROPS/FOPS/TOPS. We believe this to be a serious omission and hold the view that the Code should specify what forms of structures are mandatory for the various types of construction and mining machines.
(2)In Appendix C – Technical standards there is reference to a number of Australian Standards that have been withdrawn and replaced by ISO standards:
Earthmoving machinery AS2294 – withdrawn December 2008 and replaced by ISO 3471:2008,ISO3449:2005 and ISO3164:1995
AS2958 – withdrawn December 2008 and replaced by ISO3457:2003
There is also no mention of AS4772:2008 relating to Earthmoving machinery- Quickhitches for excavators and backhoe loaders. There is no mention of quickhitches in the wording of the Code.

Without reference to the type of protective structures required to be fitted to earthmoving machinery there is the potential for increased confusion bymanufacrurers, retailers and users of this equipment as to what level of protection is required..
Currently there are some State Regulations which refer to the type of protection required and these regulations need to be clarified in the new WHS legislation.
