GRADUATEAND PROFESSIONALSTUDENTSOF ARIZONASTATEUNIVERSITY

MEMBERSHIPAND ESTABLISHMENT
Preamble
We,thegraduateandprofessionalstudentsof ArizonaStateUniversity,inordertoprovidea representativestudentgovernment,herebyformtheGraduateandProfessionalStudents Association(“GPSA”),andestablishthisConstitution.GPSA existstorepresentandadvocate
for graduateandprofessionalstudentintereststostudentgovernments,universityadministration, communityorganizations,andlocal,state,andnationalgoverningbodies;supportprogramsand servicesbenefittingthegraduateandprofessionalstudentbody anduniversity;andunifythe studentbody throughcollaborationwithinternalandexternalstudentdirectedorganizations. GPSA ismandatedtoprovideaunifiedforumfor inter-universitydialogue,toorganizestudent involvement,andtoadministerservices,resources,andprogramsthatbenefitthegreater
graduateandprofessionalstudentpopulation.
WerecognizetheArizonaStateUniversityGraduateandProfessionalStudentsAssociation (GPSA) astheofficialstudentgovernmentandgoverningbody of ASU graduateand professionalstudents.
Furthermore,weaffirmthatTheUndergraduateStudentGovernment("USG") andGPSA
togetherconstitutetheAssociatedStudentsof ArizonaStateUniversity,or ASASU.
Article1 - Establishment
TheGraduateandProfessionalStudentAssociationof ArizonaStateUniversityishereby establishedunderthisConstitution.
Article2 – Membership
Allregistered,post-baccalaureatestudentswithgraduate,professional,or non-degreeseeking status,who areenrolledinatleastone(1) credithour throughanycampusof ArizonaState University,andonlysuchpersons,aremembersof theGPSA. Allmembersareentitledtovote, toholdofficeintheGPSA, ifqualificationsfor candidacyaremet,andtoexercisethevarious rightsof membership.
Article3 - Rightsof Membership
Allstudentswho meettheabovedefinitionof membershipshallbeguaranteedthefollowing rights,whichshallbefurtherdelineatedwithintheBylaws:
A.TherighttopetitionGPSA toaddressissuesof concern
B.Therighttorepresentationandadvocacy
C.Therighttoactiveengagement
D.TherighttoopenGPSA meetings,documents,andprocedures
TITLEII
GRADUATEAND PROFESSIONALSTUDENTASSOCIATION Article1 - ExecutiveBranch
Section1.ExecutiveCommitteeof theGPSA
A.TheExecutiveOfficersof theGPSA shallbeaPresident,VicePresidentof ExternalAffairs,VicePresidentof InternalAffairs,andaVicePresidentof Professional Development.TheExecutiveOfficersshallexercisetheexecutivefunctionsof theGPSA. Dutiesof saidOfficersshallbesetforthinthisConstitutionandintheBylaws.
B.ThePresidentandVicePresidentsshallbeelectedby thegeneralmembershipas definedinTitleI, Article2.
C.ThePresident-electof GPSA andthePresident-electof theAssemblyshallnotbe of thesameGraduateor ProfessionalProgramatthetimeof election.
D.Themembersof theExecutiveCommitteeshallconsistof theExecutiveOfficers of theGPSA asvotingmembers.Also,theAssemblyPresident,AssemblyPresidentpro tempore andallhireddirectorsserveasnon- votingex-officiomembers.
Section2.Termof Office
TheExecutiveOfficersshalltakeofficebeginningatnoon on theMondayfollowingthe
Maygraduationceremonyandshallservefor oneyear.
Section3.Succession
A.In theeventthePresidentresignsor isremovedfromofficethePresidentshallbe succeededby the(1) VicePresidentof InternalAffairs,(2) thePresidentof theGraduate Assembly,(3) theVicePresidentof ExternalAffairs,and(4) theVicePresidentof Professional Development.An Officermaydeclinetoassumethedutiesof thePresidencyandcontinueinher/ hiselectedposition.Any successiontotheOfficeof thePresidentshallberatifiedby avoteof 2/3 of themembersof theAssemblywithinthirty(30) days.If ratificationfails,theAssemblywill votetoelectaPresidentfromamongthesittingGPSA VicePresidentsor AssemblyPresident andratifyby amajorityvote.
