ORDINANCE NO. 260

AN ORDINANCE OF THE CITY OF FAIRFIELD, CAMAS COUNTY, IDAHO, AMENDING SUBDIVISION ORDINANCE #165 ARTICLE 4 DESIGN STANDARDS:

SECTION 1-Amend language to reference Title and Chapter;

SECTION 2 -Amend language to reference street dedications and include alleys;

SECTION 3-Amend language to reference street location and clarify definitions for street continuation and extension, frontage roads, cul-de-sac. Add language to include alleys in industrial subdivisions ;

SECTION 4 -Amend language to reference street specification and add language that such streets are to be platted and developed;

SECTION 5-Add language to clarify street names are to not duplicate a street name in Camas County;

SECTION 8- Add easement language to include setback from stream bank/waterway and snow storage when deemed necessary from the commission/council;

SECTION 10 -Amend language to clarify lots are to conform to the zoning district, add language for lot lines and width related to length;

SECTION 13-Delete large scale development language to be included in Article 5 Special Development Subdivisions. Amend required public improvement standards by combining existing language in the streets, water supply system and sanitary system sections to clarify each standard. Adding criteria for bridges, drainage improvements, and building numbers. Amend Guarantee of Completion section to add performance bond requirements of one hundred fifty percent of estimated cost of improvements. Amend Evidence of Completion section to be required prior final plat approval. Add off-site improvement language to ensure that such improvements are installed when necessary to provide required improvements or adequate infrastructure to proposed subdivision;

WHILE PROVIDING A SEVERABILITY CLAUSE AND EFFECTIVE DATE.

WHEREAS, the City of Fairfield, Camas County, Idaho, is a municipal corporation formed pursuant to the laws of the State of Idaho; and

WHEREAS, following public workshop on February 10, 2015, and public hearings held by the Fairfield Planning and Zoning Commission on ______, the Planning and Zoning Commission made recommendation to the City Council on ______to approve/deny amending Subdivision Ordinance #165 Article 4 Design Standards; and

WHEREAS, after holding public workshops, public hearings, and providing legal notice, all according to law, the City Council of the City of Fairfield, Camas County, Idaho, voted to approve/deny such amendments on______, 2015 ; and

WHEREAS, Section 67-6509, Idaho Code, provides that the city may amend the subdivision ordinance; and

WHEREAS, the City of Fairfield Subdivision Title was last updated in 1992. Amendments include language to clarify street and alley standards. Other amendments include adding standards for bridges and drainage improvements that may be necessary to protect existing or new infrastructure and adding performance bond language to ensure new infrastructure is paid for at the cost of applicant; and

WHEREAS, standards have been outlined for new subdivisions that are traversed by a watercourse, drainage way, channel or stream. When deemed necessary the commission/council may require additional setbacks to protect natural vegetation, riverbank erosion, and structures from damage or loss; and

WHEREAS, standards have been outlined for new subdivisions to provided adequate snow storage and drainage area. When deemed necessary the commission/council may require a specific site location for snow storage to protect existing and/or new infrastructure from melt water.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF FAIRFIELD, CAMAS COUNTY IDAHO:

SECTION 1. That the City of Fairfield Subdivision Ordinance Number #165, Article 4 Design Standards are to be amended with the following additions indicated as double underlined and deletions crossed out:

4.1 MINIMUM DESIGN STANDARDS REQUIRED

All plats submitted pursuant to the provisions of this Ordinance Title, and all subdivisions, improvements and facilities done, constructed or made in accordance with said provisions shall comply with the minimum design standards set forth hereinafter in this Article Chapter; provided, however, that any higher standards adopted by the any Highway District, State Highway Department or Health Agency shall prevail over those set forth herein.

4-2: STREET DEDICATION

Arterial and collector streets shall be dedicated to the public in all cases; in general, all other streets including alleys within any subdivision shall also be dedicated to public use.

4-3: STREET LOCATION

Street and road location shall conform to the following:

A. Street Location and Arrangements:

When a major street plan or comprehensive development plan has been adopted, subdivision streets shall conform to such plan;.

