1st Payment:

  1. The landlord lets and the tenant takes the property for the term at the rent payable above.
  2. Where the context admits-

a)’The landlord’ includes the persons for the time being entitled in reversion expected on the tenancy

b)’The tenant’ includes the persons deriving title under the tenant

c)References to the property include references to any part or parts of the property and to the fixtures furniture and effects or any of them

  1. The tenant will-

a)Pay the rent at the times and in the manner specified.

b)Pay for all gas and electric light and power, telephone services, water and television licence, which shall be consumed or supplied on or to the property.

c)Not to damage or injure the property or make any alteration in or addition to it without the agreement of the landlord.

d)Preserve the fixtures and furniture and effects from being damaged and not remove any of them from the property without the agreement of the landlord.

e)Yeild up the property at the end of the tenancy in the same clean state and condition as it was in the beginning of the tenancy and make good pay for the repair or replacement of all such items damaged (reasonable wear and fire damage excepted).

f)Permit the landlord or the landlord’s agent at reasonable hours to enter the property.

g)Not to sublet the the property.

h)Not do or suffer to be done on the property anything which may be or become a nuisance to landlord, other tenants or neighbours, or which might vitiate any insurance of the property or increase the ordinary premium of such insurance.

i)Not to keep animals without the agreement of the landlord.

j)Not to injure any trees shrubs or plants about the property.

k)Remain a member of the Housing Co-operative, and to fulfill such reasonable duties as may be agreed by the co-operative to be a condition of such membership.

l)Not use any language or behaviour that might reasonably be expected to harm, exclude, restrict or offend any tenant or member of the public due to their race, religion, sexuality, ethnicity, disability, sexuality or deeply held beliefs.

m)Refrain from any criminal act of violence.

  1. Provided as follows:- The landlord shall not be liable or responsible for any injury or damage suffered by the Tenant or any occupier of the premises or any other person therein by reason of any defect on the premises or through the neglect, default or misconduct of any agent emoployed by the landlord.
  2. Provided that if the rent or any part thereof shall be in arrears for at least fourteen days after the same shall have been due (whether legally demanded or not) or if there shall be a breach of any of the agreements by the tenant the matter shall be referred to the general meeting of the co-op to consider appropriate action. If a written warning issuing from such a meeting is not complied with within ten days, the tenant may be evicted.
  3. The landlord agrees with the tenant as follows:-

a)To pay and indemnify the tenant against all assessments and outgoings in respect of the property (except as noted above).

b)That the tenant paying the rent and performing the agreements on the part of the tenant may quietly posess and enjoy the property during the tenancy without any unlawful interruption from the landlord or any person claiming under or in trust for the landlord.

c)To return to the tenant any rent payable for any period while the property is rendered uninhabitable by fire the amount in case of dispute to be settled by arbitration.

  1. This agreement may be ended by either party with one months notice in writing.