B.If theofficeof aVicePresidentbecomesvacant,theGPSA Presidentshallcall for andconsiderapplications,andmustappointtotheofficeamemberof theGPSA who is eligiblefor theposition,theVP willassumeofficeimmediatelyupon atwo-thirds(2/3)voteof presentandvotingAssemblyMembers.
C.In theeventallpositionsbecomevacant,theAssemblyshallappointinterim officersuntilaspecialelectioncanbeheld.
D.In theeventthatthePresidencyisvacantbecauseno ExecutiveOfficeriswilling tosucceedtotheoffice,theAssemblyshallappointaninterimPresidentuntilaspecialelection canbeheld.
Section4.Responsibilitiesof theExecutiveBranch
TheExecutiveBranchshallexerciseallresponsibilitiesof theirofficeaslaidoutinthis ConstitutionandalldutiesdefinedintheBylaws,includingbutnotlimitedtoservingasthe GraduateandProfessionalstudentvoice,administeringprogramsandinformingtheGPSA Assemblyaboutallactivities,disbursingfunds of theGPSA accordingtoapplicableGPSA andUniversitypolicies,andcreatingcommittees,inaccordancewithAssemblydirectionand consultation.TheExecutiveBranchshallpromotecommunicationandcollaborationbetween graduateandprofessionalstudentson allArizonaStateUniversitycampuses.
Section5.ScopeandPurpose
TheAssemblymayenactBylawsthatestablishanddefinethepurpose,scopeandpowersof any
ExecutiveOfficeconsistentwiththisConstitution.
Section6.Recallof Officers
A.Petition- A petitionfor recallof anyExecutiveOfficershallrequirethe signaturesandstudentidentificationnumbersof atleasttenpercent(10%) of thecurrent membershipof theGPSA. TheRegistrarmustcertifythenames,graduatestatus,andstudent identificationnumbersof thesepetitioners.
B.RecallElections– Itshallbethedutyof theElectionsDepartmenttoholda specialelectionupon noticeby theAssemblyPresidentthatacertifiedpetitionfor recallhas beenreceived.
C.Recall– A recallelectionisvalidonlyifthenumberof totalvotescastinthat electionisequaltoatleastthree-fourths(3/4)of thenumberof votescastatthegeneralelection for theofficeinquestion.If therecallmeasurereceivesamajorityvote,theOfficershallbe officiallyrecalled.ThevacancythuscreatedshallbefilledimmediatelyasprovidedinSection3 of thisArticle.
Section7.Impeachmentof Officers
TheImpeachmentandremovalof anExecutiveOfficermaybeinitiatedby awrittenpresentation of chargessignedby 25% of allseatedAssemblyMembersandapprovedby atwo-thirds(2/3) voteof allseatedAssemblyMembers.
Article2 - TheLegislativeBranch- TheAssembly
Section1.PowersandDuties
A.Thelegislativeandfiscalpowerof theGPSA shallbevestedintheAssembly subjecttoavetoby theGPSA Presidentwithinseven(7) days,whichmaybeoverriddenby a two-thirds(2/3)voteof presentandvotingAssemblyMembers.
B.Additionally,thepowersanddutiesof theAssemblyincludetheauthority:
1. ToapproveandrevisetheGPSA budgetby majorityvoteof allseatedAssembly Memberssubjecttoalineitemvetoby theGPSA President,whichmaybeoverriddenby atwo-thirds(2/3)voteof presentandvotingAssemblyMembers.
2. ToadoptandreviseGPSA BylawsandotherAssemblyRulesby atwo-thirds(2/3)
voteof presentandvotingAssemblyMembers.
3. Toassumewhateveradditionalresponsibilitiesitdeemsnecessarytofulfillits obligationtostudentsundertheBylawsof theGPSA.
4. Toprovideacommunicationnetworkbetweenthestudentsof eachgraduateand professionalprogram,theExecutiveOfficers,andtheadministrationof theUniversity.
5. Toencourageparticipationanddiscussionby thestudentsintheindividualgraduate andprofessionalprograms.
6. Toundertakesuchbusinessasitdeemsnecessarytofulfillthepurposesof theGPSA.
7. Toreviewtheactionsof theExecutiveCommittee.
Section2.GraduateAssemblyMembers
A.Thevotingmembershipof theAssemblyshallconsistof aproportionalnumberof AssemblyMembersfromeachdisciplineof graduateor professionalprogramasfurtherdefined undertheBylawsof theGPSA.