B. Minor Streets:

Minor Streets S shall be so arranged as to discourage their use by through traffic;.

C. Stub Streets:

Where adjoining areas are not subdivided, the arrangement of streets in new subdivisions shall be such that said streets extend to the boundary line of the tract to make provisions for the future extension of said streets into adjacent areas. A reserve strip may be required and held in public ownership;.

D. Street Continuation and Extension:

The arrangement of streets in new subdivisions shall be such that said streets form adjoining areas into new provide access to adjoining lands and provide proper traffic circulation through existing or future subdivisions unless otherwise approved by the Council or department having jurisdiction over such streets;.

E. Relation to Topography:

Streets shall be arranged in proper relation to topography so as to result in usable lots, safe streets and acceptable gradients;.

F. Alleys:

Alleys shall be provided in multiple dwelling, or commercial and industrial subdivisions unless other provisions are made for service access and off-street loading and parking. Dead-end alleys shall be prohibited in all cases;.

G. Frontage Roads:

Where a subdivision abuts or contains an arterial street, the council may require a frontage street, planting strip, or similar design features it shall be required that there be frontage roads approximately parallel to and on each side of sub-arterial streets; and that there be such other treatment as is necessary for the adequate protection of residential properties and to separate through traffic from local traffic;.

H. Cul-de-Sac Streets:

Cul-de-sac streets shall not be more than five hundred (500) feet in length and shall terminate with an adequate turnaround having a minimum radius of seventy-five (75) eight (80) feet for right-of-way;. have a maximum length of no greater than five hundred (500) feet from entrance to center of turnaround and a minimum turnaround radius of eighty (80) feet at the curb line or whichever is less, unless public access to public lands or access to adjacent private land is determined appropriate by the Council;.

I. Half Streets:

Half streets shall be prohibited except where unusual circumstances make such necessary to the reasonable development of a tract in conformance with this Ordinance Title and where satisfactory assurance for dedication of the remaining part of the street is provided. Whenever a tract to be subdivided borders on an existing half or partial street, the other part of the street shall be dedicated within such tract; and.

J. Private Streets:

Private streets and roads shall be prohibited except within planned unit developments.

4-4: STREET SPECIFICATIONS

All streets in the subdivision must be platted and developed with a width, alignment, and improvements such that the street is adequate to accommodate existing and anticipated vehicular and pedestrian traffic and meets city standards for the appropriate functional classification. Streets shall be aligned in such a manner as to provide through and efficient access from and to adjacent developments and properties and shall provide for the integration of the proposed streets with the existing pattern.

A: Streets Right-of-Way Widths:

Street and road right-of-way widths shall conform to the adopted major street plan or comprehensive development plan and the rules of the State Department of Highways Idaho Transportation Department, and the Highway District or Department other government entity having jurisdiction. Minimum right-of-way standards are as follows with those marked with * to also include an additional ten (10) feet easement each side of roadway for snow removal:

HIGHWAY AND STREET TYPES WIDTH

Expressway or Freeway 160-260 feet

Major Arterial 120 feet

Minor Arterial 70 + 10 feet *

Collector Street 60 + 10 feet *

Minor Street 50 + 10 feet *

B. Street Grades:

Street grades shall not exceed ten percent (10%) on either minor or collector streets, and six percent (6%) for arterial streets. No street grade shall be less than three tenths (.3) per hundred feet.

C. Street Alignment: Shall be as follows:

1. Horizontal Alignment:

When street lines deflect from each other by more than ten (10) degrees in alignment, the center lines shall be connected by a curve having a minimum radius of five hundred (500) feet for arterial streets, three hundred (300) feet for collector streets and one hundred fifty (150) feet for minor streets. Between reverse curves on minor streets there shall be a minimum tangent distance of one hundred (100) feet and two hundred (200) feet on collector and arterial streets; and.

2. Vertical Alignment:

Minimum sight distances shall be two hundred (200) feet for minor streets and three hundred (300) feet for collector and arterial streets or designed in accord to speed limit.

