NATIONAL SHERIFFS’ ASSOCIATION SUPPORTS NATIONAL ASSOCIATION

OF STATE AGENCIES FOR SURPLUS PROPERTY

(FEDERAL SURPLUS PROPERTY PROGRAM)

WHEREAS, the National Sheriffs’ Association (NSA) recognizes the limited fiscal resources available for the procurement of vehicles, electronics, office furniture, commodities, and other property necessary for the operations and public safety missions of its members; and

WHEREAS, the mission and goal of the 56 State Agencies for Surplus Property (SASPs) that make up NASASP Inc., in partnership with the U.S. General Services Administration, is to save taxpayer dollars by extending the useful life of federal excess/surplus personal property assets is "for the public good" and ensure that it serves the "welfare of the whole;" and

WHEREAS, the National Association for State Agencies for Surplus Property (NASASP, Inc.) and its member states (SASPs) serve more than 65,000 organizations nationally—and specifically—more than 15,000 public safety agencies, including county sheriff departments; and

WHEREAS, the State Agencies for Surplus Property (SASPs) donates a variety of excess and surplus federal property to County Sheriff Departments throughout the United States thereby effectively reducing program costs to our law enforcement agencies by acquiring items that are new/unused or have been used to their life expectancy; and

WHEREAS, NASASP, Inc. believes the highest and best secondary utilization of property made available by federal agencies and federal military branches is to the public and private organizations of this nation that are dedicated to the education, training, health, civil protection, safety, and other public benefits of our nation;and

WHEREAS, 40 U.S.C. 503 authorizes executive federal agencies, when acquiring personal property, to “exchange or sell” similar items and apply the exchange allowance or proceeds of sale in whole or partial payment for the property acquired, and that such provisions sanctioning this process are found at 41 CFR part 102-39; and

WHEREAS, the U.S. General Services Administration encourages, represents and authorizes such trades and sales of federal property without ensuring the best reutilization, without sufficient accountability, thus resulting in loss and value of taxpayer owned assets;

THEREFORE, BE IT RESOLVED, that the National Sheriffs’ Association does hereby consent and decree that it supports NASASP’s proposed changes to the Exchange/Sale provisions to provide the maximum amounts of property to our local communities through the Federal Surplus Property Program and urges all Sheriffs Offices to contact their State Agencies for Surplus Property for further information.

BE IT FURTHER RESOLVED that NSA urges the U.S. General Services Administration to incorporate the changes made by NASASP into their current policies on the Exchange Sales Authority