B.AssemblyMembersshallbeelectedby GPSA membersintheirrespective programsandserveatermof oneyear.Theseelectionsshallmeettherequirementsassetforth intheGPSA Bylaws.
C.No AssemblyMembershallsimultaneouslyholdanExecutiveOffice.
D.An AssemblyMembermayberemovedfromtheAssemblyby amajorityvoteof thestudentswhomheor sherepresentsor by awrittenpresentationof chargessignedby 25% of allseatedAssemblyMembersandapprovedby atwo-thirds(2/3)voteof allseatedAssembly Members.
E.Thenon-votingmembersof theAssemblyshallconsistof arepresentativefrom: theDivisionof GraduateStudies,theAdministrativeOfficeinwhichASASU ishoused,the AcademicSenate,andtheUndergraduateStudentGovernment.
F.FormerExecutiveOfficersandcommitteechairsmaybegrantedexofficiostatus inaccordancewiththeBylaws.
G.If anAssemblyseatisvacantaftertheannualelections,or becomesvacantduring thelegislativeyear,theAssemblyPresidentwillpubliclycallfor andacceptnominationsfor a periodno lessthanonecalendarweek.TheAssemblyOperationsCommitteewillthenreviewtheapplicantsandpresentanomineefor eachseatatthefollowingAssemblymeeting,who must thenbeconfirmedby atwo-thirds(2/3)voteof presentandvotingAssemblyMembers.Graduate programswithestablishedgovernancestructuresmaysubmitanomination,howeverthe Assembly OperationsCommitteeisnotbound toacceptonlysuchnominations.
Section3.Meetings
A.TheAssemblyshallconveneatleastoncepermonthduringtheacademicyearat apubliclyannouncedtimeandplace.
B.Specialsessionsmaybecalledby theGPSA President,AssemblyPresident,or by two-thirds(2/3)voteof presentandvotingAssemblyMembers.
Section4.PresidingOfficer
A.ThePresidentof theAssemblyshallbeelectedfromtheAssemblymembershipat thefirstmeetingof eachLegislativeSessionandserveasPresidentfor thatLegislativeSession, subjecttothefollowinglimitations:
1. No AssemblyMembershallbeelectedPresidentof theAssemblywithoutreceivinga majorityof votesfromtheAssemblyMemberspresentandvoting.
2. Onlythosewho havebeenelectedor appointedtoserveasAssemblyMembersfor the upcomingacademicyearmayvoteinthiselection.AllAssemblyMemberswho have servedatleastonefullacademicsemesterasanAssemblyMemberareeligiblefor electiontoAssemblyPresident.
3. In theeventthatno qualifiedAssemblyMembersarenominatedor self-nominatedfor thepositionof AssemblyPresident,Item2 aboveshallbewaived.
4. ThenewlyelectedAssemblyPresidentwillbeginhisor hertermof officeatnoon on theMondayfollowingtheMaygraduationceremony.TheoutgoingAssemblyPresident shallcontinuetopresideuntilthistime.
5. Theimpeachmentandremovalof theAssemblyPresidentfromhisor herofficemay beinitiatedby awrittenpresentationof chargessignedby 25% of allseatedAssembly Membersandapprovedby atwo-thirds(2/3)voteof allseatedAssemblyMembers.
B.ThePresidentof theAssemblyshallpresideoverAssemblymeetings.The Presidentof theAssemblyshallselectaPresidentpro temporetopresideintheabsenceof the Presidentof theAssembly.
C.Any vacancyintheOfficeof Presidentof theAssemblyshallbefilledaccording toSubsectionA of thisSection.
Section5.Procedure
A.For purposesof thisTitle,invoteoutcomesdescribedintermsof “presentand voting”AssemblyMembers,absencesandabstentionsarenottobecountedasvotingAssembly Membersincalculatingmajority.For voteoutcomesdescribedintermsof “seated”Assembly Members,allcurrentlyappointedandelectedAssemblyMembersareusedtocalculatemajority. TheBylawsmayindependentlydefinecalculationrulesfor votestherein.