4-5: STREET NAMES

The naming of streets shall conform to the following:

A. Street names shall not duplicate any existing street name except where a new street is a continuation of an existing street:. Street names that may be spelled differently but sound the same as existing streets within Camas County, Idaho shall not be used; and.

B. All new streets shall be named as follows: Streets having predominantly east-west direction shall have phonetic names; streets having predominantly north-south direction shall have numerical names; meandering streets shall be named "Drive", "Lane", or "Path", and cul-de-sacs shall be named "Circle", "Court", and or "Place".

4-6: INTERSECTIONS

Intersections shall conform to the following:

A. Angle of Intersection:

Streets shall intersect at ninety (90) degrees or as closely thereto as possible, in no case, shall streets intersect at less than eighty (80) degrees; .

B. Sight Triangles:

Minimum clear sight distance at all minor street intersections shall permit vehicles to be visible to the driver of another vehicle when each is one hundred (100) feet from the center of the intersection; .

C. Number of Streets:

No more than two (2) streets shall cross at any one (1) intersection; .

D. "T" Intersections:

"T" Intersections may be used wherever such design will not restrict the free movement of traffic.

E. Center Line Offsets:

Street center lines shall be offset by a distance of at least one hundred twenty-five (125) feet; and.

F. Vertical Alignment of Intersection:

A nearly flat grade with appropriate drainage slopes is desirable within intersections. This flat section shall be extended a minimum of one hundred (100) feet each way from the intersections. An allowance of 2% maximum intersection grade in rolling terrain, and 4% in hilly terrain, will may be permitted.

4-7: PEDESTRIAN WALKWAYS

Right-of-way for pedestrian walkways in the middle of long blocks may be required where necessary to obtain convenient pedestrian circulation to schools, parks or shopping areas; the pedestrian easement shall be at least ten (10) feet wide and extend throughout the entire block.

4-8 EASEMENTS

A. Unobstructed utility easements shall be provided along front lot lines, rear lot lines and side lot lines when deemed necessary;. Total easement width shall not be less than twelve (12) feet where lots adjoin. Unobstructed drainage way easements shall be provided as required by the Council.

B. Where a subdivision is traversed by a watercourse, drainage way, channel or stream there shall be provided a storm water easement or drainage right of way which substantially conforms to the lines of such watercourse, and such further width or construction, or both, as will be adequate for that purpose. The commission/council may require additional setbacks from watercourses, applicable not only to buildings, but also to any disturbance of the stream banks and edge habitats to protect the natural vegetation and other habitats along the riverbank and to protect structures from damage or loss due to riverbank erosion.

C. Provisions for adequate snow storage and drainage may be required by the commission/council. If such provision is deemed necessary the applicant wherever public parking, public or private streets, or other uses requiring the removal of snow are identified, the developer shall provide specific site locations protected for the storage of snow and the consequences of melt water. If an offsite location is identified, developer shall provide evidence of commitment, to be so designated on the plat, to allow the storage of snow. Snow storage areas shall be not less than thirty three percent (33%) of parking, sidewalk, and driveway areas. This area shall not be designated between any property line and setback line.

4-9: BLOCKS

Every block shall be so designed as to provide two (2) tiers of lots, except where lots back onto an arterial street, natural feature or subdivision boundary;. Blocks shall not be less that that three hundred (300) feet long in all cases, nor exceed four hundred (400) feet in length.

The length, width and shape of blocks shall be determined with due regard to adequate sites suitable to the special needs of the type of use contemplated; the zoning requirements as to lot size and dimensions; the need for convenient access, circulation, control and safety of street traffic; and the limitations and opportunities of topography.

4-10: LOTS

Lots shall conform to the following:

A. Zoning: The lot width, depth and total area shall not be less than the requirements of any applicable zoning ordinance conform to the minimum standards for lots in the zoning district in which the subdivision is planned.

B. Corner Lots: Corner lots shall have sufficient extra width to permit appropriate building setback from both streets or orientation to both streets.

C. Lot Lines: Side lot lines shall be essentially at right angles to straight streets and shall conform to the radius of curved streets.

D. Width Related To Length: Narrow, deep lots shall be avoided.
