BOOKING CONDITIONS

1.  Conditions of Hire

Bookings between the owners or owner of the above property (hereinafter called the Owners) and the person making the bookings (hereinafter called the client) are valid after (a) the Booking Form has been completed and signed and has been received by the Owners;(b) the appropriate deposit has been paid to the Owners; and (c) the booking has been confirmed to the Client by the Owners in writing. Telephone reservations can only be held for a maximum of 3 days. The owners reserve the right to cancel the reservation thereafter unless a completed Booking Form and the appropriate deposit has been reserved.

2.  Booking

By signing the Booking Form, the Client accepts these conditions and warrants that he/ she is authorised to agree them on behalf of all other persons named on the Booking Form including those substituted or added by subsequent agreed amendment of the booking. The Client may not sublet nor assign the property nor share with persons other then those persons on the Booking Form or otherwise agreed with the Owners.

3.  Initial and Balance Payments

A booking deposit of 25% of the total cost of the holiday (but not less than £150/$200

is paid at the time of booking. The balance is payable not less than 8 weeks prior to the rental period, except where booking instructions are received within 8 weeks of the rental period when payment in full must be made with the application. If the Client does not pay the balance due at the prescribed time the Owners have the right to cancel the booking. In this event the deposit will be forfeited.

4.  Cancellation

Any cancellation by the Client must be notified in wiring directly to the Owners. If the notification of cancellation is received by the Owners more than 8 weeks before the rental period, only the deposit will be retained If less than 8 weeks, then the following cancellation charge will apply:

Between 6 and 8 weeks before rental period 75% of the total cost.

6 weeks or less, the total cost of the rental is forfeited.

All cancellations must be notified in writing by the person who signed the Booking Form.

5.  Availability

Rental period commences at 4.00pm local time on the day of arrival as specified on the Booking Form and the property must be vacated by 11.00am on the day of departure.

6.  Restrictions

Persons/children under the age of 21 years are not acceptable unless accompanied by parents or a responsible adult. Please also note the bookings cannot be accepted from either all male or all female parties.

7.  Liability

The use of accommodation and amenities including the pool is entirely at the user’s risk, and no responsibility can be accepted by the Owners or their agents for injury, or loss or damage to the user, visitors or their belongings, howsoever caused. Baggage and personal belongings are at the Clients risk at all times, and no responsibility can be accepted for loss or damage to any car or its contents. The Client is strongly advised to take out full and adequate travel insurance to cover all members of the party.

Children must at all times be supervised by parents or other responsible adults when using the swimming pool. All persons use the pool and surrounding areas entirely at their own risk. Diving is not permitted.

8.  Security Deposit

The Client is responsible for the property and is expected to take all reasonable care of it. All damages and breakages are the legal responsibility of the Client, and their cost shall be refunded on demand. Any maintenance or repair of the premises, equipment, amenities or fixtures required due to misuse will be charged to the Client. The Owner reserves the right to charge for excessive cleaning at the end of the hire period. A refundable security deposit of £100/$150 is charged and must be paid to the Owners when the balance of the holiday cost falls to be settled. Refund by the Owners follows a satisfactory report from the Property Managers and return of all keys.

9. Complaints

Should the Client consider that there is any reason for complaint whilst staying in the property; the Client must first approach the local Property Managers who will endeavour or rectify any problems immediately. However, should the Client wish to pursue the matter with the Owners, the complaint should be made in writing and submitted within 7 days of return to the U.K.

10. Force Majeurs

The Owners or their Property Managers will not be liable for any loss or delay to or cancellation of the Client’s holiday due to industrial disputes, riots, threat of hostilities, political unrest, natural disasters, aircraft grounding, closure of airports or ports, weather conditions or any circumstances beyond their control.

11.  Unavailable Changes

Should the Owners home be unavailable, the Owners will, upon request, endeavour to find the Client suitable alternative accommodation. The Owners will not have inspected other properties and will rely on representations made by relevant Property Managers and, as such, they do not make any warranties, express or implied, as to fitness or suitability and will not accept any responsibility for any inadequacies or misrepresentations. All complaints must be made to the Property Managers from whom the keys to the property would have been obtained. If this condition applies, it replaces condition 9 only. All other conditions remain unaffected.

The Owners reserve the right in any circumstances to cancel the booking and in this event all monies paid will be refunded in full (but without interest or compensation).

12.  Safety and Security

The Owners and Property Managers reserve the right to enter the property at any time for whatever reason.

13.  Property Descriptions

All property descriptions are given in good faith and every care has been taken to ensure accuracy but no liability will be accepted in the event of any error or incorrect descriptions.

14.  Contract

This contract is subject to and shall be constructed in accordance with the Laws of England and the parties hereby submit to the exclusive jurisdiction of the English Courts.