B.TheAssemblyshallhavethepowertodetermineitsrulesandprocedures,to establishcommitteesandtodisciplineitsmembers.
C.ThePresidentof theAssemblywillconsultwiththeParliamentarianasnecessary andappropriateon parliamentaryquestions.
D.WhenRobert'sRulesof OrderandtheBylawsconflict,theBylawstake precedence.
E.Robert'sRulesof Order,latestedition,willbetheparliamentaryresourceof the
Assemblyanditssubsidiarybodies.
Article3 - Bylaws
Bylawsshallbeestablishedtoincludetherulesof theAssemblyandthedutiesof the
GPSA ExecutiveOfficers,AssemblyMembers,Boards,andCommittees.
Article4 - AcademicStanding
ExecutiveOfficersor AssemblyMembersmayserveonlyifregisteredfor atleastone(1) semesterhour of graduateor professionalacademiccreditatArizonaStateUniversityinthe currentregularsemesterandinacademicgood standingasdefinedby theUniversityfor that student’sprogramof study.
TITLEIV JUDICIARY
Article1 – SupremeCourtJudiciaryStructure
Section1. JudicialPowers
Thejudicialpowersof theGPSA shallbevestedintheGPSA SupremeCourt(hereafterreferred toas“SupremeCourt”)andanylowercourtsestablishedby theGPSA.
Section2. Jurisdiction
A.TheSupremeCourtandanylowercourtsshallhavejurisdictionoveralldisputes arisingunderthisConstitutionor anyBylawsestablishedpursuanttothisConstitution.In addition,theyshallhaveanyotherjurisdictiontheGPSA AssemblymayprovideintheBylaws.
B.Thedecisionof theSupremeCourton anydisputesarisingundertheASASU Constitutionshallbefinal,exceptinthecaseof impeachmentof aSupremeCourtJustice.
C.TheSupremeCourtshallretainoriginaljurisdictionoverdisputesarisingbetween
GPSA, andanyotherorganizationsor departmentscreatedby GPSA.
D.TheSupremeCourtshallretainalljurisdictionnotdelineatedby theGPSA toany lowercourtandappellatejurisdictionoveralldisputes.
Section3. Composition
- TheSupremeCourtshallconsistof fiveJustices
B.Selectionof Justices
1. FollowingGPSA elections,thesittingPresidentof GPSA shallnominatetwoSupreme
CourtJustices.ThesittingPresidentof theAssemblyshallnominatetwoSupreme
CourtJustices.A majorityof theGovernmentOperationscommitteeshallnominate
oneSupremeCourtJustice.Applicationprocessinganddeadlinesshallbedefinedinthe bylaws.
2. GPSA nominationsshallbeconfirmedby atwo-thirdsvoteof thesittingGPSA Assemblyandshallnotbesubjecttothevetoof theGPSA President.Confirmationshall occurno laterthanthefinallegislativesessionsof sittingAssembly.
3. If anysittingmemberof theAssemblyisnominatedfor aSupremeCourtJustice position,theyshallnotbepermittedtovotefor theirown Justiceconfirmation
C.TheGovernmentOperationsCommitteeshallappointaSupremeCourtClerkto performalladministrativedutiesoutlinedinArticle2, Section3 of thisTitle.
1. TheGovernmentOperationsCommitteewillacceptapplicationsfor thepositionof SupremeCourtClerkfromqualifiedcandidatesfromtheuniversityfaculty,staffand students.
2. A finalappointmentwillbemadeby atwo-thirdsvoteof theGovernmentOperations Committee.TheClerkshallbeginservinghisor hertermatnoon on theMonday followingtheMaycommencementceremonyandshallservefor oneyear.
Section4. Term
TheJustices’termsbeginatnoon on MondayfollowingtheMayCommencementCeremonyand shallcontinueuntilnoon of theMondayfollowingtheMayCommencementCeremonyof the followingyear.
Section5. Impeachment
Any SupremeCourtJusticemaybeimpeachedfor malfeasanceby atwo-thirdsvoteof the
GPSA Assembly.
Section6. Removal
Followingcompletionof impeachmentprocedures,anySupremeCourtJusticemayberemoved by athree-fourthsvoteof theGPSA Assembly.
