SPECIAL CALLED MEETING

MAYOR AND COUNCIL

CITY OF DULUTH, GA

OCTOBER 26, 2015

PRESENT: Mayor Harris, Council members Dugan, Jones, Kelkenberg and Whitlock, City Manager, Department Directors, City Attorney

ABSENT: Councilmember Bomar

Mayor Harris called the meeting to order at 5:30 p.m.

I.  EXECUTIVE SESSION

It was necessary to hold an executive session on Real Estate, Pending/Potential Litigation, and/or Personnel.

A motion was made by Councilmember Whitlock, seconded by Councilmember Jones, to adjourn to executive session at 5:30 p.m.

Those voting for: Council members Dugan, Jones, Kelkenberg and Whitlock

Motion carried.

After the discussion, a motion was made by Councilmember Whitlock, seconded by Councilmember Dugan, to return to regular session at 5:30 p.m.

Those voting for: Council members Dugan, Jones, Kelkenberg and Whitlock

II.  NEW BUSINESS

1.  INTERGOVERNMENT AGREEMENTS – CITY OF DULUTH/DOWNTOWN DEVELOPMENT AUTHORITY

{A}

Staff and Council to discuss Intergovernmental Agreements (IGAs) with the Downtown Development Authority (DDA) for transfer of properties in the downtown Central Business District (CBD).

A motion was made by Councilmember Kelkenberg, seconded by Councilmember Dugan, to approve the Intergovernmental Agreement with the Duluth Downtown Development Authority as presented to convey the real property consisting of tax parcels 6-293-006, 6-293-020, 6-293-013, 6-293-237 and 6-293-375 less 0.33 acres, all of which are located in the Central Business District on Hill Street and Hardy Industrial Blvd., and which are more particularly described in Exhibits A, B and C to the Intergovernmental Agreement, for the amount of ten dollars and the specific conditions of development set forth therein.

Those voting for: Council members Dugan, Jones, Kelkenberg and Whitlock

Motion carried.

III.  ADJOURNMENT

A motion was made by Councilmember Kelkenberg, seconded by Councilmember Whitlock, to adjourn at 6:40 p.m.

WORK SESSION NOTES

MAYOR AND COUNCIL

I.  PUBLIC COMMENTS

Douglas Young and Nicole Rasmussen of FreezeCream USA thanked the Mayor and Council for allowing them to introduce their company and share their product.

II.  PRESENTATION ITEMS

1.  GEORGIA POWER LIGHT CONVERSION

Jessica Tolley and Jerry Cook from Georgia Power gave a presentation on their company's plan to replace the existing cobra head light fixtures throughout the City with new LED (light-emitting diode) fixtures. Although the City will not incur any expense for the fixture replacement, Georgia Power will adjust their rate to correspond with the new energy usage for the fixtures, thus keeping our current monthly bill the same. The new LED fixtures provide better light coverage and are anticipated to have long term maintenance benefits. Council was agreeable for staff to place a project authorization form on the next agenda.

2.  PARTNERSHIP GWINNETT REDEVELOPMENT TOUR/FORUM {B}

Will Corbin and Eva Kennedy came forward to present. On September 11, 2015, Partnership Gwinnett conducted a redevelopment tour of the City of Macon, Georgia. More than 40 people participated, including staff and elected officials from Gwinnett County, Gwinnett cities, Gwinnett CIDs, and local private partners. The purpose of the trip was to gain insight, ideas, and direction on redevelopment best practices that peer communities such as Macon have been able to execute.

On October 15, 2015, four staff members, Councilmember Kelkenberg, and Councilmember Bomar attended the Partnership Gwinnett Annual Redevelopment Forum. The purpose was to present redevelopment issues and topics within Gwinnett County.

3.  STORMWATER UTILITY PROGRAM UPDATE {C}

City Engineer Margie Pozin gave a presentation on the status of the City’s Stormwater program including highlights of recently completed projects. Councilmember Jones also asked for a description on the budget and the prioritization of projects to ensure that analysis includes future cost projections, etc. Staff recommended that a study be completed next year (at the five year mark) for accurate analysis and recommendation for funding.

4.  TRANSPORTATION PROGRAM UPDATE {D}

Community Development Director Nick Colonna came forward to present an update on the status of the City’s transportation projects.

5.  MAIN STREET PHASE II UPDATE {E}

City Engineer Margie Pozin explained that Main Street Phase II was originally proposed in the gulch and along Main Street on the Norfolk Southern Railroad side of the road. Norfolk Southern (NS) did not approve the design the concept was adjusted to add 32 angled parking spaces on the school side of the road. The school and NS approved the concept, and the school agreed to donate the right-of-way (ROW). Tunnell Spangler Walsh (TSW) is working on 30% plans and should have them ready this week. Staff will forward them to the school and NS for continued review. Staff is also working with the school to see whether our small stormwater detention area can be located on their property and whether they would want to use it in their science curriculum. The small detention area would be a bioswale which is a teaching opportunity for the school. Staff is also coordinating their drainage into our system, so we are working together to make a seamless design. Once 30% plans are approved, TSW will develop a ROW exhibit so the Gwinnett County School Board can officially donate the ROW. Staff is also looking into the potential to have wider sidewalks along that side of the road as a continuation of the potential future path along Chattahoochee Drive/Main Street. A concept sketch of the area is attached.

6.  NEIGHBORHOOD STABILIZATION –REGENCY PARK

In May of this year, staff met with homeowners and residents of the Regency Park subdivision to discuss a neighborhood stabilization strategy. Community Development Director Nick Colonna discussed this effort and upcoming engagement activities.