Section7. Replacement
In theeventof avacancyon theSupremeCourt,areplacementshallbenominatedby theofficer fromwhichtheprecedingjusticewasnominatedfor confirmationby theAssemblyby atwo- thirdsvotenotsubjecttothevetoof theGPSA President.Applicationprocessinganddeadlines shallbedefinedby theBylaws.
Section8. RighttoBringaCase
A casemaybebroughtbeforetheSupremeCourtby anymemberof theGPSA. Section9. Decisions
Decisionsandopinionsshallbewritten,posted,andplacedinapermanentfileof theGPSA and remainpubliclyavailablefor allGPSA studentsasadministeredby theSupremeCourtClerk.
Section10. AcademicStanding
OnlyGPSA membersingood academicstanding,asdefinedby theUniversity,shallserveon the
SupremeCourt.
Article2 – SupremeCourtRulesandProcedures
Section1. JudicialCode
A.Upon appointment,theSupremeCourtJusticesshalladoptaJudicialCodeto governtheinternalrulesandproceduresof thejudiciary.ThisCodeshallberecordedandmade publiclyavailableby theSupremeCourtClerk.
B.Deadlinesfor courtfilingandpublicfilingof courtcasesshallbeestablishedby theJudicialCode.
- TheJudicialCodeshallbereviewedandapprovedby amajorityvoteof the
GovernmentOperationsCommitteeno laterthanthethirdregularmeetingof theFallsemester.
Section2. Quorum
- Quorumfor theSupremeCourtshallbedefinedasfour sittingjustices.
- Quorumshallberequiredtohearcasesandtoissuedecisions.
Section3 . Dutiesof theCourtClerk
A.TheCourtClerkshallorganizeandmaintaincourtfilesfor thecourts.
B.TheCourtClerkisalsoresponsiblefor gettingevidenceandcourtpaperstoeach memberof thejudiciaryfor eachcasebroughtbeforethecourtsasappropriate.
C.TheCourtClerkshallmakepleadingsandcourtdecisionspubliclyavailable.
D.TheCourtClerkmayberemovedfollowingtherequestof theSupremeCourt,
subjecttotheapprovalof theGovernmentOperationsCommittee.
TITLEV ELECTIONS
Article1 – ElectionsDepartment
TheElectionsDepartmentshallexerciseindependentauthorityoverGPSA elections,referenda, andinitiatives.
A.Selectionof ElectionsDirector:
1. NotwithstandinganagreementpursuanttoTitleVI of thisConstitution,the GovernmentOperationsCommitteeshalladministertheselectionprocessfor the ElectionsDirector.
2. NotwithstandinganagreementpursuanttoTitleVI of thisConstitution,thenomination shallbeconfirmedby atwo-thirdsvoteof theGovernmentOperationsCommittee.Upon confirmation,theindividualshallassumethepositionof ElectionsDirector.
B.Termof ElectionsDepartment:
1.TheElectionsDirectorshallbeconfirmedby theGovernmentOperations Committeeby October1 andshallserveuntilanewElectionsDirectorisconfirmed pursuanttothisdocument.
2.TheAssistantElectionsDirectorshallbeconfirmedby theGovernment OperationsCommitteefollowinghis/herselectionby theElectionsDirector.The AssistantElectionsDirectorshallserveuntilthenewElectionsDirectorisconfirmedby GovernmentOperationsCommittee.
C.Dutiesof theElectionsDepartment:
1.TheElectionsDirectorshallhavetheauthoritytohireanAssistantDirectoror Directors,subjecttoconfirmationby two-thirdsof theGovernmentOperations Committee.
2.TheElectionsDirectorshallinterpretandenforcetheelectionandpetition provisionsdevelopedandcodifiedby GPSA intheBylawsthisConstitution.
3.TheElectionsDepartmentshallevaluatethemechanismsby whichstudentsmay voteannually,andshallinvestigatetheefficacyandpotentialusefulnessof newvoting technologies.
4.TheElectionsDepartmentshalladvertiseandpromotethecandidacyandelection process.
5.TheElectionsDepartmentshallhavethesoleauthoritytoadministertheGPSA
electionsandreferenda.
6.TheElectionsDepartmentshallbebound by thedutiesdefinedinthis Constitutionandby anypoliciesor proceduresadoptedby GovernmentOperations CommitteepursuanttothisConstitution.
7.Followingtheendof theelectionprocess,theElectionsDirectorshallpresentan officialreporttotheGovernmentOperationsCommitteedetailingthesuccessesand failuresof theDepartment,anyissuesthatarosewiththeelection,votingmethodsand anyotherissuestheElectionsDirectordeemspertinent.
D.Removalof ElectionsDirector:
1.TheElectionsDirectormayberemovedfromthepositionfor willfulneglectof duty,gross incompetence,gross negligenceor for anyfraudulentactions.
2.AllegationsagainsttheElectionsDirectorshallbefiledwiththeSupremeCourt.
3.In theeventtheSupremeCourtfindssufficientcauseexists,itmayremovethe
ElectionsDirector.
4.In theeventtheElectionsDirectorresignsor isremovedfromoffice,theAssistant ElectionsDirectorwillautomaticallyadvancetothepositionof ElectionsDirectorand maythenappointanewAssistantElectionsDirectorwho shallbesubjecttoconfirmation by theGovernmentOperationsCommittee.
5.In theeventboththeElectionsDirectorandAssistantElectionsDirector(s)resign or areremovedfromoffice,anewElectionsDirectorshallbeappointedinthemanner prescribed.
Article2 – ElectionsProcedures
A.ElectionsshallbeheldintheSpringsemesterfor allexecutiveandlegislativeoffices establishedunderthisConstitution.
B.Electionsshallbeby secretballot.
C.TheGPSA AssemblymayenactBylawsfurtherdefiningtheelectionprocessand providingfor violationsanddisputes.
GENERALPROVISIONS
Article1 - SupremacyClause
ThisConstitutionsupersedesallotherGPSA Constitutions,legislativeandexecutivedocuments, includingbutnotlimitedtoBylawsandCollegeCouncilConstitutions.
Article2 – Amendment
Proposalstoamendthisconstitutionshalloriginateby avoteof two-thirds(2/3)of present
andvotingAssemblyMembers.Theproposalshallbescheduledfor avoteinthenextgeneral electionor inareferendavoteof theGPSA membership.Detailednoticeof theproposed amendmentshallbemadepublicduringatleasttheweekpriortothegeneralelection.If this proposalreceivesamajorityof thevotescastby theGPSA membersinthiselection,this constitutionshallbedeclaredamended.
Article3– Enactment
Section1.Effectof Enactment
ThisConstitutionshallhavefullforceandeffectfollowingpassageby amajorityvoteof the ASASU ConstitutionalConvention,by atwo-thirdsvoteof theUSG andtheGPSA legislative bodies,andby amajorityof undergraduateandgraduatestudentsvotinginacampus-wide election.ThisConstitutionshallsupersedeandreplaceallpreviousASASU Constitutionsand Bylaws.
Section2.InitialElections
NotwithstandingSection3 of thisarticle,theElectionsDepartment,establishedunderthe outgoingASASU ConstitutionandBylaws,shallconductacampus-wideelectionfor the
ExecutiveandLegislativeofficesestablishedunderthisConstitutionno laterthanApril1stof
theelectionsyearfollowingtheenactmentof thisConstitution.
Section3.DelayedEffectiveDate
Thisdocumentwillbecomeeffectiveupon ratificationof fiftypercentplusoneof theUSG, and fiftypercentplusoneof theGPSA, atnoon on theMondayfollowingMaycommencement.
Article4—AdministrativeAgreementClause
In signingthisdocumentthePresidentof theArizonaStateUniversityrecognizesthe sovereigntyof theGPSA astherepresentativebody for allgraduateandprofessionalstudents atArizonaStateUniversity.TheUniversityPresidentfurtherrecognizesthisdocumentasthe supremegoverningdocumentthereof.
JointGovernmentalAgreements
Article1 – JointGovernmentalAgreements
Any formalagreementbetweentheUndergraduateStudentGovernmentof anyASU campusand theGraduateandProfessionalStudentAssociationshallbebindingtotheoperationsof the GraduateandProfessionalStudentAssociationaswouldthebylawsiftheagreementisratified by amajorityof theGraduateandProfessionalStudentAssociationAssemblyandtherespective UndergraduateStudentGovernmentlegislativebody, isbindingon thatUndergraduateStudent Government,andisnotinviolationof thisconstitution.
Article2 – TheAssociatedStudentsof ArizonaStateUniversity
